If I were OP I'd have told them,"Too bad, so sad. I'm not helping you. So get lost and I want nothing to do with you." Then have a 'cease & desist ' letter sent to them .

If he went to court, it could have backfired. "Yeah, they've been going so far as to break financial promises and kick their other child onto the streets with no care what happens to him, abandoning him for 5 years without even considering the Iudicrous nature of my brother's claims... just because they would have to admit he's not perfect. Why would my brother not think the company money belongs to him?"
