Considering she’s already served 4 and a half years and she would only have to serve 85% of a 15 year sentence minus the 4 1/2 years. So basically she could be out within 5 to 7 years.

I'm a little more lenient on them in this case given that she's on lawyer #9 and they came in like a month ago. There's only so much you can do as a defense attorney when the person you're defending seems damned and determined to fight you on everything. Sooner or later someone's just going to say "screw it, let the defendant ruin their own defense, we can't keep delaying the trial until they come to their senses and stop fighting their own lawyers."

I was empaneled on a Jury in NY in August, ended up getting strep throat over the following weekend and they still made me show up in person to get excused. They wouldn't take my doctors note or anything over the phone or emailed. It really sucked to have to sit around the courthouse for 1/2 a day in a mask feeling like garbage to then finally be dismissed. Plus potentially getting others sick

I was telling someone the other day "she can ask to accept that plea deal any time she wants up until the jury comes back with a verdict, whether the prosecution accepts that is another thing," and I'm torn on how I think that would go. Part of me thinks the prosecution would happily let her have it and not spend one more minute in court with her, the other part of me thinks they would go "Nah bitch we hope the jury throws the book AND the suitcase at you."

For the majority of my career, I’ve done at least 1 jury trial while sick each year. Judges don’t find illness to be a valid excuse and you can’t just have someone step in for you.

Having exhibits dumped at the eleventh hour and rules of evidence notwithstanding, there is a simple way to scroll through *.jpg files quickly. Leaving them separate means you don't have to go through the added work and time of compiling them into a *.pdf and futzing with them all for captions, cross referencing, objections, and redactions.

I don’t think I’ve ever seen a woman so hard that she cannot manage to say, “I’m sorry for what I did to Jorge.” Instead, her defense is built around a justifiable homicide. 👀 She has no shame and no remorse.

I haven’t seen her cry for him even once. When sentencing time comes down, she’ll pay heavily for her lack of remorse, the jerking of the court chain (demands for hair and makeup stylists, sacks, acting like she’s a celebrity). Her time will come and I’ll be here for it. At least we won’t hear from her for a long while, while her case navigates through the appellate court. I do fear that her case is going to get turned over on appeal for many many reasons (I used to work for the court of appeals) but at least we can all breathe for a while and she won’t be getting the attention she desperately craves.

Can she really even get away on self defense when she said in the video that they had been doing well? She said they were doing puzzles- not threatening. She said he was going to therapy and/or anger management iirc and said they hadn't argued in a month- not threatening. She said that he apologized for her after seeing how damaging being physically abusive is to a woman after going to his counseling. Nothing about what she said posed him as a threat, especially if she can talk him into a suitcase

Emily! I’m so very glad you’re here now for this trial. Couple thoughts: Owens reminds me of a gentler Harpootlian - he’s asked for a lavaliere and pickup pack (mobile talkie device) because he’s used to walking around while talking. He loves speaking arguments and the court has made It abundantly clear that the court doesn’t entertain speaking arguments. Owens has yet to figure out that the court wants concise, precise information and arguments; Owens hasn’t read the room yet. My theory: Owens thought he would come down here, run his “this is what the prosecutor is gonna say in opening” aka the first shouting match at Orange County Detention Center when Owens came down. Second shouting match and incident was after the early October plea offer. I think he thought he would come down and do his thing that he does and SB would do what his other defendants have done: take the deal. SB (as she has stated in a previous letter to iirc Judge Wooten) isn’t the typical inmate or defendant. She ain’t taking no deal because in her mind it was an accident (except that it wasn’t because she was afraid so she was defending herself but it was not intentional! No malicious!!) and like Charlie Adelson “Sarah’s never wrong because Sarah’s always right.”

The dog analogy kills me (in a morbidly amusing way), and this man clearly has never owned a dog or known someone who has. It's also incorrect. When a dog bites, the dog is _usually_ put down after that single incident. A better analogy would be someone with PTSD after getting third-degree burns from falling in a fire. Can handle being around fire while it's contained, but once the fire gets even a little bit out of control, the trauma response kicks in, and you retreat from the thing that had caused you serious pain in the past to protect yourself from being harmed again.

1:02:30 so the defense is claiming that the trapped man escaping from the suitcase was a threatening act? Are they of the belief that the defendant wouldn’t have been in danger if he escaped at a later time? Or do they believe he should have stayed trapped permanently? Escaping from the suitcase was necessary for him to continue living, and she denied him of that.
