Seen the deposition of a 30 year career officer. Was asked if he knew and understood the 1st amendment and the 4th amendment. You would think they would know these by heart. His testimony was an embarrassment to say the very least.

No, here's the answer: When it comes to Police, this is what needs to happen, Legislation must be passed requiring police to carry malpractice insurance. A Doctor, a Nurse Practitioner, a Lawyer and so on must carry malpractice insurance. The purpose of the insurance is not to pay out to someone if you mess up, but to make you mind your P's and Q's. Just think, you get into an accident, your premiums go through the roof, not because someone made a claim against you, but because you have proven yourself a liability. If any of the professions that I mentioned mess up, their rates increase as well, mess up again and they won't be able to get insurance anywhere without mortgaging the property. If you still continue to mess up, well,, you will never be able to work in the field again because you can't get the insurance required to practice, Same should go for PIGS. Same goes for driving, mess up to many times, you loose your license, and nobody will insure you, resulting in you not being able to drive. With all these points made, wouldn't it make sense for Police to carry insurance? Rest assured, they have to start paying out of pocket for violating the rights of people, I'm sure by strike three, they would have to quit because the can't afford to pay the insurance required to possess an Officers Certificate. One may argue well they are working for someone. Well, all these professions are under some sort of contract, which mean these people are all working for someone else, why is it the people they work for just be held to account? Doctors work for hospitals, Lawyers work for Law Firms etc. But they are all still mandated to carry insurance because they still have a responsibility in the game, a responsibility to do the right thing. The police are working for someone else to, so the whole, well they are represented by the Government so they all fall under the Governments responsibility. Personally, that is a moot point by my reasoning of it all. I'm sick and tired of seeing all these lawsuits because police can't stay within their lanes so to speak, lawsuits that we the Tax Payers are paying, (3.2 BILLION, thats with a B), just last year alone. Of course that doesn't include any litigation that is still ongoing. Make police accountable, make them carry insurance and I assure you, the attitude and practice of a lot of these PIGS will change.

The Supreme Court in several states has ruled a "smell of marijuana" is not enough suspicion. If they say they "smell marijuana", tell them you have no idea what that smells like, smells can come from anywhere, they aren't drug dogs, you don't consent to a search and you want your lawyer.

No. The smell of burned marijuana is enough probable cause to search a vehicle. Miranda only applies to questioning, not searching.

I’m a little confused by what you said at the end. Was it a complete dismissal, or was there a misdemeanor charge? If so, what was the misdemeanor? Also, the cops seemed to really have it in for this man from the very start. Did they know him from a previous interaction? They just seemed determined to “get him” for something, ANYTHING. Bullies with badges. 😡

He was saying that the prosecutor didn't even try to argue for misdemeanors or to offer a better plea deal. He went straight to dismissing the case in full, no negotiation.

