IMO, I can't say that two years is too little, but the judges words here are very offensive, and Im not even the family. Basically the family just listened to a judge talk about how Potter's actions weren't a big deal. The judge should have just gave the sentence and not said anything else justifying it, because it's basically insult to injury for the family. My heart breaks for the family. I hope Kim Potter understands how very lucky she is.

Taking a life when you are trained to protect should ever be considered a mistake. A mistake is putting hot sauce on your fries instead of ketchup. You can’t bring a life back once you take it. Man gets pulled over for warrant related to firearms charge. Man is told to exit the car. Man is told to you are under arrest for the warrant and asked to place his hands behind his back. Man resists arrest. Man fights and struggles with police attempting to enter his vehicle to flee and or obtain a weapon. Officer fires on man who has a weapons warrant, has shown a disregard for the law and a willingness to fight officers and potentially using his vehicle as a weapon. Nah. Police officers have a slew of non-lethal alternatives. If he wasn’t in active possession of a lethal weapon, lethal force is NOT warranted. If someone claimed self defense after shooting and killing someone and it was found that they were not in possession of a lethal weapon, the killer would probably lose his case and be charged with manslaughter. Not to mention she shot SIX shots in an apartment building with children around. Even if she didn’t kill someone, that’s reckless endangerment.

Unfortunately not. Once appointed a judge has to commit an offense worthy of impeachment and they cannot be removed by any other means for the duration of their tenure in office. And that tenure is usually a life duration, except under very very niche circumstances. And she isnt the first one either. I can think of a few judges across the globe who have made me raise an eyebrow over their sentencing. In my 6 years of law Ive seen a good fair share of cases where Ive just gone "what? what is this?" because it's just been so out of character in relation to case precedent or even, in some cases, the judge's personality themselves. It happens, rather unfortunately, more often than people think.

No the judge should be fired. Judges must follow state law minimum sentencing guidelines for a guilty conviction of the charges. Yes, Kim made a mistake BUT prosecutors charged her appropriately with the manslaughter charge. You cannot accidentally kill someone and then cry victim. You have to do the state minimum required time and do your apologies in front of the parole board when you are eligible

@@kia73k95 nobody can say exactly what was going on in Chu’s head that made her unable to contain her emotions, but this is a unique circumstance where 999/1000 cops would not have been found guilty. Doctors don’t get charged with manslaughter when they accidentally kill a patient. It’s a civil thing, like suing for money kind of thing. When you’re doing your job and you make a mistake, that’s not supposed to result in criminal charges let alone a conviction. That goes for everyone, except in the case of cops their job is to use force to stop bad guys, and that includes potentially killing people

The presumptive sentence for 1st degree manslaughter in Minnesota is 86 months. This downward departure was very extreme!

Not at all. You are forgetting the fact that it also depends on the percentage of role a person plays in the manslaughter. Wright chose to fight the cops trying to take him in to custody, who did not know if he had his gun he used in so many other crimes. This includes when he shot an 18 year old man in the head then left him to die. Wright could have also grabbed a cop's gun injuring or killing other people. Then Wright almost ran over several cops taking off fleeing. If Wright had not sped off he could have received immediate health care and would likely still be alive. Instead, he sped off while internally bleeding, then aggravated his condition by slamming in to another vehicle where he could have also killed someone. Wright chose to put himself in that position, and therefore Wright is more responsible for his death than anyone else.

@@emm8357 So what? People often survive gunshot wounds of the chest if they get immediate medical attention. I have worked in medicine 43 years including working on an ambulance and working the in the emergency room. We even had a patient put a 357 under his chin to commit suicide and literally blew almost half his head off and survived. His jaw was still there, but half of his head above the jaw was gone. Last time I saw him we were still trying to teach him to feed himself. When a bullet enters the chest there are so many things to take in to account. What kind of bullet, the caliber, dd the bullet deflect or bounce in the chest, what organs were hit, etc. When i worked on the ambulance we had a 15 year old kid killed by another kid who shot him through the chest with a shotgun slug. The slug entered his chest near the top front and left about a fist sized exist hole in his lower back because the slug deflected in the chest damaging a lot of organs on the way. Some bullets go right through or lodge in the bones. Not everyone shot in the chest dies, just like not everyone shot in the head dies. Just ask the 18 year old man Wright shot in the head and left to die, but managed to survive but is now permanently paralyzed. This is why I said that IF Wright had not fled then he could have got immediate medical care and MAY have survived. We will never know though because this dangerous career criminal decided to flee delaying medical care then aggravated his injury by slamming his car in to another vehicle.

