I worked as a maternity nurse from 2003 to 2016. I cared for hundreds of women from other countries (mostly India and Dominican Republic) who came here during the second half of their pregnancy and stayed long enough to give birth. Not all come to stay. Many return to their homelands and collect US benefits for their American citizen babies. There are people here making making big money to accommodate them...they arrange for their travel, provide room and board, connect them to proper resources, etc. It's a business. That's just my experience in one hospital in one small state. Imagine that happening across the nation. We've been getting ripped off for a very long time.

They waited in Mexico (about 2 years) before they could legally live in the U.S. after the husband became a U.S. citizen. So I'm assuming both parents would have to be U.S. citizens (legally). But really don't know for sure. Maybe the child would have dual citizenship!

I am a retired social worker. The anchor baby phenomenon needs to end. Just ONE child born in 2013 would cost his parents $304,480 from birth to his eighteenth birthday. (Tuttle, 2015, National Review). The research on this topic is staggering. I contend any child who was "used" as a meal ticket -- is severely compromised & likely not being raised well. Multi billions are spent currently on U.S. birth tourism. The 14th amendment was never designed to be abused this way ... neither are babies. Trump's on it, thankfully.

The problem I’m seeing with doing away with 14a is that the arguments republicans are using against it are also used against 2a and even 1a by democrats. If you ask me, SCOTUS is better off just leaving the constitution as is, and simply changing the law to where anchor babies can technically stay, but the parents are still subject to deportation - which would leave the parents with no option but to either leave the kid with any legal relatives, put them up for adoption, or take the kid with them. That way, birth tourism is disincentivized while still honoring the constitution.

UK: Although we don't have a birthright issue, we do have health tourism. Pregnant women fly in, hang around until it's time, then the National Health Service, the NHS, caters to their every need, for Free. As soon as it's possible, they fly out with the newborn back to wherever. Officially, they are supposed to be billed, but it's almost impossible to track them down for payment. The health tourism also applies to treatment for a huge range of medical issues such as cancer ops, surgeries etc for Free.

Finally someone said the quiet part out loud. The whole reason that section of the 14th amendment was written was to address the issue of the formally enslaved black population to have citizenship. Why the hell would they have been thinking in the 1860s that 150 years from then that all these different ethnic groups would want to come to America and live. The 14th amendment is obviously due for reinterpretation. Black people should be outraged that an amendment written for our ancestors has historically been exploited in this way.

There is no such thing as "Birthright Citizenship" in the Constitution. The only exception is if at least one of the parents are a US Citizen. Also, notice that the 14th Amendment makes no provision for citizenship for Illegals just because they have kids here. 14th Amendment: All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws. Subject to the jurisdiction thereof being the key. If the parents are not citizens, then neither are their children.

I asked an emergency room nurse what percentage of people have insurance. 30%. Think about that. Hospitals have to provide services. The US Supreme court in 1898 ruled that to get birthright citizenship can be given only to immigrants who are married to US citizens and have a permanent residence in the US. Illegal immigrants do not have permanent residences nor are they married to US citizens, so if they are pregnant and give birth to their child while in the US they still do not qualify for birthright citizenship. That ruling in 1898 was very very clear and very specific on what constitutes and qualifies for that type of citizenship

Additionally, if you are pregnant and entering the United States at a border port of entry via vehicle, be aware the radiation detection portals deployed at the ports do not emit any radiation, and do not present a hazard to you and your unborn child. Note: On January 24, 2020, the Department of State amended its B nonimmigrant visa regulation to address birth tourism. Under this amended regulation, U.S. consular officers overseas will deny any B visa application from an applicant whom the consular officer has reason to believe is traveling for the primary purpose of giving birth in the United States to obtain U.S. citizenship for their child.

The intent is clear through 100% of their actions for all its history, there is a legal process for removing an amendment from the constitution. In fact, the law of the constitution even dictates how that is done. Executive order is not a legal process for removing from the foundation of our constitution and it is against the law of our constitution to do so or attempt to do so. and if you’re OK with the president executive ordering out our constitution then you can put your flag down you no longer believe in it.

Talk to hospitals in border towns who were losing so much money from non-paying foreign births that they had to close their L&D departments, or they couldn’t staff their L&D departments because OB/GYN’s refused to work there because they weren’t getting paid, then they had to close their ERs because women would drive around until they were effaced & couldn’t be turned away, so the ER departments were closed. I heard these stories over & over.

Not just border towns. My mother in law, sister in law, niece, and brother in law are all nurses, and they all have the same story. When my mother in law was director of nursing at a private hospital, she said illegals would show up almost crowning and demand a private room. They could not turn them away. Of course no bills were ever paid. Many hospitals have closed in Houston because of this ridiculous misinterpretation of the 14th amendment. They were losing so much money and obgyns didn't want to practice there.

Do people really think that while people cannot borrow forever and not pay it back, that countries can? In my country, many actors and actresses travel to America on tourist visas to give birth, knowing that their baby will automatically become an American citizen. After the birth, the parents typically return to our country. When their child turns 18, they can return to the United States without needing to complete additional paperwork, as the child was born in the US. I agree this law needs to change.

