Playing the legal language games. CJ's assumption that he can walk in to the site because the gate is open and there are no signs won't hold up to the law. The legal position is that you should not be chancing your arm walking around on private property unless you have an obvious reaoson to be going on there. Postal deliveries and the like are the obvious reasons. Wanting to take photos or film doesn't fit in that group. Now fair enough CJ gets in and he's filming and as long as the people there are willing to tolerate him he can get away with it. But then your man tells him to leave. The law expects CJ to leave. And to leave immediately without making any fuss. Now they could have spelled it all out like a lawyer and talked about removing the implied right of access and that CJ was trespassing. But the law doesn't expect everyone to have a law degree. As long as they make it clear enough that you are on private property and that you have to leave that gets the job done with the law. You have to go. Now we get to the business end. Trespass is, and most everyone seems to know nowadays, a civil matter. Which means the landowner or their agent/s must supply the reasonable force in the circumstances to remove the trespasser that has by word or deed refused to leave. Reasonable force in the circumstances. If is a wee woman and you are a big man she won't be able to do it. But if she tries and you resist, well that's you putting your head in the lion's mouth for both criminal and civil law. If it is these fellas on the site, well they did right enough. They didn't take CJ away and break his legs. They just did what they needed to get him off site. The verbals don't matter any apart from when CJ says he will defend himself. Then it matters where he is. If he is still on the site he's in the wrong with the law. If he is away on the public footpath or highway outside the site he may defend himself if reasonable in the circumstances. Given what happened up to that point though the law would not be super keen on taking his side unless the fellas did something grossly disproportionate. Does CJ have any legal claim over any of this? No. He chanced his arm going where he knew he may be trespassing and told to leave. He did not leave immediately and without fuss when he was told to leave. The force used to remove him was obviously reasonable in the circumstances. He has no potential claim for anything here. The other side have no reason to bother the courts either. CJ was removed and none of the fellas on site were injured by him. He did not damage any property, and he did go away and leave them in peace in the end. No reason to go to the courts seeking injunctions against him or anything else. All UK based auditors could do with watching and learning from this video. It's very useful for getting your head around the parameters of the law as it applies in these situations.

Some auditors take the scenic route when leaving and pause for additional banter. In my opinion it looks bad.
