I clicked and watched the link you provided in your video description area that takes you to the Blue Ribbon Coalition (4) person panel discussion of the National Park Filming Law issues. WOW! It was a very complete and fantastic explanation of how we got to where we are right now.. I have taken your suggestion to join the coalition to become part of the folks involved in the "Filming Permit Injunction" they currently have secured for Coalition Members. Sounds like the best way to protect one's self while all these legal challenges are being worked on. EXCELLENT reporting as usual.

The Feds need to get it together. Every park has its own rules and laws. It’s getting way too complicated. And I must have missed something. I thought Congress made laws not individual government entities. You do a REAL good job and give a lot of information

I suggest you check out the controversial new Washington State Parks cancellation policy. The earlier you made a reservation, the more you are penalized for cancelling. We reserved several parks last January for an August trip, then had an RV transmission issue and had to cancel in July. They held back ~ 80% of the reservation fee!

I got verbal permission to video in Big Horn National Recreation Area and published my video on KZbin. I took the video down because if anyone from the National Parks Administration was to come after me for the video they would ask to see proof of my permit. With verbal permission you have nothing to back yourself up and could face a huge fine.

Thank you for sharing this! I've been waiting on the Senate to take up the Explore Act, but I suspect that everything got held up with the election cycle. Hopefully it will be passed early next year. It took very little time for the House to vote in favor of it on a bipartisan basis.

Being a lifetime BRC member this is awesome news. Not that I seek monetization of my videos, I just want to share the awesomeness of our public lands... w/o having to seek permission to do so. Old archaic laws need to be updated (like the explore act) or eliminated entirely. Repeal the (agency) laws by legislation, as that's how laws are "supposed" to be enacted in the first place (legislatively, not agency enacted)

It depends on the park. For instance, we filmed and photographed in Bryce this summer. They require a permit for both video and photos. It was $150, and the entire process took a week. Check with the park you are planning to visit.

How many frames per second makes "a moving image"? 1/10 seconds 1/second 60/second?

It’s a good question. The rule contains the definition of what a video is. Basically they define it as the capture of a moving image. That can be interpreted many ways and the is part of the problem with the law being as out of date as it is. You can read the rules and the definitions by searching up CRF 43 A Part 5.

I’ve asked this question a million times and no one ever gives me an answer. What if I take still photographs and then create a Ken Burns like video and post it on KZbin? Would that satisfy landing within the jurisdiction of still photographers while avoiding breaking the rules that currently applyto hitting the record button? Anybody?

Hi there - I’m the guy who hosted the interview with Ben from BRC that Jason referenced well as having pretty extensively researched and written on this topic along with “teaching” on it at various events this past year. I alway hesitate to call myself an expert on any topic and I’d include this one. I will just say I’m well versed. I have actually spoken to head agency permitting officials on this exact topic. I was told a moving picture is a moving picture even if I processed it in post to be moving the same as any other processing I might do to a moving picture. I pressed if it mattered if it had sound and I was told no. I understand that doesn’t make a lot of sense and I agree, but that is a huge part of the problem. The rules and definitions are not written with modern technology in mind which opens the door to a lot of interpretation. Take a look at CFR 43 A Part 5 and read the rules and definitions. It can be helpful in understanding how some of what most of us might consider “extreme” interpretations occur by permitting staff / officials. Hope that helps.

We filmed and photographed in Bryce this summer. They required a permit for both photography and videography. Each was a separate category in the form and required a fee. Since we shot some time lapses, that was considered still photography according to the ranger we spoke to before filling out the paperwork. I'd check with the park you are interested in photographing in to learn their rules.

@ it doesn’t surprise me one bit to hear that. It is a big part of the absurdity of the entire topic. All the agencies and units within them are bound to the same exact federal code and definitions. But you will find confusion and disagreement among the individual permit administrators as they try to interpret the outdated code in modern times. That is why I say always get it in writing because at least you have something showing you attempted to do the right thing even if the administrator themselves didn’t understand the law and advised you what you were doing was legal even if a judge sees it differently. Hopefully they fix it legislatively sooner rather than later. In the meantime joining the BRC is some insurance until they do.

It absolutely did. Lots of us have avoided filming in parks, or have been stopped in person, and a handful of us have been fined. Lots of us have brand agreements that don’t allow us to break the law in our videos. And there’s always the concern that KZbin could remove your channel for doing something illegal, which has happened to many for other issues. The problem is that it stopped the responsible people and not the irresponsible people.

One issue I have not heard you address is the court case filed by Utah to get public lands in Utah turned over to the state? If the supreme court allows this it will mean the destruction of our public lands - lands that belong to ALL Americans not just the citizens of Utah. This could be the most impactful case in public lands history and we must oppose it.

BlueRibbon Coalition sounds like a good group, but are you sure that "new members" will be covered by this lawsuit/injunction? In other similar rulings (but different legal issues) often only the members at the time of the injunction are covered, and not members that sign up afterward. It's not always the case, but more often than not. The court order should indicate if current AND future members are covered by the ruling or just current members of the organization.

I don't fully understand the conversation. Of getting some personal video. At the national Parks. But okay with the snapshots. Okey-dokey then. I am taking 30 snapshots per second. For a few minutes here and there. As it's no longer interlaced. Every frame is a single photo. Taken in very quick succession. Because I'm handicapped and disabled from Multiple Sclerosis. So I can't press the button fast enough. And I fall within their requirements that way. To be taking 30 pictures per second. For as long as I want to in national parks. I mean if you want to put on a major production with more than 6 people involved? Like anything else, like that. You generally have to get a Permit and/or Permission. On the property. You want to perform upon. It's a performance. Captured with a dinky little toy looking video camera. These days. What would be the problem? If it's just you? And not a gaggle of equipment. I come from a Network Television News, career of decades. And there is this Run and Gun, method. Of getting the story you want, to get. Where ever you have to go for it. You, go for it. Wherever and however. That's called ingenuity. That's called being stealth. That's being, adequately prepared. That's, keeping it light. That's called covert surveillance. Like a TV camera in the bridge, of your glasses. Or, cameras above both ears. Wide Angle at 4 K, resolution. Lets you window zoom, edgier subject matter. Still in high resolution. And so? Is there a problem? Plenty of smart phones can already shoot, 4K. I can understand them not wanting those whizzing, battery-operated quad copter drones. As it might scare the, birds and wildlife. And they'll all run screaming. They could stampede. And kill stupid tourists. There flew the drone. And because that was not a Federal Law. That was a, Bird, Law. The birds wouldn't stop screeching, at the crack of dawn. And then they had, to do something. So you kill the birds. They make great soup and barbecues. Just, so you know. I'm just saying...... it keeps everything balanced in the ecosystem that way. No need to run to the store. And adding to the carbon dioxide emissions. So kill all, the birds, for dinner. They all, taste like chicken. And they will no longer wake you up in the morning. Problem, solved. The, Dodo bird must have made a lot of noise in the morning? You can't find them anymore? They must've been delicious? Perfect for the Thanks Killing Holidays. Dodo Bird Soup, with egg noodles. I long for a bowl. RemyRAD
