And then afterwards with the result, the loser may then need to pay for the other party's fees. It gets real costly real quick. And it's not like they're scamming anyone. Crowdfunding is not an obligation, and nor do the people who send money expect any return. It is support for the cause they believe in, if they decide to contribute. There's no scam, everyone knows exactly what they're sending money to. A legal fund. Whether or not the beef/lawsuit is stupid is entirely irrelevant. No one's being scammed for donating to a legal fund, and both have reason to ask for support. Most fans of either party aren't likely to be sending much anyway.