Officer- I don't need one. License & Registration, Proof of Insurance. You- No probable cause! Officer- Don't need one. You- I have rights! Officer- Correct. You have the right to purchase a vehicle, and to tag/insure it, per state law, and the state requires you have a drivers license while you operate it. You- That's not what I want to be stopped for! Officer- By law, I don't need your want to have a reason to stop you to check your license, registration, and proof of insurance, and to make contact with you. You- B-b-but... Officer- Not to worry, some internet ambulance chaser with an extremely poor understanding of law will get you off on a legal technicality, but in the meantime, now we know what drug network you are involved in, and where it and your friends are generally located, so can focus on it more effectively. You- B-but...I feel like... Officer- I feel like our next encounter when you are carrying illegal drugs and weapons will prove more fruitful. Oh...and don't forget, now we know to keep an eye out for your specific vehicle that is involved in the local illegal drug trade because we have witnesses ID'ing you, and your vehicle, and known drug houses. You- B-but...the constitution and laws and stuff! Officer- Neat. Oh, by the way...there is no constitutional or legal right of yours to engage in criminal activity or that I have to tell you, while you are in commission of criminal acts, any kind of "probable cause truth". My job is to make contact with criminals, sometimes in commission of crimes. Surely your internet ambulance chaser will help you understand that. In the meantime, get in the back of my car so we can get you on down to the pokey to get processed & booked. Because take a guess at what we found in your center console, and hidden under the seats. All that really matters here, is that now the coppers can focus on illegal drug networks full of stolen property, illegal weapons and the sale/distribution to minors. Those poor, innocent criminals. If only those mean old cops would stop focusing on them all the time, and "focus on real crime", amirite? Even in stop and ID states, all have clauses requiring reasonable, articulable suspicion that a crime has happened, is happening, or will happen. Most the videos of cops on KZbin they obviously don't just want to violate your rights, but retaliate against them. You have a smug almost doper attitude. That is something else you can do when tghe officers voluntarily revoking Qualified Immunity, "Officer it's obvious you don't want to violate my rights but v retaliate against my rights. Furtive movement reminds me of the incident in which cops pull a guy over for not using his turn signal or stopping pass the stop bar. It took the cops all the way up to handing the guy his ticket before they mentioned furtive movement and how they wanted to search his vehicle. In the end both cops get dragged by the guy and he ends up in jail for over a year before a judge throws out his case stating the stop was over the minute the guy was handed his ticket and any injuries the cops sustained were at their own actions.

@@stevek8829 he CANNOT sue the police if he pleads to ANYTHING. The lawyer clearly states in the video that they could have sued the department. I understand his wording in that section confuses people but this man plead to nothing and all charges were dismissed with no attempt at negotiation by the prosecutor. He added those sentences to emphasize how odd it was for the prosecutor to dismiss the charges point blank and how strong of a vindication it was to do so.

I'm in Barnstable, Ma. and they have repeatedly violated my rights. I mean blatantly. I could write a book about my last experience alone. On another occasion I was bleeding in 5 places, had a severely sprained ankle, and am permanently disfigured. When the police arrived I was talked to like little kid that had just broke grandma's antique cookie jar, threatened with arrest twice, told not to come back outside, called a liar, and accused of faking injuries. Not even a police report was filed. My attacker was allowed to go on his way while they ran checks on me and were verbally abusive. All I was attacked because I was recording in public and they guy didn't like it.

He took no plea. The quantifier is that the prosecutor offered to drop all charges in the sentence prior and after the confusing remarks he states the guy has a case against the police that they would take up had the arrested taken them up on it. You CANNOT sue if you plead guilty. The sentences there were to emphasize the flat nature of the end of the trial - no negotiation ( didnt try to get a better plea, reduce chargea ) as is what normally occurs. It's hard to hear but the guy does turn the statements into a negative ( no reducing to misdemeanor, didn't try to give a better deal ).

As a lawyer who has the authority and responsibility to refer criminal civil rights claims to the DOJ. Specifically for 18US241 and 18US242 issues. I think it is strange we have laws like this on the books but cops are rarely charged and prosecuted for them like in this case.

You seem to have trouble with words. 8:35 The prosecutor came over to us and said, "I'm dismissing all the charges. Reduced from a felony to a misdemeanor. No better deal. I agree with you. What the police did was wrong. Pure dismissal. These two phrases don't belong together : "dismissing all the charges" "Reduced from a felony to a misdemeanor" If charges are dismissed, there is no need to state about 'reduction', it is a moot point.

There's a new law just coming into play. Cops can't say they smell weed anymore. It's like me furling and them saying it smells like weed. I have a bad stomach and been known to clear out a car in two. All you need is a cop saying that and have some really come back lines for them. Why are they sniffing people's butt cracks ?

One of the last things you said was that your client should have never been in this position at all. So, what can be done about this. If your client should have never been harassed and arrested, those cops are nothing more than criminals. American are getting tired of criminal cops roaming the streets.
