in cases like this the person who took the child initially should be held in prison until they fess up and tell where the child is, and if that child is dead they should then be charged with murder. i've seen cases like this where someone is missing (mostly i've seen cases where an adult is missing and presumed murdered) and someone is strongly suspected in their murder, and they are arrested for destroying evidence in the case or other related charges, but they won't talk so they can't charge them with the murder or disappearance of the missing person until they find a body or someone comes forward. it sucks watching stuff like that play out and someone get away with murder.
