If that defense attorney is a public defender that guy deserves a raise. Exceptional care, effort, and genuine conviction. Wish there were more like him who don't make you feel like an annoying hindrance or burden. He clearly took time to fully understand and empathize with his client. He's not just phoning it in.

The GED is indeed an acvomplishment. At 69 yrs old, I could never manage to earn that because I couldn't understand algebra. (I'm on spectrum.)

Once the VA actually started taking care of my pain my mental anxiety and depression of thinking I’d be dealing with the pain forever going away helped me alot. Sometimes there is one thing that really does need care and fixes a persons outlook. I’m going back to school I’m doing sled hockey tournaments with other disabled veterans I go dancing again and bike riding when I can. Sometimes a treatment of one thing is all it takes.

Counselling is a lot harder than probation meetings. More personal. Also arguably more important since the point of the probation reporting is to confirm compliance on the other stuff.

I really like this ruling. The judge paid attention to the work the defendant put in and still ensured the underlying issue is being addressed.

He's not abusing drugs so he's better equipped to be calm and attentive plus his mental illness is managed by prescribed meds that he must take as prescribed!!! which will also help him to be calm and attentive. 1 is not possible w/o the other.

Agree with your assessment regarding the family members saying he wasn’t using but they didn’t know he was before…..so how do they know if he is or not? This confuses this old grandma….🙄and this attorney is going all out for this guy…..he’s definitely advocating for his client….and he’s long winded…says a lot.

Seems like the family just wants to protect a member and they're blind to the truth. They don't live with him, they don't see if he sleeps every night, he probably doesn't visit them when he's tweaking and looks like a zombie after a 3 day binge. I mean, he's on probation now so I hope he keeps up with his PO. If he really cleaned up his act he'll be fine.

I'm usually one who thinks punishments need to be faced but I have to say that I think this is reasonable outcome. I think extending the probation is actually better than making him serve jail time. By all accounts he has improved himself and having him sit in jail could have a negative impact. I wish him much success.

I still say he should serve his jail sentence on weekends so he can attend his college classes during the week and have free time on the weekends to get into trouble. His weekend jail time will allow him time to plan on how he is to complete all that he has to do to complete his probation that he chose to ignore ... he can that when he is free during the week after attending his college classes. He can attend college classes at night and complete the programs he was ordered to complete for his probation.

Fully agree. He’s already put in the effort to become enrolled in various positive things as well as remained sober. When someone is fresh out of addiction a set back like that could only cause relapse and a loss of all hope upon release. I hope this young man continues on the right path.

He's operated within the spirit of the law (if not the letter lol) since his conviction... it sounds like he just needs to get in the swing of reporting to his PO and taking whatever classes they recommend/going on the record as having completed his probation, and he'll be right as rain no jail time needed? Or did I miss something ❤

Thanks for the closure, Squish. It is good to see him clean & sober, and getting his life back on track. The 12-step programs will help him to clean up his past and make amends as necessary. I hope and pray that he continues to grow & mature & becomes the successful adult he seems to want to be. x

He just needs to get his stuff together now and that’s what he has and that’s what is working. He’s enrolled in college and has family support. I’m sure they’ll be watching and supporting him along the journey. 💯💯💯

Great Hearing. Probation Officers can "SOMETIMES" take their Job a little to serious or not pay FULL attention to everything happening and ask for a Revocation like they always do just like in this Case. This Defendant proved to the Judge he is not the same kid they ALL saw 2yrs ago. This Judge listened THOROUGHLY to EVERYTHING said and even though it was THIS JUDGE who put him on Probation and THIS JUDGE he "blew off" he chose to take the high road and made a great decision I think. Just tells me that this is a very TENTATIVE Judge.

The probation officer definitely takes her job personally. The kid is actually doing great compared to most people in his predicament. This judge is super fair. Good job judge!

I don't have the most positive impressions of female probation officers. Without exception, every one I've heard seems to approach speaking to the court as though they have "something personal to prove". None have ever appeared to be there in any type of guidance role, and while they shouldn't be expected to be a defendants'cheerleader, they do only focus on the negative, even over emphasizing things unnecessarily. I could include several appearances by POs who were admonished by the judge when trying to have a defendant's probation revoked, including one defendant who submitted 260 hours of Comm. Svc but only had a 40 hrs requirement -- The PO would not accept the hours b/c the form had been initialled daily but a full signature was given for each week instead of daily. Another who wanted probation revoked because the county-approved testing lab admitted to damaging the specimen during transport leaving no actual specimen to test - the lab sent both the PO and the Def a notification E-mail, but the PO claimed it was a "failure to test" by the Def. If I recall correctly, the Def wasn't even aware of the E-mail sent by the lab regarding the spoiled sample until she received notice of the court date for Revocation because she didn't often use E-mail and didn't drink/use drugs. Usually and regardless of the sex of the defendant, a male PO filing to revoke a probation has given the defendant a few chances to get his/her act together, but that's not so w/female POs.

