Unfortunately, the comment above me is correct. There are one-party and two-party states. Depending on a variety of factors, he could or could not fight this. If the state is a one-party State, all they need to do is be the ones aware of the recording. One party can be the individual recording it. In a two-party State, he would have to be aware of the fact that they are recording him as well, and without consent, couod sue. A little screwed up, but that's the general basis of the rules. If you're interested, a basic course in Private investigation covers this. One reason I backed aware from it.
