It is criminal. There is Supreme Court case law on the books that determined that elements of the USG cannot deputize private industry as an end run around The Law of the Land, such as The Fourth Amendment within The Bill of Rights pertaining to search and seizure. Of course, that's just paper, and only political will can enforce it.

So, as I understood, it ANOM was a worldwide joint venture between intelligence agencies. The guy who invented ANOM, who got caught doing bad things , made a deal with law enforcement to make and distribute ANOM phones to criminals and built-in a backdoor where law enforcement could see all the messages from everyone.

When they started to arrest everyone they had been investigating in Australia they were able to dismantle the biggest individuals who controlled the drug supply into Australia,it took a year to repair the drug shortage back to normal,it was impossible to get any product for many months & prices tripled & stayed very high for two years,what cost $3200 before the arrests increased to $12,000 after....

The analogy of a lawyer breaking into an opposition lawyer to take their notes doesn't actually make sense because lawyers are required by law to share their evidence in a process called discovery. In fact, if they don't share, you are basically guaranteed to be able to appeal the case and you might just win the case by default.

Evidence != notes, eg strategy notes, and not all evidence has to be disclosed. Eg in most places defendant in criminal case doesn't have tomdisclose anything unless they want to use it in court.

You can't expect total privacy (of even safety, at that) once you are a suspected target. But you can protect yourself from becoming a target in the first place. Protecting from non-targeted, mass surveillance is doable.

Cooperation internationally between domestic law enforcement agencies circumvents at least to some degree the laws of each individual nation involved. I couldn't imagine an easy time for any lawyer trying to hold say the FBI for example accountable for anything in an Australian, New Zealand or UK court. Governments of friendly nations spy on each other all the time so why wouldn't we expect they'd be spying on forgien citizens they might deem of "interest" too. I don't know how forgien police agencies feel but it's definitely a sentiment in Australian law enforcement that the rules are stacked in the favour of criminals and not the police. Pretty it's messy though if you ask me. I guess that's another advantage of something like the five eyes that most ordinary people wouldn't think about. Sneaky buggers.

Only if they don't answer the questions honestly. So the prosecution does not ask for the truth, only the cover story. It is up to the defence to poke holes in that story so it can be seen as a tissue of lies. The court did not evolve from finding out the truth, rather it was which side won the fight.

If a server is able to keep a copy of a message, its not end to end encryption being used. End to End - Means its encrypted on the user device sending the message and decrypted on the user device receiving it.

Oh this is real old about the Samsung smart TV listening, however you could disable it by turning off voice activation last I checked unless it changed. This is alarming none the less, they collect audio data, how do we know they are not selling the audio to criminals so they know when you are home? Regardless anyone having your audio from your home is not cool, however you could also cover that mic. Makes you think twice about those roku remotes with voice activation, though I doubt that small device is storing audio. Do not forget some TVs come with cameras, you can research with ones, cover it, or check out the online schematic for your TV. 7:24 yep sneak apps do this same thing to hide contacts or texts that you want hidden by hitting a secret keypad entry order. Pretty sneaky stuff.

The reason the FBI listening in on these calls was not a violation of the 4th amendment is because the 4th amendment ONLY applies to the government. However, if I am a private person/company that happens to have access to TONS of data, there is no rule saying that I am not allowed to hand that data over the feds. Afgoo is the key here. HE is the one spying on these criminals, NOT the FBI. The FBI is simply reading data that is handed over to them. The Constitution does not apply.

most western countries have similar entrapment laws and requirements for warrants to tap/couvertly listen to phones. im suprised a lot of the criminals didnt get off claiming entrappment as the phone providor was managed by the FBI and sold as secure, and the calls were couvertly monitored and listened to illegally before there was any reason for suspicion let alone attempting gaining a warrant to listen to the call in their country. why didnt the FBI just give officers in another country access to monitor calls in the US without a warrant? would be just as legal / illegal

Entrapment only works if an undercover law enforcement officer talks you into committing a crime you otherwise wouldn’t have so it wouldn’t have worked for those criminals.

I have a question, and I know it’s not the same as your talking about, in the Idaho 4 case, I feel it’s clear, that they violated the tos, of some genealogy companies, and used people who did not opt in, as they will not provide info. If violating others rights, to get a killer off the street, do the ends justify the means?

I agree 100%. I put the book on my wish list, and will order it with other items. which gives me free shipping. I personally don't need a phone, so I do without it. It's amazing how many businesses you deal with that want and even require you to have a phone, UPS is one of them, which they will never use, for the purchase from them. If you use another person's phone, and they know it, they don't like it. You make up a number, and they will except it. Put 555 in it, and it has not been denied yet.I think this is illegal, since offering something for sale means you need to sell it at the price you offer it. It's getting out of hand.
