Germany is now subject to EU law which, technically, is 'Corpus Juris', which differs from the 'Habeas Corpus' applied in the US and, once upon a time, the UK. The difference is very simple, under habeas corpus you are considered innocent until proven guilty in a court of law. With Corpus Juris, you are guilty until you can prove your innocence. This is an abomination as it's almost impossible to prove you didn't do something- after all, there will be no evidence of you not doing it. The reality is, in the EU, it's possible to be incarcerated for an indefinite period, without even being told what it is you're accused of - which increases the difficulty level of proving innocence to a far higher level. It also relieves the principle of 'beyond a reasonable doubt', so if you were where the offence took place, without any witnesses, and somebody said it was you, you're screwed. The other big difference is that, in the US, you can do anything you wish unless it is prohibited by law. The EU had already adopted the principle that you cannot do anything unless it is permitted by law - the style the WEF is intent on forcing on the world. The UK has already started down this dreadful route by giving local authorities the right to penalize people without trial & your only recourse is to 'appeal', which is usually refused, following which you have to take them to court, which most people have neither time nor money for...

I do nothing on facebook. I did not create one, I did not ever sign up, I never wanted anything to do with it. However, a spiteful neighbor created an account, used my picture from a local ad, and then spent two months pretending to be me with liking random stuff online. Then, spent two weeks making threats towards kids at the local school, resulting in a 2am visit from the local armored law enforcement detachment. Just out of the blue. Because he hated the fact I grew a hedge that blocked his dog from coming onto my lawn. I *despise* most social networks... but everything hinges on them now.

I travelled around the world as a Marine, retired in 97, and I found lots of people found our "right to speak" extraordinary, everywhere outside the US. We tend to take it for granted, but there was nowhere foreign I found that one could easily with confidence, simply ignore the issue. The last place I was overseas was Bahrain, and free speech was not an option there.

My first duty station when I was a US Air Force officer was Wiesbaden, Germany. During my orientation, it was pointed out that by German law, a German citizen can take you to court for insulting them and the court can compel you to make a written apology.

What you said still applies. I'm working on a Dept of Defense contract in Stuttgart and even I know that addressing police using the German article "Du" is an insult and arrest-able by the Polizei. If I've said it once, I'll say it again. Until they start holding judges fully accountable for garbage like this, the cops are going to do it. The judges rubber stamp this stuff. You can be absolutely guaranteed that if the judge's name was on that warrant as the suspect, they would have denied it before The ink was dry. But because that judge doesn't have any kind of personal interest or stake in what happens to the suspect, why not? It's not their stuff being stolen.

@@nonionbeezness except it's in the US laws too. There's no clear definition of "hate speech". Right now, it's simply speech which others find offensive - and that's just as dangerous. Speech is often provocative or offensive.. but it's how progress happens. That's why the supreme courts have ruled (at least until all this social bullcrap) that offensive speech is allowed by the First Amendment.

IMO, there's no way to define "hate speech" where all forms of discussion would be fairly represented; it really is that simple. It's a slippery slope. The first question you have to ask, is who gets to "decide" what hate speech is? Mob rule? Politicians? Nah; First Amendment says everything you need to know. All speech and ideas are protected. Inciting violence is NOT a form of a protected idea. It's a call to action. We already have laws. People being offended by the silliest things and forcing others to be in control of how something is perceived, is a dangerous proposition that easily leads to "thought policing". It's NOT my job to codify others, and it's certainly not my job to make others feel all warm and fuzzy when I speak. If my speech offends thee, don't listen. Quite simple.

FYI: the shooting: 2 cops were cold bloodedly executed. Everyone was shocked, because usually we neither have shootings in Germany nor any significant violence against leo. The network assertion act is purely against free speech. Everyone warned that it's a bad law, and it is contested in court. It will get stuck down eventually because it's clearly unconstitutional, but that will take years. In the meantime Leo can hold anyone in "contempt of cop" arbitrarily based on whatever the person says online.

People are entitled to have opinions that may be foolish and incorrect, provided that these opinions don't harm anyone (i.e. cause them to lose housing, employment, safety, etc. which is different than offending or insulting). SCOTUS has been working at eroding our constitution for decades. Two examples: qualified immunity instituted a caste system in ths country. Those who don’t have it are second class citizens. Dui checkpoints. A direct and blatant violation of our fourth amendment rights and unnecessary. Saturation patrolling is much more effective.

Each day, we lose more and more of our rights, our justice system becomes more and more perverted, it seems that only some of us are required to follow the rules, and I just have very little faith in our legal system anymore. It’s awful. And escalating. I know that’s Germany, but it’s coming our way. You recognize it, you only let a little bit out because of your KZbin channel and big brother watching over your shoulder. In Deutschland, “du bist was du magst”. You are what you like (on social media). :-) The German Constitution (Grundgesetz or Basic Law) is nothing like the US Constitution in areas like free speech, or individual rights in general. It was largely written by the Western Allies for West Germany after WWII. Top priorities included De-Nazification. So protections for political speech are weak. Political parties like the NAZI’s are outright banned. And the threat of bans is always there. I found the web-site Steve mentioned but not the article. I was curious about the translation. One thing I find with Maschine Translations is that they default to bland words. There are many words or expressions that might be rendered as “creature” for example. As in English, some, in some contexts might be inflammatory or offensive. Google Translate likely won’t pick that up, or would avoid the more offensive rendering if it did. I’d be curious for a link to the actual article if someone has it.

When I lived in Europe (came back 3 years ago) I spoke quite a number of Germans - outside of Germany and in English - so they felt freer to express themselves than at "home" to a non-German, outside of Germany. I was told numerous times by many, that Germany has no real freedom of speech and have to be careful of what they say at home. As one put it succinctly: "We are an occupied country and we're not free to talk openly and truthfully - like you are in America". This case clearly reflects what they told me.

This is the most dishonest logic lol Texas is making journalism illegal, so i guess Europeans can say "look what's happening over there, we don't want to end up like them"

@@no_peace This is precisely why my statement has the best logic. You cannot support an argument with "they're doing it so we should too" or the common one these days "We need to do X because some european country is"

I cannot even tell you how many times I have accidently sent a thumbs up or some other thing at both work chat and phone chat applications. I would be in big trouble.
