I've been flying RC motor gliders for 30 years.... 400' AGL? The AMA recommended such restrictions only when within 5 miles of an airport. To enforce this EVERYWHERE is to kill a perfectly good hobby... Thanks again government... Starting to think Jefferson was right about the tree of liberty...

"These are all recommendations not laws" I would strongly suggest any inexperienced/new pilot follow these "recommendations" I also agree with everything on that list minus beyond line of sight fpv. I think anyone flying "Model Aircraft" already knows these rules from the AMA. The biggest thing to remember "you" are "responsible" for your actions and any damage you do. I have flown over 3000 FPV flights beyond LOS and never had any accidents that harmed people, manned aircraft or property. I do follow all the rules stated in 91-57.

This December 21, 2015... The FAA is requiring all Swinging Pallywackers be register as it is in free flight during the drying process. You must submit photos and a $5 fee to the FAA headquarters located at 711 cold shriveled Ave. Once received and evaluated you will be given a number at which you must write immediately on the pallwacker before use. You can either use permanent ink or a sticker. there are STIFF fines and HARD punishment for not complying. Have a great day and remember we only care for your best interest!!! There is a $5 charge for reading this..

I live on a 105 acre farm in the boondocks. They built a new hospital 4 miles from me with a helicopter pad and they built an emergency helicopter service. Now, according to the rules, I can't even legally fly a drone on my own farm! BS!

If you take a lesson on how to fly your UAV, a fair assumption would be that a student would pay an instructor for that lesson. Except that would be a commercial use of a UAV, which goes against FAA's guidelines, thus opening the instructor up to fines and penalties. Also, I'm curious as to what the FAA's definition of 'near' an airport or 'near' people is? 10 feet near? Maybe a thousand feet? Or maybe it's 5 miles, which would basically exclude nearly all of the inhabitable spaces in the United States. If the FAA were to have it's way, Santa wouldn't be delivering any UAVs this Christmas. Bah humbug.

My comment a year ago has nothing to do with what the FAA has just announced over the past few days. For what it is worth, I do not see anything that they have announced to make flying any safer and just added a way to collect money from modelers.

These guidelines have been in place by the AMA for decades. The FAA has no jurisdiction over model airplanes and other model aircraft - it never did and never should. The air is filled with far more organic flying objects (birds) than there will ever be hobbyist "drones" (model aircraft). Bird strikes happen almost everyday. Birds can't be regulated. The same goes for quadcopters and model planes of roughly similar size and weight. To be rationally consistent, they should not be regulated either. Full scale pilots simply have to take responsibility and avoid small objects in the air as best they can. The gov't could make Orwellian laws to outlaw model aircraft, kites, model rockets, or even party balloons, but the vastly larger threat of small objects will remain - birds. I want to see the FAA regulating where birds choose to fly. Good luck with that one. The common-sense AMA guidelines that are in place are sufficient. There is no need for the gov't and FAA to get involved any further unless they are just looking for another thing they can license, tax, and fine to generate revenue for the gov't pickpockets.

Pretty sure the FAA is above the AMA, and the AMA is more of a "middle manager" on making decisions about things like FPV and such. That being said, as long as you stay below 400ft, five miles away from all airports, and aren't flying over populated areas then I'd say you're good.

Max Hodges flying below 500ft, 5 miles away from an airport in non populated. area is pretty safe. 16yr olds can drive motorcycles but you cant fly a 4lb toy below 500ft and take pictures and use those pictures for anything commercial. Hypocrisy.

The FAA does not, and never has had the authority to regulate RC flight below 400 feet. This whole "no commercial use" thing is ridiculous since there is no rules in place. Publish some rules/guidelines for manual operators or back off

+Justin Stubbs Hmmnnnn... Good observation. The rule calls for putting the number on a plane where it can be seen without having to use tools to remove anything. Best bet would be to put on the inside underneath the canopy as the canopy requires no tools to be removed...

If I'm following all the other "guidelines" and the only difference is that the shot i'm getting is for a client, then what i'm doing is "illegal"?! so i'f i'm out in a corn field, doing a dolly move 5 feet above the corn stocks and using that shot in a video for a paying client, thats illegal?! can someone please explain to me why if I follow all the "guidelines" in the video above, but the only thing I'm doing different is using the drone for a video, THAT makes me a criminal? so if I get that shot above the corn field by sticking a gopro on a pole and running through the corn and use that shot for a clients video, thats legal, but if I do the same thing using a drone, its illegal?! so being the law abiding citizen that I am, what do I have to do to be able to use the footage for a client without being a modern day billy the kid?! wheres the crappy video explaining that part!