The 14th clearly states that the person giving birth must be under the complete jurisdiction of this country, in which case the child can be a US citizen. This would be someone who is here LEGALLY and who is under the full jurisdiction of the USA, in other words a permanent legal resident or a naturalized citizen. Illegal aliens are NOT under the full jurisdiction of the USA! So the 14th doesn't apply to them because they have broken federal law. A person that comes here illegally has committed a crime, in other words they are a criminal. Breaking the law makes one a criminal because you have committed the crime of breaking the law. Those criminals that are here are NOT UNDER THE FULL JURISDICTION OF THE USA because they broke the law and are here illegally, so they do not get c citizenship for their children. If a mother STEALS something and gives it to her child, what she has given to her child does NOT belong to her child because it was STOLEN.

Eventually, he married my mother and finally took the test and became a naturalized citizen after 15 years. He didn't try the cheap way to do it and come illegally and have children born in the USA to become citizens in order to stay.

That’s a fair question but I believe it has been creatively misinterpreted out of malice, not out of ignorance. Section I of the 14th Amendment is clear, in that a birth parent must be under the [legal] jurisdiction of the United States, which illegal immigrants are not. SCOTUS will inevitably take this up and their ruling will settle this issue once and for all. 🇺🇸

If the 14th amendment intended to add or include children of foreign nationals, they would have added the language, pretty simple. They didn't. A second requirement was included beyond birth, "subject to the jurisdiction thereof". If you line out that portion, you get birth alone. But that's not what is written. You can't ignore a part of the amendment because you don't like it.

Yes and no. If you enter illegally and you have a child that is US citizen you have to wait until the child is 21 years old. Now because you enter illegally you are not entitled for adjustment of status meaning you can’t get a green card. The illegal will have to seek a pardon which are rare and extremely hard to get regardless of the administration that is in place. Then that person will need to get the green card outside of USA and start a consular process. When you are illegal in the United States and depart overseas you trigger a 10 year ban. So you can’t go back to the country for 10 years and even then is discretionary, even with the pardon they can deny your reentry, you might get lifetime ban and won’t be able to go back becoming ineligible for a green card. So basically is a process that may take 20-30 years depending of how old is your child, this is not new. I’m not advocating for immigrants. I just don’t like exploitation of a particular subject for political gain. They are trying to make sound like if you are illegal and you have a baby that is a USA citizen you can then get the green card in a blink of an eye haha and that ain’t the truth.

It’s not the citizenship birthright that worries me the most. It’s the changing of an amendment because it doesn’t align with your beliefs. I could say well let’s change the 2nd and I bet a bunch people will be angry, so it’s okay to change an amendment so long as it doesn’t conflict with your beliefs but when you don’t like something you change it as you please. This sets a precedent and a bad one.

I believe that is what was done to native Americans by our ancestors whether they came on the Mayflower or another way. Entire families were packed on a boat because they felt about their country the same way some of these people feel about their countries. How come we feel superior than they do. I see people come here, have a baby, go back to Mexico, 2 years later come back and have another baby, go back, I have seen it done up to 5 kids. Then take advantage pf the benefits.

That was a loophole people! I spent 20 years of my life in a third world country and my entire life I would hear people directly, people indirectly, people speaking about a relative or friend, one of my own friends say and do “I’m going to get pregnant so I can cross the border and have a citizen kid” my own friend even tried to entice my sister to go with her so she wouldn’t be by herself traveling with the coyote. Thankfully my sister was taught better from my dad and didn’t go. Our friend did which means that she didn’t get pregnant because it was the right time, she didn’t get pregnant because she was planning on it or had the money to… she got pregnant with the sole purpose of having an anchor baby which she did. This is a fact and even to this day I continue hearing or reading people on a mom group I follow ask questions regarding “has any of you gone to the U.S. to have a kid there and how did it work out for the citizenship?” I’m sick and tired of telling people why that’s wrong only to be mocked and cussed at but that’s reality. People are not fleeing from anything and just so happen to be pregnant and looking to give their babies a better life, PEOPLE ARE ABUSING THE SYSTEM BECAUSE BIRTHRIGHT CITIZENSHIP IS A DAMN LOOPHOLE and people lie about it and use it ALL THE TIME

100% of our government on both sides 100% have followed this law. There has never been a waiver. The intent is clear through 100% of their actions for all its history, there is a legal process for removing an amendment from the constitution. In fact, the law of the constitution even dictates how that is done. Executive order is not a legal process for removing from the foundation of our constitution and it is against the law of our constitution to do so or attempt to do so. and if you’re OK with the president executive ordering out our constitution then you can put your flag down you no longer believe in it.

@ did I write anything about the entire question about whether or not the 14th amendment should be taken out or changed in anyway? What are YOU talking about? I spoke from my own testimony as to how people thousands of people have used it and abused it. This is true and a real concern because it is happening and it will continue to happen. It is happening, I’m not even sure you understand and whether or not you’re ok with that happening. My comment in its entirety is about whether or not people were using the 14th amendment to have anchor babies on purpose which they are.

This guarantees citizenship rights regardless of race, ethnicity, or previous condition of servitude, and forms the basis of the principle of birthright citizenship. Meaning children born with illegal immigrant parents should not be citizens of USA 🇺🇸 this means lots of people will be deported
