Hey guys. I've thought about doing a video about this for a long time. Over the years of doing Game Theory, people have had one MAJOR problem with the series - the use of fanart. And since I'm covering the Scott Fan Art Issue as well, I figured what better day than today to address it. I've done my best to set rules in place to keep fanart out of Game Theory but accidents happen and things slip through the cracks. Today I am setting the record straight on Game Theory and fanart. Plus, hopefully giving you fan artists some advice on how to keep your fanart from being stolen.

I don't think this is Mat Pat's fault at all. I think people that complain about stealing their fan art are major hypocrits. Also I consider Game Theory and Film Theory too be fair use. So Mat Pat should be allowed to use other people's work in the way that he does. He is not the problem.

As an artist I really respect MatPat for this, he explained the situation and I am not mad at him (not in the slightest). I mean how could I, how could anyone ? they were just some honest mistakes. They never even wanted this to happen. Game theory even makes a video about it to spread the awareness, I am actually really grateful to people like him having so much respect for arists and actually caring about stuff like this ! I hope he doesn't feel too bad about it, he really shouldn't.

I would even hesitate to say that Matpat made a mistake here. He had full faith and confidence that the images he used were official; since they weren't marked or signed in any way, and were so well-made that even the creator of the thing the fanart was emulating had trouble telling them from his own work. I would place the majority of the blame on the artist themselves in this situation. They failed to learn one of the most basic things school teaches you right from the first day: "If you want credit, put your name on it". And yes, there are assholes out there that remove obvious distinguishing marks from fanart. However, artists have to be smart about how they mark their art. To catch illegal copiers, mapmakers would often include a fake street named after themselves hidden in their maps. That way, if they ever came upon another map with that street, they knew there was some tomfoolery going on. Creativity doesn't just make art, it can also protect it.

Hi!! If anyone doesn't know, Adobe 2018 and up have settings where you can claim your files to be copyrighted or not. Therefore, when it's uploaded, it'll never be used as commercial reuse.

As a fellow artist (if you can even call my trashy sketches that lmao) I agree 100% with you. I always make sure to put my insta @ right over the art to prevent people from stealing (though I’m not sure why someone would really wanna steal my trash but y’know, you can never be too careful). And on top of this? I would actually be over the moon excited if my art somehow got featured on possibly my absolute favorite channel on KZbin! I mean, that would have to mean my art is good enough to be mistaken as real.

as an artist, i’m not mad about this. if your art looks very similar to the original, you’re bound to have people mistake the two. you can’t get upset you’re not getting credit if you make it very similar to the original. the artist is 100% in the right for asking for credit, but being upset over an accident? that’s not cool the biggest thing in art stealing controversies is intent. why did they steal it? was it on purpose? was it to profit off of the image? pretend like it’s their own? when your art is similar to the original, you really can’t be upset at people for mistaking it as such. informing and asking for credit is what you should do, but trying to cancel someone over an accident that isn’t hard to do is not

Completely agree. I think we all need to learn to stop assuming the worst of everything and everyone, and realize that people make mistakes and people can learn from those mistakes. If you don’t forgive anyone for any mistake they ever make, they’ll never change. You have to hear them out and give them a chance to learn first. It’s when someone repeatedly makes the same mistakes without apologizing or trying to fix it that you can get mad. Honestly, I feel like when he uses fan art, He does more than use it, He gives credit to all the people for making it and using them in his theories, Heck he also makes them look so freaking realistic we can't tell if its fake or not. Whenever I see some controversy pop up with your name in the title, I'm suspicious from the get go. I've been watching you for a couple of years now (around 2015, I think), I've seen a lot of your videos, A LOT of your streams, and if there is one thing I learned about you and Steph and the crew, is that you're all genuinely good people. You're not mean, you don't exploit us for anything, you take us into consideration when making some decisions (for example, when everyone started using the youtube membership thing, you asked us if we wanted to have that on the channel.), you make quality videos with loads of research and effort put into it, as well as making sure the merch you make is quality as well. Stuff like "matpat steals fanarts" or "matpat isn't citing any work" is an over the top mess people try to pin on you when they don't know the whole story. If there's someting wrong, you fix it and appologize for it (which I feel like you don't need to do half the time because the people who watch you are smart and understanding and the people who go berserk on you for every little thing that goes wrong should go to h-e- double toothpicks 😡). You are great, your team is great, your videos are great, mistakes happen and that's normal, as you said, we're all human and mistakes happen for crying out loud 😧. I like seeing how much work they actually put into this. It's easy to say "how could they steal someone's work, they should know better." Keep in mind that in the beginning 1) no money was earned on their work, and 2) fandom was a dirty secret that made one an outcast. Now it's everywhere you go artists works are being stolen for profit. There are several "art channels" stealing art videos, putting them into speed paint compilations without saying it isn't their work, letting commentors call them the artist, and monetizing them. So yeah, after spending however long seeing someone they trusted to not do that used their work without asking or crediting, tempers run short.

