Ideally you should get refund as cancellation is due to bank not funding the project.

Sir, does the same rule applies in resale property... ? I booked a commercial in Noida but my broker did a cheating along with his shell company.. they took the cheque in the name of a shell company.. now they are saying to talk to shell company..

I cancelled my flat on the very 2nd day of booking in kumar sunrise hadapsar link road when I came to know that the builder's sales team made many false promises. Now they keep delaying to refund my money. First they asked me to wait for 30 days Now they are saying it will be delayed.

@@NavyaYadav-em5et yes I got my refund, after 3 months but I keep following them and asked them to reply on mail only...force them to communicate all things on mail so that you have proofs...if you file case to RERA authority it will be useful.

Sir maine ek flat book kiya tha par uska rera approval nhi aaya tha us time. Diwali last year ki baat h, builder ne bola ki thoda down payment karne toh maine kuch pasie de diye jab kuch time tak rera approval nhi aaya toh maine cancellation ke liye apply Kiya. 4 months ho gye h par abhi tak refund nhi aaya. Plzz help. Agar kisi ko kuch pta h toh batao

All tier-1 builders, after paying 10% only provide property documents for verification. Is this normal? After document checking if anything wrong will they refund full money and how to negotiate to get the documents before paying the 10% amount, let me know thanks.

Gurgaon builder mostly are Scammers ..! I booked 2 units of shops in Gurgaon in 2011 till 2024 aug the Building & possession Not done yet in 2019 when covid is coming Builder asked me lumsum amount of 55 % of total amount in CLP whether the property papers mentioned 5-10-15 & so onn .!. But he asked me to give 55% payment one shot .. frequently 3 demands letters served to me & after that it will be cancelled by builder ..! Till now didn’t get any amount from builder .! Whether I asked them to merge 2 unit’s into 1 as My 50-50 % payment done in 2011 for 2 shops & I requested them to convert into 1 & let me in paid up 100 % for 1 unit ..! But no reply from them & if I willing to pay them and asked them to make New payment plan as your project is over delayed ..! Then they say No.!. Because the builder are So greedy bcoz the Value of property from 2011 till 2020 is approx 5x ..! But they will never picked up my calls & not interested in personal meeting & even not willing to Pay my money with interest what should I Do can help me out in this case Thank You

I have given token amount and cancelled my booking just after 3 days, There was no paper work done. While doing the payment of token amount they clearly told it will be refunded. Now they are saying it will take 30 working day to refund. I am afraid. 😢

hi Sir i had booked one property in Gaur City, but could't pay them the demard money, as a result they have cancelled my Units. however i tried to get additional loan from the band but no band gave me the money because the bank did not approve my loan because the registratiion of the property did not happen, how can i get the money refunded.

You need to approach UPREARA but if you have not paid the demand without any delay in the project or any breach of commitment from developer then it will be difficult for you to get refund. In that case you need to consult a civil lawyer

You will get refund subject to deductions 1. forfeiture amount mentioned in agreement to sale 2. deduction in refund of stamp duty and registration amount, this amount differs as per state policy

Bba complete means bba sign or bba register in tehsil as my bba is signed but not registerd in tehsil

I think there’s some confusion sir. SC says a builder cannot deduct more than 10% in any case .

can we sell a flat to other customer after agreement, after partial loan disbursement, ---- but before sale deed or before taking possession of flat ?

You can always sell the house after agreement and before possession & Sale deed, provided builder permits. Check lock-in and transfer clause in BBA. loan taken will be transferred to the new buyer or you can take money from the buyer and settle the loan if new buyer does not want to take a loan.

VTP Dolce vita builder in Pune is not refunding my money. I booked flat on 30th June and cancelled on 8th July. I cancelled within 15 days, So according to RERA I should get all money refund but Builder is saying they took deviation approval from RERA to change cancellation policy. VTP PUNE IS WORST BUILDER. DON'T EVER BOOK FLAT IN VTP