Can someone summarize the FAA's thinking and supposed justification for prohibiting commercial use of drones unless the operator obtains a license for this purpose ? How do they justify such a rule or policy under their mandate of aviation-safety ? How is safety of drone-use different if hobby and commercial drones are flown under the same reccommendations for safe operation? I think that most of us know the real motivation for the FAA's new ruling, but how do they publicly justify this ?

The lawsuit, filed in the U.S. Court of Appeals for the District of Columbia, argues that the drone registration rules put in place last month violate a federal law that prohibits the FAA from regulating recreational drones. The lawsuit was filed by John Taylor, a drone hobbyist in Silver Spring, Md., who is requesting that court overturn the registration rules. The Department of Transportation (DOT) has said drone users will have to register their devices by Feb. 19 in a new Web-based tracking system that opened on Dec. 21, 2015. The agency is imposing a $5 fee for drone registrations over the objections of drone advocates, but the FAA said it is waiving the charge for the first 30 days of the new requirement. Critics have been threatening to sue the FAA over the drone registration rules since they were first announced in December. The Washington, D.C.-based Competitive Enterprise Institute said the FAA violated federal requirements for allowing public comments on the drone registration proposal, which usually lasts for a period of 30 to 60 days. The FAA has defended the legality of the drone registration system, saying it has authority to regulate all "aircrafts" that are flown in the U.S. "By statute all aircraft are required to register," the agency said in a statement that provided to The Hill in December. "Congress has defined 'aircraft' to include [drones], regardless of whether they are operated by modelers and hobbyists," the agency continued. The FAA declined to comment to The Hill on Tuesday about the lawsuit over its drone rules, saying it does not comment on pending litigation.

They've offered exactly zero reasons to comply other than a threat of "cruel and unusual" punishment in the form of egregious financial penalties, while not identifying one "bad behavior" which might warrant such a penalty.

What about low flying helicopters flying over private property in the country that has a landing strip long enough to land an ultra-light or small engine aircraft? Point being, THEY are the ones who always fly low enough to run into MY aircraft or our private landing strip in the country. So how can I regulate or make MY own rules to keep them away from MY property and endangering ME or even themselves? These type of things are starting to get very unfair.

ShadowⓋ If you own the airstrip, it can be listed as private, and no other aircraft can legally operate there except for emergency landings. If you don't own the airstrip, it's up to the owner to decide who can use it. It's a basic property rights issue, and penalties for trespassing are well defined by our most basic laws which have been working just fine for over two centuries.

K Danagger What about military or news helicopters? Sometimes they fly really low over my air strip almost every time I take my quad up, which I think could be dangerous for them because they could hit it flying over MY property. The last time this happened, it was a black helicopter and it looked like someone was hanging out the window taking photos of me. I was thinking maybe they picked up my quad on radar or something. I've also had the National Guard pull into my driveway. Funny thing is though, there's no known military bases near by and the nearest airport is more than 50 miles away.

Do you really need to use the term "unmanned" when talking about a toy quad-copter? If this is the new speak term of the month then come over and take a look at my grandson playing with his unmanned automobiles aka Hot Wheels cars. And I do not care for the word "Drone", that is a military airplane as big or bigger than my living room and its used to execute those folks on Obama's Disposition Matrix. Really do we need to call toy quad-copters drones? I do understand that given the right quad-copter and the wrong idiot someones going to get hurt somewhere. But someone is going to get hurt or killed in my city today with an automobile and some thug is going to kill someone this week in my city and everyday in some cities. I think real problems need to be addressed. All I see is efforts to infringe on law abiding citizens and hobbyists.

As a pilot, it's terrifying to me that these are the only rules that a drone pilot may have. I almost hit one while flying a helicopter in illinois. It could have killed me. Does anyone have a better link to more rules or know what might be done to regulate them more?

Instead the FAA go after Trappy and team blacksheep the benchmark in the hobby for safety in their setups and flight operations.