@@B_Bodziak I hear ya; and quite frankly I happen to agree with you. I've seen several female PO's do that, and I'm of the same opinion: why wouldn't this PO have acknowledged the positive means by which this gentleman succeeded? Do they think they have something to prove? Yes, he did do some wrong by not adhering to his probation meetings, but look at what he DID accomplish. Sometimes, it's important to give grace to those who have earned a bit of it, just like the Judge did in this case. You're right, they should not just punish but also be an encouragement and help them to succeed. This gentleman deserved some kind of leeway for what he was able to do "without probation on my back". I understand what he meant. This PO was hard-nosed and had only punishment on her agenda. I'm glad the Judge saw through that. He made a good decision.

I spent nearly 10 years on felony probation and i have seen my share of revocation hearings, and I want everyone to know that what happened here is a 1 in a million. I have never seen a revocation hearing that ended on the side of the accused. They always ended up with revocation. This judge is truly empathetic to bunt's situation and I think he's throwing every tool he can into the mix to keep this guy out of jail and it's the right thing to do. I was honestly expecting this to end in revocation...

It is amazing that getting a fair shake in court is a rare occurrence although he had a good paid attorney which in reality is what got him out of this & on a side note depending on the length its better to take jail time over dealing with the misery of probation for a decade

My little brother had a revocation hearing, and the judge really paid attention to the circumstances in his case too, and ultimately made a very kind and fair ruling, so it happens. Should happen more often, but it happens.

I saw it happen to a guy my sister was dating back in 2014. He got his parole revoked and was going to do the remainder of 15 years for pissing hot. What I had no idea about was the reason he tested positive for heroin was his infant son dying which sent him into a pretty bad spiral. Was at the hearing and the judge let him walk free.

I do like to get the follow ups, thanks for this. Glad he turned himself in, however he didn't do what he was supposed to do for his probabtion. He is very polite, the Judge is fair, I do hope he does everything he needs to do on the completion of his parole.

In most circumstances I would say “lock him up”. He should pay for his crimes. He did that without someone from probation looking over his shoulder and collecting fees. I think this case was fairly addressed by the judge. I like this judge. Please do not let us down Mr. Bundt.

Let the kid attend college courses and spend weekends in jail. The Judge could tether him when's he's out of jail during the week. Once he successfully complete's his ASSociates degree, he can be set free from his criminal record if he continues to be a law abiding citizen. He will have to continue as a patient of the mental health services for the rest of his life until WE as a Society FIGure out how to heal the brain as we do the body and spirit.

I hope for this young man that the Judge made the right decision as his substance abuse is the 'root' of all of his problems and he must stay clean and sober if he wants to be a successful and law abiding citizen v a shitizen that needs to be caged like an animal.

It must strike fear in the heart of a public defender when defendant, sitting in jail, says, "I'd like to say something." I would absolutely prep my client that terrible things generally occur after that statement. The other thing I would make extremely clear to a client is that this is not a conversation with the judge. The judge will make A LOT statements and is not waiting for you to confirm them by saying, "yes your honor", nor fill in extra details.

There isn't much "prep time" between PDs and defendants. Often, it's as short as 7-10 minutes before the hearing. Sometimes, you don't get a chance to even look at the file until earlier that same day and for a very limited time. For the vast majority of cases, a PD mitigates punishments and makes sure correct courtroom/police-related procedures are followed.

It's hard for the general public to know, but absolutely - you basically should not speak unless directly asked a question, and when asked you should answer the question as asked. If the judge asks "Do you like dogs?" you say "Yes, your honor" or "No your honor" or "I like some dogs", you do not need to explain your entire dog-related backstory like you're narrating a novel.

I am definitely a "hard on crime " type of person. My first thought on probation violations is punishment. I think the judge did a good job of balancing punishment and restorative justice. If he steps one toe over the line though, bam 1 year in jail.

You still have to balance what "Bam, one year in jail," will do vs alternative punishments. The effects of a year in prison can have a profoundly negative effect on the defendant and society for the next 40-50 years, as well as, a hardship on his family members, who are innocent victims of his crimes. Whenever there's a chance to aid a defendant getting back on track, that is often the best outcome for everyone involved. He's also very young. A 50 yr old Def often needs to be treated differently than a 21yo victim. There's a reason Judges want to know a Def's living situation, job status, marital status and whether there are dependents involved. Also, a year in jail in addition to what he's already served is likely longer than his original sentence.

No, he only got 10 months jail and probation for his original charge which they fail to mention in any of these videos. He is a registered sexual offender for being with a 13 year old.

Absconding immediately and completely blowing off probation is not an accident. He needs to discuss why he did that with his counselor, there's something underlying there. Don't want to get in the habit of being a scofflaw.

I have a feeling since this Probation Officer didn’t get what she wanted with him staying in jail. She’s gonna be on his ass and try to violate him. I’ve been in the Probation system with something very similar. Happened to me when I was in my early 20s it’s almost like probation officers set you up for failure no matter how hard you try. The judge made a perfect call, and trusting he has turned his life around. I wish this guy the best.