I suggest you watch them take the stand, it was a fatal wound and there was no way he could have survived for a number of reasons, which the ME can explain far better than I’m able to.

@@emm8357 I suggest you learn something about medicine instead of relying on assumptions. Medical examiners contradict each other all the time since they are basing a lot of this on opinions. They do not have some magical crystal ball to see what would have really happened. Look at Bob Sagate's death recently for example. The medical examiner determined a fall in his hotel room. Various other medical examiners though came forward and clearly stated that what the first medical examiner claimed was impossible. By the way I did listen to the testimony of the medical examiner. And there was no mention by the ME of the path that the bullet took or what organs were affected. He gave a rather wide range, considering the wound, on how long it would take for Wright to die. And no mention at all if immediate medical attention could have possibly saved his life. And I did not hear the ME say even a single time that there was no way Wright could have survived, and again this is not even taking in to account immediate medical intervention. This clearly was not an instantly fatal shot as he had plenty of time to speed off. And you have no clue if any of the police officers present had medical training or not, including possibly having been a combat medic trained well to deal with these kinds of wounds. We will never know what could have really happened though because this dangerous career criminal decide to speed off preventing any type of immediate medical care.

Because resisting arrest is not a crime punishable by execution. A responsible, actually humane cop will allow someone to resist and run away instead of shooting them dead, as any other normal human would (unless the criminal was actively threatening people, which this victim wasn't). Police should avoid killing citizen whenever possible. Minor crimes do not become death warrants just because you resist arrest.

Dante Wright's life ended that day. She made a mistake. Though let's look at why that mistake happened. But for Dante Wright's actions of resisting while being arrested on a lawful warrant, none of this would have occurred. There would have not been a split second decision and mistake by the officer. Dante Wright created the situation that caused the mistake that ended his life. If this is the road the people of Minnesota want to go down, the state is about to become dangerous state in which to reside. No one will want to become a law enforcement officer there. As is shown by the dramatic resignations and retirements occurring there now.

I agree the judge should be fired. In most states the judge has no discretion over the mandatory minimum sentence requirements that go with a guilty conviction. The reason the law has mandatory minimum sentences is to block uncle tomming judges like this that are racist towards blacks and give them max sentences while giving whites a slap on the wrists for the same guilty convictions. In most states manslaughter in the 1st degree is a minimum of 8 years.

The sentence was actually more than it should have been. Wright contributed a large part to his death. This was nothing more than a bad accident precipitated by a career criminal who had already committed armed robbery, home invasion where he held a gun to the victim's head, carjacking and shooting an 18 year old man in the head and leaving him for dead!!! And these are only the crimes we know of. How long before he actually killed someone if he had not already that we know of? Wright had a history of armed violence, then fought with police before being accidentally shot. He then fled in the car putting himself, his passenger, pedestrians including children and the occupants of the vehicle he slammed in to at risk since Wright clearly had no regard for anyone's life including his own. Something else to keep in mind is that if Wright had not sped off after being shot the police could have gotten medical aid much faster and his injuries would have been less severe so that Wright may still be alive. Wright did a lot to contribute to his own death and the sentence given to the cop for this reason is actually pretty severe. Wright put himself in that position where he could be harmed, and again delayed medical treatment and further exacerbated his injuries by speeding off and crashing in to another vehicle.

Manslaughter means you accidentally caused the death of someone with no malice or aforethought. Whether or not the victim contributed to you accidentally killing them does not erase the fact you killed them. The video clearly shows Kim grabbing for her taser WITHOUT LOOKING at what she was grabbing and then shooting the victim. Even without looking at what she was grabbing there is a very strong difference in feel, weight, and position of a taser in your hand versus a gun. When you hold a police taser only your first 3 fingers can be used with it because the handle it too short for all your fingers whereas when you hold a police gun all of your fingers can fit to hold the handle. When you make a mistake that resulted in killing someone you are guilty of manslaughter. The state laws already take into account the difference between murder and manslaughter charges and that is why there are minimum sentence guidelines for every charge. The judge should be fired for not following the minimum sentencing guidelines. The minimum sentence already takes into account everything you wrote! The reason why there are minimum sentences is so that the victim's family receives some level of damages for the life that was taken from them. Your comment only focuses on the victim. But what about his mother, father, aunts, siblings, uncles, children, etc? There were not all "living a life of violence" and they suffered unrepairable harm in the loss of the victim. Nothing the victim did prior to the shooting grants a cop to shoot him dead. Nothing the victim did prior to the shooting grants a cop to play the role of judge and jury. Nothing the victim did prior to the shooting would have resulted in a death sentence in court.

