@KevTech1 Miranda must be read before police questions a suspect who is in custody. They don't have to mirandize a person the moment they are taken into custody. However, if the suspect voluntarily spills his guts before being mirandized or is not in custody, then anything said can be used against them. So, it's best to keep quiet.

But I lived in NYC off and on from 1993-2018. And during that time i avoided any DUIs (easier in NYC). I did know a few Americans who got them and not one who went to jail. That's terribly anecdotal I know! So I've researched it and as expected, I found that very few first time DUI offenders get jail time. Except perhaps black americans like this guy in the video. So you're right, perhaps this person would have gone to jail if his wife wasnt a judge. And I understand how that sense of injustice makes Americans feel.

This reminds me a Florida DUI case of an FBI agent who was going the wrong way on I-95 and crashed into an oncoming car, killing two brothers. A “fatal flaw” by the highway patrol in the investigation resulted in the agent being sentenced to just six months probation. Intentional flaw, in my opinion.

The speeding was explained away by that LT the investigators were interviewing. Because he was trying to say that the Sheriff deputies should have charged him with that as they were the ones that saw it happened, but those deputies are just as corrupt because they didn't want to mess with the guy in the first place and it required the police to step in and do something.

Just because Miranda Rights are not read to you it does not mean the case is over or dropped it only means you words can't be used against you in trial to prove guilt but they can still be used to impeach credibility and at sentencing hearing commonly . All other evidence stands like the bad driving, failing the sobriety test and refusing the blow test. Not taking the alcohol test alone gets him a 6 month license suspension in S.C.

I walked out of law enforcement in 2009 for crap like this. I miss actually helping people but it’s the best decision I’ve ever made. Moved out of the hood, out of the city and my ulcers went away.

When the 2nd and 3rd in command PURPOSEFULLY DO NOT bring up that a judge called them about her husband's arrest, they are guilty of collusion/corruption. That said, the officer who saw the infraction not being apart of the case is worrying.

The body language of that lieutenant being interviewed, says he’s lying, probably for 26 years. The body language of the arresting officer saying no one pressured him, and he knew 30 minutes later he was gonna drop the ticket says he’s lying. The facts are they were pressured into it, and now they’re telling more lies to cover the first lies. Classic classic classic. Two-tiered justice system for anyone Who’s a drunk husband of a judge

The experienced, certified DUI cop, and instructor forgot to read Miranda Rights? Miranda Rights are not required under S.C. law at time of arrest they are only required at time of the custodial interrogation. Did the custodial interrogation take place? The cop told the perp he didn't care where he came from or what he did when booking him. Cops still had bad/reckless driving, failed sobriety test, and refused breathalyzer test. Easy 6 month license suspension for the refusal.

Yes! That was so wrong! SLED cops seem very ignorant! I’m assuming they had no idea that hemp is not marijuana. Hemp is used for many different products, fabric, sheets, towels, etc.!

Situations like this make me question why the U.S.A. sends our children and grandchildren to war in other countries to fight tyranny, civil rights violations, or to promote ''democracy'' when these rights are violated daily in our own ''Great Nation.'' As a former veteran, I feel great shame at the ongoing violation of our Constitution by the criminal ''untouchables'' within the government.
