Generally the same way when it comes to Tammy Duckworth, and Dick Durbin.. ⌐⌐ We're still tyrannized by Chicago, but they don't have that much longer left in Illinois. But generally.. It forces the agencies to have to have the court decide if what they're attempting to do against a citizen (business or otherwise), they have to ask the court to approve it. As as a farmer, I approve of that.

Our Founders designed a small government with limited, enumerated powers. It was their intent to interfere as little as possible in the lives and Freedoms of the People who are to be respected as the sovereigns of this Republic. Congress was divided into two chambers, one representing the States, and the other the People. These also are limited. The problem enters when Agencies, who are NOT elected, begin to assume powers not delegated to the and create rules/laws without Congressional process, debate, due process - which must include submitting all proposed rules and regulation for approval of both houses, and representation of the People. We now have more laws, rules, regulations, and "guidelines" and "recommendations" - which have somehow become enforceable, than any reasonable person, committee, or group can keep up with. The overbearing volume and complexity of this mess has created a system where nobody knows what the laws are and everybody can probably be found "guilty" of something he had no idea and no reason to believe or know was in force. The Agencies must ALL be brought under control and Congress must do its duty. I would suggest that all laws be Sunset at two years. (Perhaps this could be extended to four or six year for laws that have been renewed by 3/4 of both Houses three times in a row.) This would rid us of frivolous laws and stabilize our system, giving security to the People. It would also give Congress reason to think much more carefully before introducing crappy laws.

Completely agree. When you look at the power of the Federal government and especially the power of the Executive Branch today it is an astounding difference from what was intended. You have Presidents unleashing more and more executive orders every term(except for Trump). With Obama's Congress using the Nuclear option in Congress it now only takes a simple majority to pass any bill or appoint any judge making things even more polarizing, and if Biden or any President ever packs the Supreme Court it will Eliminate the Supreme Court as an effective body as any President who controls both houses of congress will defacto control the Supreme Court by appointing more Justices. Just like the Nuclear option in Congress once that is done both parties will use it. Then since Covid hit they have discovered they can just declare an Emergency for any reason they want and the Constitution is null and void.

So, according to Nadler, courts do not enforce guidance of agencies, but they use that guidance to assist them with the directions of interpreting policy and rules. That sure sounds like enforcing guidance to me, as the jurisdiction of a judge, and their questions of law, is guided with the directions of an agencies recommendations. The direct legal effect here, or the pith and substance of the law, is an agency telling what the judge to consider in making a decision about a question of law. That contradicts the separation of power between the judiciary and the legislative branch of government, and the healthy function of an independent judiciary. Anyone who doesn't understand this, would fail Con law, and probably Admin law shortly after. Nadler wants judges to exercise deference to agencies, but at the same time still allow them to adjudicate on the same issues contemporaneously, thus making agencies judges themselves by extension. That is logically, and legally unsound.