Judge Regina Chu has 20 years in the Judicial experience did not consider the aggravating factors were not proven but ignored gross negligence by the white police woman. Judge Chu did not consider the racial component of this case .I believe with this Decision Judge Chu would be forced to shorten her term. She would be forced to resign her position. If defendants received empathy because... say... it was a first offense, and they had a history of serving their community? Wouldn't that be a good thing, regardless of color? A black hero, a firefighter, is arrested for a first offense, shouldn't he get more empathy than a nine time woman beater or child molester or other type of criminal? Serious questions... they let Darnell Brookes off with $1,000 bail after he ran over his girlfriend with an SUV, and then he went and ran over a bunch of grandmothers and children a few days later. Shouldn't people with a history of community service, and no criminal history, get more empathy?

How do you know she mistook her gun for taser? We can’t ever know that Ms. Chu, we cant read someone’s mind. She killed someone and she gets a small sentence. The judge coddled her. If tables were turned, there would another bias toward civilians. He wasn’t fighting her, nor was her life in peril. Regina Chu makes a joke of non-biased ness. “She deserves some accountability” Judge Chuu said about Officer Potter. She is pushing her beliefs on the law. So if a rookie made that mistake they would be more guilty? Regina Chuu doesn’t make her point. She was probably a weak lawyer and now a sorry Judge.

That would be up to the lawmakers to add that distinction. However, I'll answer your question gladly and the answer is this: How do we know that the countless people in prison for murder for use of a firearm didn't fire it by accident? And the countless people dead from being killed by police for simply holding a weapon, how do we know that those, now deceased people, grabbed the object they were holding by accident? Lawmakers need to intervene to give police more non-leathal ways that actually work to physically subdue people versus just guns. Guns will always work, but they work too well. The fact is, the "accident" is a luxury afforded by (given to) the layperson. It's not allowed to those supposedly "trained" to avoid accidents. What upsets me is when they claim to be professionals "highly trained" for situations just like this one - highly chaotic and violent -- but then play the "I'm just human" card when they screw up and plead for sympathy. Part of that line of work is to be "keenly focused" (almost androidic) and to "know" what you're doing. It's a very high standard, but they know that when they take the oath. -- Another example (relevant to this): police are supposedly "trained" in firearms. Yet only 19% of the bullets they discharge ever hit their targets. The rest fly "everywhere." making them as dangerous to the public as the gun-toting criminal. Run of thumb: just stay the hell away. You don't know which side is going to shoot at you.

Daunte tried driving away. His death resulted in his own actions. He wouldn’t be dead today if he would have complied, it’s that simple. Kim shouldn’t be serving ANY time but she is because she’s white and Daunte was black, am I wrong? It seems to me when a black person is killed by police that it’s an automatic response to claim they’re innocent and the office is at fault. Of course, sometimes the police are at fault and they should be held accountable. Sometimes it’s the black person’s fault, sometimes it’s not but EVERYTIME, it seems, the black community proclaims “their innocent”, “they were a good person”, “the police just want to kill us all” which is preposterous and jumping to conclusions rather than waiting patiently for the full story. Mob rules. If Kim didn’t get any time at all, the city would potentially face another riot like with George Floyd. You think they would risk that? I don’t think so. So now black folks have a upper hand, a privilege, when things go wrong for them with police. Hardly hear of any other race in the news anymore when someone is killed by police. “A black man was killed by police tonight…” ends up being the top story of the night and possibly for days. I’m not saying that their aren’t times when Police are in the wrong. I’m not saying there shouldn’t be action taken against someone that’s guilty. I’m saying, when a black person is killed by police, it’s guilty until proven innocent. That’s a poor mentality, it’s unrealistic. Some people are guilty. Daunte Wright had a warrant out for his arrest and decided to drive off, he was guilty. Did he deserve to die, no, but he would have been arrested and gone to court for being involved in illegal activity.

Suppose we take race out of the situation, i.e. Daunte Wright was a white man of 22 instead of a black man, but everything else stayed the same, i.e. he had an outstanding warrant out against him, he did not comply when being arrested, etc.. Would you still say that Potter deserved to be simply let go? She was supposed to be highly trained. There is no denying that she made a monumental albeit unintentional mistake which resulted in the death of another person. Killing someone should not be taken lightly at all, and merits some kind of punishment; you can argue whether her sentence should be 6 months or 24 months. On the whole, I think Judge Chu made the correct and compassionate choice. This is one brave, smart and compassionate judge who recognized the pain suffered by both the victim and the accused.
