I'm trying to fill this form out but I don't understand some of the questions. And not sure what the correct answer is for particular questions. Is there any free help available for this as I'm unable to claim legal aid but cannot afford a solicitor

Hi there, just filling in my C100 after mediation didn’t work. I currently work a 5on 4off shift pattern, but my ex has said I can only have my toddler daughter every other weekend due to ‘stability and routine’, which simply doesn’t work as I work most weekends. Currently she’s a 40 minute bus ride from nursery, but a 2 minute walk if she stays with me. Do you think I have a good chance of having my daughter on my days off with my shift pattern? Many thanks :)

I think the arrangement that best suits the child will be the one that the court favours

Hi, my friend has lost contact with his son of 5 nights over a fortnight, he had a breakdown in his relationship with his new partner resulting in mental health issues (documented by GP), new living arrangements 1 hour (37miles) away from son (accommodation was unsuitable for his son to visit or live at), a car which was not safe to transport his son, to then totally loose his car at a roundabout breakdown (car was written off, hence unsafe for son), this caused a 4 month delay in him seeing his son, whilst he was trying to sort himself out and get life on track to a level which would have been reasonable before meeting his son again. After 4 months when he ask child’s mother, she denied contact stating it is confusing for their 2 year old son and asked that father will not get contact till he goes to court. This further cause more upset for father who financially was already struggling and did not have funds for solicitor bills but has zero contact and it’s now been 11 months. Mother has also denied MIAM. There are no safeguarding issues which were ever reported or raised against either parent. Child is not known t social services. Would it be reasonable for father to submit the C100, without MIAM and without notice, to at least get a few hours of contact a fortnight? Or even a one night stay a fortnight where he collects from nursery and drops to nursery preventing contact between father and mother, without using a solicitor? Or can an arrangement be requested for a few hour to begin with as father feels an over night stay could shock his son and then once he starts school be increased to an over night stay in the same court order arrangement? For this would father need to fill out any other forms or just a c100? Any advice would be very useful please. Thank you so much.

Hello I have been watching your Tik Toks I have found your videos very helpful I would like to thank you, may I ask if my partner is expecting a baby and she has said when the baby is born I would only be allowed to see the baby at her address due to her having concerns regarding me having mental health issues yet my support worker has said she has no concerns regarding me around and having the baby at my address . What could I do? Thank you.
@cameronsaunders25042 жыл бұрын
Was my partner sorry. The relationship has broken down due to me not agreeing to her arrangement - only having the baby at her home won’t let me have the baby unattended thank you.

Thank you for this been so helpful, after my partner has applied for the c100 to try and get to see his son, once it goes to court can he represent himself to help keep costs low? Do you need to pay fees upfront or can it be done monthly once at court? And would he be able to use witness statements from other people to help support his case?
@thelegalqueen2 жыл бұрын
Yes they can. Depends on the person representing you. He will need to get permission from the court to file witness statements.

You should be okay to take if there is no court order preventing it. Get a letter from the mother giving permission to take her aboard. Google examples of template letters. Also take her birth certificate showing you're her father.

Do you need to find a solicitor before applying or can this be done after if needed ? If you say you have no representation is this allowed to change or is it best to seek out a solicitor prior ?
