Three men have been charged with special circumstances murder for the death of Patricia McKay at Fashion Island Mall in Newport Beach. If convicted, they could face the death penalty. Legal expert Lou Shapiro breaks down the charges.

34 years ago, I arrived in the US as a brand new immigrant. I was a child and the first big news story I remember was about the murder of a German tourist in Florida. It made international headlines. Big changes were promised. Talking heads were all over TV spouting off about tougher enforcement, tougher sentences, community outreach, and about how nothing like this was ever going to happen again. Nearly four decades later absolutely nothing has changed. In fact, everything has gotten worse. We live in a society of unbridled violence. This will not change. It will simply eventually collapse into something straight out of the Purge or GTA. This is the new normal.

For sure, OC ain’t soft like LA. They will add all kinds of enhancements to make sure criminals get 2-3x the time. In this case, these guys are all going to get the death penalty at the very minimum. But there are far fewer robberies that occurred with death in OC, this is not LA. They don’t call it the orange curtain for nothing and that’s why OC has 7 of the 10 safest cities in California. The OC sheriffs office just opened a new multi-million dollar command center. There’s no way to get away from a crime scene from the freeway, OC unlike LA is using license plate and facial recognition.

As long as there’s one person say no to death penalty, they’ll live. 99.99% of the time there’s always more than 1. In case the trial go smoothly and death penalty is handed out, criminals can just appeal and re appeals indefinitely until jury get tired and set him free. All it takes is 1 mistrial. America tourism comes for the hype, live if you’re lucky.
