Being a pro-law enforcement guy and ardent supporter of police- I like Mr Murphy very much. He delivers the message of rights competently and accurately, and does not display an anti-Police swagger that some commentators do. Hats off to him.

@wendyt234 No Australia have different laws but everything is pretty much similiar. 1) Police need warrant to enter and search your house 2) You may remain silent unless you are given a lawyer 3)You may ask for the officers name when your "addressed" by the Police. Police can however search you on the spot and if your 18 or under, police are unable to question you without parental supervision or approval.

@dyingdignity I don't know about other forces but I've found the Met's guidance on it. Type into Google, 'can you refuse a police search in the uk'. At the time of writing, it's the very first link on the list, it mentions an FAQ. Click that and read it all but the part that is specifically relevant to your question is the section, 'How should I react?' Basically, they have a right under the law to stop and search you without your consent, by force if necessary.

@labarinthofdream: I record most every encounter where i think I may need to archive the information. I find it helpful in situations where a lot of data is quickly being passed, say, when a contractor and 4 subs are discussing layouts. I have also had the rare occasion of having to say, for example: "Would you like to hear the audio of you saying you will pay for this part?" Amazing how a person will do the right thing after that. I have read 1984. Good book. Short.

@KatiushaVN4 If an officer searches you with consent, that's their choice of whether or not to give out a ticket. They most likely pulled you over to search for illegal items. If you just cooperate and act normally and are never asked to be searched, then they might not hand out a citation, but it depends on 3 factors. You, the cop, and the region are in. I live near an area where illegal searches are common place.

We don't use that terminology, but the principles are pretty much the same. In some way or another, pretty much all these rules are transferable. The only thing that is consistent is the fact that abiding by these rules can help you if you get stuck in court.

@Rilamin67: My newest MP3 recorder is about 1/2 of the size of a pack of cigarettes. I have it Velcro'd to the ceiling of the car. The other one is about the size of a pack of cigarettes and stays in my pocket The third one stays somewhere else.

DAMN RIGHT you don't know what the previous owner of your used car might have stashed in it. I bought an old used 1977 buick regal off a 75 year old lady. She bought it used off a car lot. About 2 years after I bought the car I finally got around to giving it a real cleaning. I had my hand vaccum in hand and pulled out the back seat. Along with candy wrappers and junk I found roach clips and "a baggy". I nearly Shit myself. I could have been bagged by the cops for this stuff.

@FlexYourRights Thanks for the video, its very helpful. Last year I was pulled over by a K-9 unit. I was aware of my 4th amendment rights and did not consent to a search, but since he had a dog with him he just walked it around the car without my consent. The dog barked, and he claimed probable cause. He searched my car and found a small amount of marijuana. Why is it okay for cops to use dogs to get around the 4th amendment? Should I have asked if I could leave before he brought the dog out?

@Zeeboe I drive a 2010 jeep wrangler, and am a college student and while driving home from college with all my belongings over an interstate in Missouri I was pulled over for going 4 miles over on a 75 mph road. The cop thought that because I was young and had a nice car I must be a drug dealer, so he illegally searched my car claiming I had marijuana flakes on my control. He cuffed me for the search and left my new 32" TV broken. I left 2 hours later with a citation for 4 mph over.

at 2:35 that's when you ask him if he has any reason to believe he needs to search your car. of course after the fact that you just told him you didn't have anything in the car. Oh when he does ask you that question, you also have a legitimate reason to believe he is implying that you are lying to him.

@pooploverism usually it is. if a cop smells or sees something relating to an illegal substance, it usually gives them probable cause to search your belongings.

@3333sweetie: Arrested for disobeying what law? I have never seen a statute that makes it illegal to refuse to consent to a search. I have, however, seen court decisions that affirm the right to refuse, and that affirm that using that right cannot be used for probable cause. I cannot comment about your second question simply because I have never encountered the problem you speak of.

@FendyRhodes And I agree, I believed that no cop would pull someone over on an empty interstate at 1 in the morning going less than 5 miles over the speed limit, and I paid the price for it, and then some. Regardless are you just trolling or are you just flat out denying that some cops do bad things to people who don't deserve it?

@3333sweetie: You can always refuse to _consent_ to a search. Officers may not need consent though and may go ahead and search anyhow. Why would they ask if they don't need consent? Because it will help if the question of consent came up in trial. Watch the video.

@labarinthofdream: Why would you want to worry the officer and reach in your pockets? Better to start it before the encounter. My current main recorder can hold 48 hours of continuous recording.

Never let them search you even if you have nothing to hide. A year after buying our car, I was cleaning the back seat and found a rolled joint from the previous owner (we have no kids). And this was after crossing US and Canadian customs more than 30 times It would have been game over for me.

I thought cops have to read your "Miranda Rights" if your get arrested due to the outcome of Miranda v. Arizona. However, after I Wikipediaed it, it says only if your being interrogated...

@estringer21 A lot of the rules are the same, but there are variations. Up here the big test is whether something is "reasonable" to an average person. There's almost never anything wrong with keeping your mouth shut around a cop.

Whenever you deal with bureaucrats (including cops), you've already lost. It's just up to you how much you lose. Keeping your cool is simply damage control. Moreover, as Sun Tzu wrote, every battle is won before it is fought. If you want to retaliate against the police, and have victory: 1) be sure you have numbers on your side, videotaping what happens. 2) Be sure you know the law, and can afford the coming legal battle. I grew up in the Bronx. And I assure you that if you said "I do not consent to searches" you would be lit up like a Christmas tree. There is some great advice hear but let's be honest. If you don't have someone recording the encounter you need to be very careful.

not to mention that they pulled you over to begin with over some bullshit that they are holding over your head. I was an explorer for a police department and they told us all kind of little infractions that most people don't know about to initiate the stop to begin with. So in the end you're either going to surrender your rights or probably get a ticket.

@michaelencarnacion I can't trust that prediction. I was pulled over back in January when an officer suspected my seatbelt was undone (it wasn't), but he wanted to search me and my car because I was nervous. I let him, because he was very friendly and I wasn't aware of my rights, and he took his time searching my backpack, seat covers, etc. I stood in front of his cruiser's camera for maybe 15 minutes. (I had a book by Emma Goldman in my backpack. I wonder what he made of it!)

One time a long time ago I was in a car with my step bro and another friend who were smoking with the lights on and music blasting I was drunk but got in there car to get out of a worse situation were my other bro and his friend were tryin to fight an entire neighborhood thought I picked lesser evil well the cops pulled up searched us all found a small bag gave me a ticket for court but the way he treated us during the search was bad ...continued

@irvinanimation Yha? Im a cop and this vid is great. If I had people act like this lawyer wants people to I would have a much easier life. But instead I got subjects jumping out of their cars as soon as I pull them over yelling at me that they know their rights and demanding to see my dashcam footage right there. Not all cops are assholes..but then again not every person is a good guy either.

I tried some of this... Apparently "I do not submit to any searches officer" Is grounds to cuff you and slam you into the pavement because you're "Trying to be difficult"

i had a cop said can i see you ID and i told him no sir its will violate my 4th amendment. and then i took out my cell and having all 10 of them on my phone i pointed out see it says here i can read it to you if you like. he stepped back and grunted and told me to get out of there. I smiled and told him you have a lovely night :D

i think the UK has similiar amendments, but not the same as the US. remember that the bill of rights was written as a reaction by americans to british oppression on their rights
