I'm with the plaintiff here 100%. When I just SAVED you 40% with an advance loan (and you contribute $0 towards household expenses), yet when I ask you for your tax return that doesn't even cover 1/3rd of the amount that I just loaned you & YOU WON'T, then we can't have a meeting of the minds or hearts. She was in a win-win position and he was in a lose-lose. The $900 may have been an afterthought BUT even with giving it to him, she was still saving the 40% that otherwise would have accumulated to much more than $900. "Oh, what about the ring?" I believe that the plaintiff can do better.

I don't think the judge understood what the defendent was saying about the tax check. The woman was trying to say that he asked for the $900 AFTER she already paid off the 3rd card. Not that she agreed to pay the $900 and just decided to pay off the 3rd card instead. But the judge just wasn't listening to what she was saying. Who knows what really happened but that was frustrating lol

Sometimes there’s no good guy or bad guy and this case is the example. They both got divorced and lost trust and faith in people, he wanted to make sure she didn’t use him for money and she wanted to make sure he didn’t control her with money so they divorced before the wedding. She’s wise to not quit her job and follow a man who proved that he can kick her out in seconds, and he’s also not ready to get married if 98% of trust and love isn’t enough.

He finds out she’s getting $900 and all the sudden he’s like I want ALL of it! He states I know she wasn’t happy with giving me the $900. So why not just back off and go by the terms of the original agreement? It wasn’t like he wasn’t going to get paid anyway. And he was perfectly happy with paying for her living expenses until she paid off her credit card debt. He never mentioned needing any financial help. In fact he kept saying “the loan was my gift to her”. In my opinion they both were wrong. She should have been honest and said “l’m not giving you my $900. I will be paying you $200 a month like we originally agreed”. But no she went behind his back and spent HER money the way she wanted to. Smh people make things so complicated when they aren’t honest.

I kind of see both of their perspectives on this. He thought he was doing his fiancée a favor by helping her pay off her credit card debts and improve her credit before they were married...the deal he makes with her is "I will pay off your debt and you can pay me the $200 you were paying on your credit card bill, and as my gift to you, I won't charge you the 40% interest, so you can pay it back faster. But then AFTER they strike this deal, he suddenly CHANGES the terms of the deal by saying "You can start chipping away at what you owe me, by giving me ALL of your tax refund (which she was getting $900) That's where it gets foggy, because he expected her to pay him that money, and yet, she used that $900 to pay off her other credit card debt on the third card. I'm not so sure she broke their bargain, because from what I am hearing, she only agreed to the $200 a month. And it would make sense to me, if she had already struck that deal with him, to make payments, that if the $900 covered the debt on that third card, that she would want to clear her debt completely and pay off that card too....since he stated that he was only willing to pay off 2 of the cards and not all 3.

The thing is, she was still using that 3rd credit card. We're all different but if someone made that deal with me and wanted my tax return of $900, then it's theirs. They saved me more than that in interest at 40%. A $3400 balance at 40% interest annually, and paying $100 monthly, accrues more in interest than your payment covers.

The defendant's way of thinking is all wrong, she still doesn't see what she did was out of order. When she agreed to use her income tax to pay off her loan to him faster, was not him breaching the contract but since they had both agreed, it was simply a new clause added to their loan contract and then when she decided to unilaterally change that clause and not discuss it with him in any way, that was a breach of contract but also a breach of TRUST. And to further show how she doesn't think normally, she doesn't understand why he took the ring back, nor why he was allowed to take the ring back. He really dodged a bullet with her, she doesn't have a 'partner' minded way of thinking...

These cases usually go bad for guys cuz they forget to handle certain things as a business arrangement. Get to court and get fckd over. Hope my son's handle certain things this way. So they don't screwed over cuz I guarantee you if he didn't, this chic would've been sayn, he gave me that money, it was never a loan. LMAO. He didn’t gift her anything. Assuming he had this money liquid, he wasn’t losing anything by letting her borrow it. While it’s true that she benefited by being able to avoid more interest payments, it’s tacky for him to keep claiming that the benefits of the loan are somehow a gift.

I disagree. I was foolish with my credit cards when I was young and my brother was an angel and loaned me all the money with no interest so I could get back on my feet. It was a gift from heaven. Interest (especially 40%) is like a noose around your neck. I paid my brother back early and thanked him profusely often. Built a great credit score and bought a house a couple years later. The fact that she doesn't see his loan as a godsend and do everything to be worthy of that kindness would make me upset too, if I were him. I know how a humble and responsible person repays a gift like that.. Quickly and without a whisper of entitlement. The personal relationship should be completely separate from the loan relationship.

I've seen some comments about how this guy is toxic but I don't see that at all. I see his point of asking for the 900 of taxes, however, that should have been communicated before the loan was made. I also see that in some cases you don't know how much you'll get for your taxes until you file so it's kind of iffy to me, but I don't see him as toxic.

This guy is an absolute control freak. All his remarks were about how he allowed/helped/made concessions etc. Which may be true but didn't allow her some wiggle room to allow her some dignity in the arrangement, not him telling her what it was going to be. This guy REALLY blew it. Since when is loving 98% of someone not enough? Look...I got my significant other out of hock before we were married. She had horrible credit. Judgements/collections/a 450 credit score. Mistakes from youth. I helped her out of it. I didn't help her while expecting anything other than that she would continue living in a fiscally responsible manner...and she did! Now, she has no bad debt, only "good" (subjective) debt (a mortgage) and an 800 credit score. Hell, I even paid for half of her masters degree program because...it...was...the...right...thing...to...do. He should have worked with her. She didn't take the money and blow it on stupid things. She paid high interest debt down, which was responsible. I have no doubt she would have repaid him aggressively once her high interest debt was gone. He missed out on a good woman, I think, and he may never admit or acknowledge it. Way to go, dude. Your loss, her gain.

She said she never told him she would. He asked for it AFTER she already received it and paid stuff. There was no check to give him anymore. She wrote a $900 AFTER to make him happy but he said NO because he knew she didn’t have it.

I think he somehow wanted her to do that on her own without him asking her. That would’ve made him feel confident that she was really going to pay him back. He felt bad when she offered the check so he declined but he shouldn’t have asked for it and she shouldn’t have attempted to appease him knowing she could only do what they agreed to. Feels like poor communication on both ends. It’s sad. They seem like they would’ve been good together.

It sounds like he was wishy-washy on the terms. I don't understand two ppl who're getting married and planning to live the rest of their lives together loaning money. I am married and I don't loan my husband, and he doesn't me. I've always found that weird. We do have personal checking accounts, but both have access to it. It's just a strange concept, but this is our only marriage 12 yrs together. Maybe if we both divorced and remarried we would think, and act differently.

Getting married at their age is stupid for the very reason they are there money. If I decided I wanted to settle with someone in my non child bearing age, I will not get married. You pay your bills, I’ll pay mine. Maybe we’ll live together, if we do half and half whatever we are comfortable splitting. No drama. And he was already helping her by her not paying rent.

There are many reasons to get married that have absolutely nothing to do with having children. In many instances, it’s better for tax purposes. If one of them has better health benefits, it benefits the other to be married and eligible for those benefits. They’d also be eligible for all kinds of loans and discounts for a variety of programs.
