Article 1250 according to De Leon's Book, the amount liable by debtor is the equivalent amount of the obligations currency today (if 5k obligation and now value nya is 10k, debtor's obligation is 10k) unless there's stipulation that regardless of inflation and deflation debtor's liability will stay as what its value upon making the contract.

For article 1250, one of the requisites that must be proven in the application is an official declaration from the BSP of the said extraordinary inflation, and that the said obligation is contractual in nature. The parties should have, also, stipulated the consideration of the effects of the said extraordinary inflations. Currently a law student. Gusto ko lang i-share since na compare ko sa book ng oblicon for college, mas detailed sa book namin ngayon sa law school. By the way, I used De Leon’s Obligation and Contracts 2019 version for this. Based lang sa understanding ko po and for the purposes of determining the amount, you have to take note if there is ordinary or extra ordinary inflation or deflation... If ordinary (which is there is no declaration by the government), yung babayaran mo is yung kung magkano talaga inutang mo Pero if may extra ordinary inflation or deflation which is you have to check if may pronouncement ba talaga ng government Formula: Yung babayaran mo is Value at the time (inutang) divided by value at the time (babayaran) multiplied amount of utang Example: Assuming, A borrowed 100M from B on June 1, 2022 and due on June 1, 2042. Due to inflation naging 50M na lng sya Due to deflation naging 200M na lng sya If ordinary inflation or deflation Yung babayaran ni A is 100M If extra ordinary inflation 100M/50M x 100M = 200M ang babayaran ni A If extra ordinary deflation 100M/200M x 100 M = 50M ang babayaran ni A Correct me if I'm wrong especially on the use of terms or construction of examples.. tnx

EXTRAORDINARY INFLATION OR DEFLATION That which is unusual or beyond the common fluctuation in the value of the currency, which the parties could not have reasonably foreseen or which was manifestly beyond their contemplation at the time when the obligation was established. Requisites: 1. There must be a decrease or increase in the purchasing power of the currency which is unusual or beyond the common fluctuation in the value of the said currency 2. Such decrease or increase could not have been reasonably foreseen or was manifestly beyond the contemplation of the parties at the time of the establishment of the obligation.

About the application in Art. 1250, there will be an application of an extraordinary inflation or deflation, when the government announced for its inflation/deflation. Thus, the formula shall be applied in determining the value of the payment/amount of the obligation.

Sir I have a question, if you have a brother and your brother is sued for non payment of his obligation, can you pay on his behalf without his consent and knowledge?

Since wala ka naman sa mga listahan ng mga posibleng interesadong parties sa fulfillment ng obligation, then subject to provisions of Art 1237, you can actually pay, given na the creditor accepted the payment (however, since your brother has been demanded in court, then provisions regarding the circumstances of non-payment should apply (Art. 1169-1170, fraud, negligence, or delay), and he shall be liable for damages caused by non-payment in addition to the principal obligation), but if your brother does not consent, then your payment accepted by the creditor remains valid to him/her, and the obligation of your brother to the creditor is extinguished; but to your brother, you can only reimburse from him the amount you paid only to the extent kung magkano naging benefit nung pagbayad mo ng utang niya sa kanya, but you cannot compel him in a way na ikaw na yung magiging bagong creditor niya in essence (subrogation of creditor's rights to you). Correct me if I'm wrong po huhu I'm also still studying XD

in 28:07, what if po debtor consent the payment (thus deemed donation) pero ayaw tanggapin ni creditor because instead of receiving cash, the 3rd person is offering a share in the company? Thank you po!

The creditor cannot refused the payment kasi valid siya? Diba ang third person is yan din yung paid as donation? Hindi yung nag offer ng share sa company. Di naman siguro pwede magkaroon ng dalawang third person or mag offer ng dalawang modes of payment ang third person? Not sure po.
