But what was reason for the decree? Surely they couldn’t pass a decree because hitler woke up one morning and thought it would be a good idea?
@rewboss
@rewboss Жыл бұрын
Decrees are issued, not passed; and yes, Hitler just needed to persuade President Hindenburg that it was necessary. It's a decree, an order from the head of state, and according to section 48 paragraph 2 of the constitution, the Reich President was empowered to issue a decree temporarily suspending or restricting the rights granted in articles 114, 115, 117, 118, 123, 124 and 153, in order to restore public order. As a decree, not a law, it doesn't go through the parliamentary process -- it's intended for sudden emergencies. The decree had actually been in the works under von Papen's leadership. Hitler's predecessor Schleicher had made a speech in December 1932 saying that for too long Germans' rights had been restricted, and that he had persuaded the President to lift them; but he also warned "the communists" that a draft decree had already been written and was lying in a drawer in case the President's expectations were disappointed, ready to be implemented as soon as possible if necessary. The professor was certainly aware of all this, but was asked the question: "What's the emergency?" and responded correctly with: "There doesn't really seem to be one." Hindenburg had made it clear he wouldn't hesitate to impose harsher restrictions if he felt public order hadn't been restored, so all Hitler really had to do was to convince him that it was time to sign it.

@@rewboss I think there should have been pushback when there was no “sudden” emergency they could have called for this. But there is something similar in Oregon’s constitution that does has a declaration of emergency when new legislation is passed that makes taxes and spending to happen on the governor’s signature rather than waiting 180 days. But there’s no requirement to tell what the emergency is
@rewboss
@rewboss Жыл бұрын
@@stroke_of_luck Oh, there was constant pushback. But the constitution of this very young republic -- it was only about 14 years old at this point -- was one of its weakest points. It gave the president a lot of arbitrary powers, almost making him a kind of elected kaiser. And by the very nature of this decree, anyone who tried to "push back" risked a hefty fine or even imprisonment.

I love this series, even though the content is quite spooky! I definitely recommend to show it in schools. Wilhelm Frick was member of the parliament (Reichstag) from 1924. He became interior minister in 1933 and played an important role in the transformation to a one-party state and silencing all other parties. In 1943 Hitler dismissed him without giving an official reason. Apparently Frick was "not consequent enough" and Hitler didn't like his plan to reform the structure of the administration. He then became "Protector of Bohemia and Moravia", a representative function in the occupied territories of Czechoslovakia. At the end of the second world war he was captured by allied forces, convicted in Nürnberg and hanged 1946. As for the law abolishing free speech ... I see parallels to what's currently going on in certain other parts of the world. In Shirley Bassey's words, "It's all just little bits of history repeating".

Hitler was quite fast in securing his position. He could use all the measures his predecessors had already established. Reason: the Reichstag was in such a bad shape that it couldn't decide even on the easiest issues it had to face. And Germany was in a bad shape, too, after three crises between 1918 and 1933. Pact of Versailles, hyperinflation, and Great Depression. At the end of the Weimar Republic elections happened so often that they would occur twice in a year. There were so many parties entering the Reichstag, that they couldn't form a workable coalition any more. The president then started issuing orders in lieu of the government (the so called emergency orders), and as Hindenburg was very old at that time, it was easy to convince him that he should subscribe to the new orders, in order to 'save the Reich'. That reminds me: another thing that Hitler did quite fast, was to kick every politician out of the Reichstag, that was left of the 'center' (which is already conservative), calling them enemies of the state. The rest would agree to anything he would bring forward.

Until this happens to you in a "free" country, you probably don't realize not just how doublespeak propaganda actually works on a lot of people, but also how difficult it is to do anything other than go on with your life, especially if the government is supported and embedded enough to smear naysayers. By the time civil rights and public discourse are targeted, unspeaking acceptance has usually already become the norm.

I found the alternate history in NSA - Nationales Sicherheits-Amt by Andreas Eschbach pretty interesting. The idea is that those inventors that tried to build mechanical computers in the 19th century were actually successful and the first electronic computers were built in the late 1800s. Mobile phones were created during the First World War and when the Nazis came to power in 1933 the internet existed and everybody had smartphones. It is a bit too on the nose sometimes when it mentions or changes real world events and the ending is completely ridiculous and over the top. But the rest of the book is pretty eye opening and terrifying.
