Hello po Atty, What if po yung Mortgage never registered and notarized, magfoforeclose po ba yon? Mr. B borrowed P4,999.00 from Mr. A. To secure the debt, Mr. B executed Real Estate Mortgage of his house and lot in favor of Mr. A. The mortgage was never notarized and registered, Mr. B soon defaulted in his Obligation to repay Mr. A. As a result, Mr. A is now looking to foreclose the Mortgage. Can Mr. A foreclose the mortgage po Atty?
