This was about a mere pleading defect as to the facts & laws alleged in support of jurisdiction in the state of Florida. The court is allowing FSU an opportunity to replead its case and cure the pleading defects concerning or pertaining to jurisdiction. FSU needs to plead the long arm statute or statutes and allege facts that show the long arm statute is satisfied. Certainly the parties all have sufficient requisite minimum contacts with the state of Florida. The essence of the agreements (GOR and associated/incorporated ESPN media agreements) pertain to, in so far as FSU is concerned, FSU's HOME games which are played in Florida, thus, not just some, but all of the relevant "performance" by FSU under the agreements is going to take place inside the state of Florida. ACC and ESPN can thus, reasonably expect to be hailed into court inside the state of Florida, in order to interpret or enforce the subject agreements being performed in the state of Florida by FSU and the other parties in regard to FSU. If they plead their case right, FSU's case will survive this jurisdictional challenge portion of this case. In short, this is just a delay tactic by ACC. It's pretty petty on ACC's part. FSU's lawyers should be able to fix the pleading, forthwith. Another question is, where were the contracts executed ? Did FSU "execute" inside the state of Florida ? This is just a bullshit.delay tactic. Clemson & FSU should go ahead and withdraw from the conference before June 30. Pull the ripcord. Rip the scab off.

Quick thoughts! ESPN is big winner as the Court, despite entertaining arguments for nearly 4.5 hours, never reached the issue of disclosing the ACC-ESPN deal. I also found it interesting that the court sided with the ACC on that FSU did not sufficiently demonstrated in its complaint that the ACC falls under Florida jurisdiction. However the Court is permitting FSU to amend its filing. Talk about home field advantage in Leon County!

Hopefully you now have a better understanding why FSU won't win in a Florida court. FSU would be wise to field a JV team to compete in the ACC an fulfill their obligation and field a varsity team and play a few seasons as an independent.

They're not doing all this work to join the Big 12. There is mutual interest between FSU and the BIG. There is that pesky AAU thing though. According to Greg Swaim, of the 13 BIG schools he has sources with 11 have said they will not vote for a school that does not have AAU status.

Didn't Florida State sign a binding contract with the ACC? Doesn't the contract have a set amount of $$$ to leave the ACC? Isn't the ACC headquarters in North Carolina and isn't that where the contract was written? Does FSU want out for moral or ethical reasons? Or do they want out because their TV contract doesn't compare to the Big Ten? Maryland had very good lawyers and sued to leave. They still had to pay over 30 million dollars to get out. Afterwords the ACC raised the exit fee and tightened up any loose ends in their favor. FSU signed it because at the time it was the best deal. Now that it's not the best deal they want to take their ball and go home. I also have not heard that The Big Ten or the SEC even want Florida State. FSU should make sure they have a place to go before becoming an independent. If they want out bad enough, pay the money and stop the crying!

My solution, a) Florida State pays out a $300,000,000 exit fee and b) the ACC lets FSU keep it's TV rights BUT they have to get the fuck out immediately. If that means that they have to play FCS and Group of 5 schools for a few years, oh well, you wanted out SO LEAVE!
