You should write your elected officials every time the VA gives you a hard time. Make it your mission to hold them accountable. Write the ACLU and the media. They need to change.

2 military psychiatrists, and a VA psychiatrist said I had ptsd when I came back in 05. C&P rated me adjustment disorder and I was in rating hell for 12 years.

I've had to repeat C&P exams for allergic rhinitis-sinusitis, and ibs (TERA, Presumptive/Pact Act) in Memphis. The doctors don't know what they are doing. The Regional Office in Nashville has to reschedule and switch vendors, until someone did it right. The Chicago Regional Office, low balled me on my gerd rating and PTSD effective dates. I had to go to BVA, still waiting to be picked up, two years so far.

When I was going to C&P exams the va would only send some of my med records , so my wife downloaded all of my med records onto an I-pad , brought it in with us, it saved my ass every time ,

Got a letter saying my lung cancer is in remission, took the 400 month SMC-S away. This after going to VA contractor and blowing into a tube. My oncologist can't believe this is how it works

Yes, I got out at that time with bunch of us E-5, E-6. When I filed for disability later in 2014, had to pay back the bonus for disability pay.

Hey Craig, good evening, I am currently on retirement leave and recovering from a C4-C7 neck fusion trying to get my BDD claim changed back because the VBD rep didn't submit the health assessment part a with the claim ..now it's processing the day after I retire....have all email traffic reg guidance sent to the VBD director and still no help...single father full custody 24 years active infantry soldier multiple OEF/OIF tours

It is imperative to establish community organizing on a minimum level given the veteran's disability and poverty in many cases. The simple idea is to vote against any politician for the local level on up, all the ones who do not prevent this clawing back, b.s. What is going on is called private equity asset gathering. Those with wealth, hiding behind secrecy provisions, are paying off politicians to claw back benefits from governmental outlays, not only from veterans but from individuals in general, and reward the wealthy who invest in the theft racket for their "services." In other words, we have a system designed and maintained by big money worldwide to find ways to take government money back from the people, intended for the people, for profits. It's financial capitalism running wild. On the one hand, it can be assumed that those at the very top, who profited from investments in the equipment for the wars, are also profiting from having created the wars. The only way to stop this vicious cycle is to punish the politicians standing by allowing these "clawbacks", while on the other hand, taking money from the very sources responsible to fund their campaigns. It is essentially a mafia move called strong-arming and extortion. Thank about it. if people knew, when they're being damn near forced to "thank us for our service, at the same time, money is being taken from veterans for copays (that the veterans don't even know about) while we veterans lay dying..., they wouldn't stand for it. A letter campaign can easily be launched, and I'll volunteer. Health care, just like it is for the people who are doing these clawbacks, should be free in the first darn case. Paying for health care means encouraging pharmaceutical companies to invent "drugs" to treat diseases thereby squeezing out funding to prevent disease. You're experiencing in many cases the last of your days, and what little money you have is being stolen. Veterans are not babies and we shouldn't stand for this crap. More than in any other grouping the veterans are the ones most capable of winning this war over justice plus exploitation of the most vulnerable. Salute! Combat Craig. I like the haircut, brother.

Are they changing the status of the discharge and adjusting the VA benefit? Thank goodness you had some notes to untangle a part of this. Some of the notes make sense in that if the issue for which you were having disability resolves or improves or does not prevent employment you no longer rate that payment. Civilian insurance benefits work the same if investigators find your status has changed and you did not update they may even charge you for fraud. Tricky situation when that is not the case or the VA makes a mistake. I've done a few C&Ps lately but they are checking the VA findings as the disability rating sits and my claim also includes my records, drs findings. I would not let the C&Ps be the only part of it.

I was scheduled for a surgery following an injury at wk it was in SFVA on a Saturday. I got there & no Dr.! I called my Senator (Kamala Harris at the time) & within 30 minutes I was called by the VA to apologize & reschedule. I was originally told the Dr.s dont like coming in on the wknd. (So why schedule it?!) Point 2 Craig you gotta stop interrupting. Caffeine alcohol whatever yoire drinkin... Chill! Love the content orherwise.

In 1994 I knew ALOT of fellow soldiers, at Ft. Bragg and Ft Hood that took the early out, and they all knew they had to pay that money back before they hit retirement age. They also were allowed to use the commissary and post privileges (all benefits) for either a year or 2. I don’t understand why you guys are saying the VA is screwing them over by taking the money back, they knew it had to be paid back when they took it. Please explain?? Another thing that irritates the shit out of me, I got hurt broke my fibula in Iraq, (actually Saudi Arabia the day the war started) had a plate and 5 screws put in my ankle, medevac’d to Germany, where I was medically terminated from jump status by a leg Dr. I get a crappy 20% for this. And I know ex soldiers that got in a car accident off duty getting 100%, and a guy that got shot off duty in a bad area (doing something illegal) and he’s getting 100%. WTF 😡

@@iokona yeah this has been in effect for forever. But who's getting 75,000 for involuntary separation pay that's nuts I got 17 K they can take it back that's six months of my pay. I'd always take the separation pay and continue to file for disability take my chances worse comes to worse going to Hudvash they're gonna pay either way

The reason people fall into adjustment disorder is because they talk too much about their job and dealing with people. You have to talk about how you feel about yourself, how you feel about people around you, how you feel about your family members, and how you no longer enjoy doing things.

Hi would like to know if I just started my claims in May . I had 2 C&P exams. They covered headache, back and headaches. Why haven't they scheduled my MST C&P exam for that yet

As long as you have the claim in there, it will be covered. That's a big one too. There's a bill HR6023 I think that would pay Vets for their MST rating from the date they left service if it gets passed. It's getting traction but been introduced probably a year ago.

I was recently increased to 100 percent p&t from 90 percent in my rating. However the VA did something weird where they only back payed me to April instead of last June when I put the intent to file in. I want to submit the back pay for review but I'm concerned that they might try to bump me off p&t even though my request has nothing to do with my actual rating. Has anyone experienced anything like this?

Also not true, I have been rated 100% P&T for Bipolar Disorder. If you're Bipolar Disorder is service connected apply for disability.

Further on static conditions… what are the requirements to get conditions approved to be static for P&T versus non static? Is chronicity demonstrated or an IMO what’s needed to be submit? Is a request for P&T or static status a particular claim to be filed?

Yes, if you Medboard and did not medically retire they will ask for their money back. The good news is veterans who get medically separated have it taking out automatically vs those who get a random notice that their money is going to be taken away.

depends they often put a re examine note in your records i think the general time frame are 6mo 1yr 3 yr 5yr , i got a mental re exam after every completed therapy in OH and when i stopped therapy ..shity VA therapists

I believe 38 CFR prescribes the re exam time frames. But remember VBA constantly violates its own regulations. I could relate my experiences regarding this but it would entail way too much typing. Thankfully I'm 100% p&t/every condition is classified as static. Took me over 20 YEARS to achieve this! The cherry on top is also receiving SMC S, an additional $400 a month.

No I was landed in a state mental hospital with what they did to me during the Clinton administration. I was recommended for the medical enlisted commissioning program and SCORE conversion to Hospital Corpsman.
