F Lee Bailey Does Killer Cross. In the history of criminal defense and trial lawyers, there are only a few, a small few, who become household names, known to all, lawyers and laypersons alike. Clarence Darrow, Johnnie Cochran in real life, in fiction, Atticus Finch, Matlock and Perry Mason come to mind. F. Lee Bailey is one of those lawyers. At various times in his life, he was considered America’s go-to lawyer. He has been involved in at several so-called “Trial’s of the Century”. His clients include:
Sam Shepherd, the wrongly convicted doctor that was the basis for the movie and tv show, The Fugitive;
Boston Strangler;
Patricia Hearst, the daughter of the one of America’s richest families who was kidnapped and then joined the SLA, Symbionese Liberation Army;
George Edgerly, the first polygraph defense case;
Ernest Medina, the court martial related to the My Lai Massacre; and,
OJ Simpson, to name a few.
Bailey graced the covers to Newsweek and other magazines related to his rise to prominence. He has written at least 20 books including, The Defense Never Rests, For the Defense, To Be A Trial Lawyer, When the Husband Is The Suspect, Excellence in Cross Examination and his latest book, The Truth about the OJ Simpson Trial, By the Architect of the Defense. In our one on one we discuss Bailey’s direct, rapid fire and assertive cross examination style. He discussed how he approaches he different witnesses by circling them, luring them into complacency and pouncing on them using speed, precision, pace, word choice and logic. In our conversation, you’ll hear trial stories, war stories, cross examination, strategies from the most famous lawyer in the 20th century. We discuss the state of lawyering, the state and quality of current cross examinations, Marcia Clark, Christopher Darden, Johnnie Cochran, OJ, Robert Shapiro, Judge Ito, Mark Fuhrman and the best cross examination of a crime scene officer I’ve ever seen, Sgt Rossi, who responded to the Bundy murder scene. We talk about the glove, the jury and more. Bailey discusses defending Patricia Hearst, the heiress who made international headlines when she was charged with bank robbery and more. He discusses how he got hired, his involvement, the impossibility of the defense and his incredibly powerful cross examination of the government’s psychiatrist witness Dr Joel Fort.

22:17 I'm glad to hear you appreciated my 10-minute edit of Bailey's cross-examinations so much. It was crammed into 10 minutes, because back in 2011, we could not upload videos longer than that. Btw, I practiced law in Las Vegas in the '90s and corresponded with someone you know, Gerry Spence, after I reviewed his book for Nevada Lawyer, "How to argue and win..." --I reached out to Lee in September of 2020 to interview him for my law article called "How Law School Orientation Broke my Heart," which is my speech to a first-year student, with pointers for law school, but he declined.

few people know that the movie Fugitive was inspired by his first case when he won the appeal. in the movie, the character does not have FL Bailey as a lawyer so he had to escape.

R.I.P Lee Bailey. I remember watching on TV in England the Trial of O J Simpson. It was ground-breaking compelling watch back then and remember seeing him being part of the Defence Team. OMG Where have those 26 + years gone!! He had a long and somewhat 'interesting' life Since this pandemic messed up the human race 16 months ago i have spent a lot of time watching a lot of classic British and American films of in the main the 60's and some from the 70's and although i was a child of the 60's i still love the decades today. I have watched the 6 James Bond films with the wonderful Sean Connery who was my favourite Bond for many reason and came across on KZbin a couple of videos posted, one around 15 minutes long and one around 35 minutes long of Lee interviewing Sean and his then wife Diane Cilento around mid 67 at their home which was then in Acton, West London. The style of Lee's interviewing skills were so relaxed and informal. I think both men got on. I have looked on Google and found that Lee became host of a short-lived ABC TV series from 67 called GOOD COMPANY where he interviewed CELEBRITIES in their own homes.

Cross examination to get off killers would be a better title for this song. Bailey was a brilliant lawyer but let us not forget the victims of his clients’ crimes. He was smart enough to know his clients were murderers. He was also extremely unethical. Why glorify him? We should glorify teachers and nurses. Most lawyers pursue the law to satisfy their egos. I graduated from law school but did a lot of soul searching. These intellectual narcissistic thugs would be my colleagues. So I decided to do music and write songs. I’d be a wordsmith and it would be a totally harmless undertaking.
