First Investigation Report
Section 154 in The Code Of Criminal Procedure, 1973
FIR is a First Investigation Report prepared by the police upon receiving the information of a cognizable offense. The procedure of an FIR is explained under section 154 of Code of Criminal procedure, 1973. Under cognizable offenses the police have the authority to undertake investigation or make arrest without warrant or order of a magistrate. Mostly an FIR is filed for heinous crimes like murder, rape, robbery, etc.
Non Cognizable Report
Section 155 in The Code Of Criminal Procedure, 1973
Now, an NCR is a Non Cognizable Report. It is a complaint which is filed by the by the police for a cognizable offense. The investigation in such reports will initiate only on the order of the magistrate. He cannot even file an FIR for such offenses without a warrant. Cases for which an NCR is file are of less serious in nature like theft, minor fraud, public nuisance etc.
The police take advantage of the innocence of people who are unaware of the difference and lodge an NCR instead of an FIR. The main difference is that an FIR contains the heading ‘First Information Report’ and contains the section of FIR. And an NCR contains ‘Non-Cognizable Report’ as its head.