So, I’m of two minds about “great strides.” Part of me applauds the steps taken by people to turn their lives around. The other part of me says that the proof is only in what they do when they’re not being watched and having to report in. When people say, “He did great when he was in a circumstance that forced him to not go off the rails, and that means he’s changed.” Well…not really. The question is whether he can avoid the habits, people, and situations that he was doing before when there is no one forcing him to do so. Only then will he actually have changed.

At 7:35, As for "no testing", wouldn't they have tested him upon entering the jail? Also, his addiction counselor likely does random urine testing on him at appointments.

I have to give him credit. I've been locked up, and there's nothing more terrifying than the potential of losing your freedom. Being behind bars is the worst. So to drive up and turn yourself in to be locked up takes guts. But he did freak the f*ck out in that first video, but he did more than most would do.

THIS is the “reform” for-profit-prisons CLAIM to be about and support. I would have been furious for this kid if the Judge had thrown him in jail. He’s accomplished more in only 2 years than literally most humans could have in 5 years. From not even graduating HS to being enrolled in college. Steady on his medication and therapy without court supervision (which is especially amazing for mentally ill ppl and addicts). He quite literally turned himself into a new person. And I’m glad the System didn’t overlook all his effort because of trivialities and technicalities.

Discipline ....... lawfully ...... why can't we punish our children? You talk back, swear at us, etc ... you get the "mommy flick." Act out in the store ... you get your leg popped! ..... it's not Abusing, it's showing care, love and knowing the difference between right and wrong .... and how to show your children the difference!!! I'm not perfect! I'm now dealing with a 13 year old, with a part-parent that I live with that doesn't let me parent. My 8th grade didn't get to graduate with his class .... AND he got suspended for the last week of school!!! I'm Not Perfect! MY OLDEST, however, is 21, almost 22. Next oldest just turned 19. I do have knowledge... Yes I'm still lacking. My partner won't let ME parent out youngest, the 13 year old. I have to keep my mouth shut because "I'm too strict!"

I'm often to the right of Atilla the Hun when it comes to crime and punishment, but this is _absolutely_ the just outcome. I'm deeply confused by why probation would characterize the underlying crime(s) as "very serious offenses." It's not _good,_ but vomiting in the bushes during a joy ride in a rental car you failed to return because you're coming down from meth certainly isn't what I was expecting to hear after she said that. (I mean, there weren't even any allegations that there were 911 calls because he was driving recklessly, just that the throwing up into the bushes drew attention to himself.) While you could argue a little jail time might be appropriate, time inside _with the other people who are inside_ is a risk to his accomplishments, which are a net good to society. He needs to be around people who celebrate his sobriety and education, and who won't try to undermine or belittle it. So much progress in twenty months is incredible -- especially with meth -- but it's not out of the woods yet. I wouldn't recommend everyone in his shoes should try it, but the fact that this guy pulled himself up by his own bootstraps makes it _infinitely_ more likely that this will just turn into some unbelievable anecdote about his youth than if he had merely gone through the motions of probation.

When you're in front of a judge for a probation revocation, And tell the judge that you cannot go to jail. because you have to attend your GED Graduation (which would be a hilarious image) Has as much weight as also paying. All the fines and court cost a year after they are due and the day before your probation revocation.

A wise & diplomatic judge manages to not completely piss off a butt-hurt probation officer, a very good lawyer who can"t say enough good things about his very good client, or a fragile defendant baby-stepping into recovery. However much he makes, that judge isn't paid enough.

Why don't you point to something backing up these very serious accusations? Another video, court records, anything? The charges was meth related and joyriding a rental car. In both videos I've seen on this kid. Not even the slightest hint of what you are claiming in either one.

Bottom line is you dont get to do probation tour way. You do it the courts way. Im proud of him for all he did accomplish, but agsin , he did whst he wanted to do and not what he was court ordered to do. 30 days would've been a .ore appropriate sentence, and i agree with the continued probation. I wish him well in his recovery and his future endeavors.

I think it’s nice and all, and I’m glad he’s making better choices, however, I think there’s a big difference in doing what you want to do and doing what you have to do. Getting his GED, going to college and going to counselling, again, all good things, are things he wanted to do for himself so he can get things in life for himself. As a former addict who always kept my job, paid my bills, gave back to my community, I hid it very well. Probation is a gift given to a defendant in lieu of jail time. I just don’t understand how you would want to work so hard at all of those things but apparently just say ‘I don’t care’ when it came to ANY of the terms of his probation. Interesting the judge also said ‘eventually turned himself in’ I’m glad it seems to be a happy ending and I wish the guy well, this just leaves me confused as to what’s really going on here.

She said "hes doing well, thats great" like it doesnt matter & right there her job should be in question because putting him in jail at this point in his life is not contributing to be a better person & society isnt that the point of all this?
