I don't know how it works in the criminal process in USA but in Sweden they always have at least one psychiatric evaluation (RPU) of the suspect that is presented to the court. And sometimes an additional more extensive if the first resulting in there could be any serious mental illness that would exclude culpability. Here he was sentenced to life thus he was seen as culpable and dangerous enough to keep him in prison for considdrable time though the level of intent may not be able to match what is required for 1st degree. Or maybe he is on some spectrum where he is considerably less capable to stop himself to come to sense after having an impulsive thought, which often is an factor measured to intent generally: "From the time you you clashed went out and to get your gun you had x much time to come to your senses and let it stop by abuse before you escalated your act to murder". And something is amiss there. And when looking at the surveillance films, the interviews etc he doesn't seem like uncontrollably enraged or fearful which you'd expect from someone with a normal cognitive comprehension level who may have feared for their life. Now that he claims he might have been threathened to his life may be silly considering the circumstances and maybe an attempt to come up with a claim of selfdefence as an afterthought. Though it is damn stupid, in a true sense, to not realize that going for a gun to "defend" yourself against a petite woman who thorwn mascara and a papertowlbox towards you and push you in the chest when wanting to have distance to you. If they’re appointed by the court to handle a specific case, and they don’t want it, they have to come up with a pretty compelling reason as to why that is, and it has to be signed off on by the judge. Usually that reason is that they’re somehow related or otherwise connected to the defendant, or the victim, or either their families/friends. Most public defenders are private attorneys who’ve contracted with the court to take a particular number of cases per year, so picking and choosing isn’t usually possible because there are only so many attorneys available to begin with, and the courts try to balance their case loads. Outside of case load (criminal trials, especially murder trials where a defendants literal life can be at stake, are very stressful and time consuming, and can take months and even years to see through), the state doesn’t pay anywhere near what a private defense attorney can charge, so they have to keep it fair/balanced in that regard too. Laws like that encourage people to use guns when they aren't necessary at all. My psycho ex from Florida used to answer the door with his gun in his hand because he was a big coward with a sick fixation on shooting anyone in order to be a man and "defend" the home. He was excited for the opportunity to kill someone, rather than ever in actual fear for his life. There's been a lot of cases in Texas where people chased intruders out of their homes / property and shot them in the back while they're fleeing. That's not standing your ground. That's murder. And they get away with it often and the trend of abusing / misunderstanding that law continues. 🙄