This is one of the reasons Game Theory is my favorite. The honesty. It's insanely refreshing to see someone explain this kind of thing, and be honest about what's going on, why it's going on, and what they're doing and have tried to do to make it better. I didn't even know that this was an issue until Mat brought it up, and I appreciate that he did. I also appreciate the examples as well, where it didn't feel like an excuse, but an explanation. The Game Theory team does do this for a living, yes, but they do it the most honest and respectful way that they can. For the time I've spent watching and loving this channel, I've never felt that this was a grueling job that people hate or couldn't stand and just do this because they have to. I've never felt that fake enthusiasm that so many KZbinrs have when they've experienced burn-out. They've stuck to their guns from the beginning. Hell, during live streams they'll even talk about how they got little to no sleep because of all the projects they're working on. That my friends, is dedication. (Also, a certain degree of insanity... but dedication nonetheless). Dedication to something that you love, and adore. Dedication to an idea that they have always followed and adhered to. I can't tell you guys how much I appreciate this channel, and how much time and effort everyone puts into it. The amount of care really shows, I think, and every time an episode comes out I always say a silent thank you to the team, because I know that this is something that they poured themselves into. I can't even imagine the amount of research and time that goes into creating and managing this kind of stuff. It's always of the highest quality, and they're honest: this stuff is hard to do. For me, knowing that only makes me appreciate what they do even more. As a lurker I know I don't say it enough, but thank you to everyone on the Theorist team. For every video I watch, just know that I appreciate every line, every detail, every joke, your honesty, commitment, artistry, every nerdy reference, and more! While i agree that the hate towards matpat is somewhat unfair, Matpat's theories sometimes are really (and i do mean REALLY) bad... Like, he lacks any sort of "research" or general understanding of a topic (specially regarding his "haters"). Sometimes It isnt "looking at it from a different perspective" but more like "Not looking at all and making stuff up" (To be fair, i'd say it isn't intentional, but more like he doesn't put as much effort as he should into some of his theories, specially in those which haven't been alreay disccused before in Reddit or some other place) . And to make things worst a good amount of his fanbase doesn't "think crtically" (which to be fair isn't mattpat's fault) but instead eat whole what he says. This annoys the people who do know about the topic (best example is probably his PERSONA and Mario theories). When you apologize to people it's important think about it. Look into what went wrong. For some making notes (mental or physical) on what and how to say what you need to so it comes across property. I've been on both sides of this issue, and it's.. interesting. - As an editor/designer, it can be very challenging to find original images. It's hard enough when an image looks authentic, but even harder when there's no indication of it being fan art (no watermark, signature, etc.). - As an artist, I've had my art used in articles and other videos. I've contacted authors/creators and politely asked to be credited, and only once was I met with resistance. I think the important thing to remember is that people make honest mistakes - we just need to be respectful, communicate issues, and rectify them. At the end of the day, sharing art (with proper credit) only helps everyone: free exposure for the artists, and legal assets for the editor. - Love your work Mat; keep going strong

You're the epitome of a good fan artist. Too many fan artists nowadays get butt hurt when a big channel uses their work which is incredibly stupid, because without the exposure from the bigger channel their fan art would never be seen. I've seen a lot of fan art in videos that I was impressed with that made me look further into the art and the artist themselves. If I was an artist, I'd make my fan art available for anyone to reuse, no credit needed.

TBH, as long as I was credited, I'd be happy for any of my fanart to used in a video. If I wasn't credited, I'd let them know and ask them not to forget to credit the artist. It's only if they pass it off as their own deliberately that I'd have a problem.

i think it's a bit different if you creating art is your livelihood/paycheck. Someone one KZbin, like MatPat for example (Who has a vastly larger reach for those who view his content) compared to the artist in most cases. He's making money off of someone's else hard work. To go a little deeper, a drawing or painting doesn't take just a few seconds or minutes to complete (saying this as an artist myself) sometimes it can take a whole day, sometimes longer depending on what you are trying to do.

It's on fortunate that so many people like to do whatever they can to make someone else feel miserable in this world. It's the very vocal minority that go out to do this sort of thing that ruined everything for everyone. They don't understand just the type of consequences their actions have at the end of the day. I'm all for giving credit obviously, but if there's no way to actually know who was creating the fan art then it's hard to properly give credit when you get right down to it. Your attitude is great. You k ow how easy it can be to make an honest mistake, and you would be appreciative of your art being highlighted. But still, you deserve credit, even if just a mention in the description, comments, a signature on the image, or line of text in the video stating the artist. Luckily there are good people like MatPat who will go back and acknowledge this, and who actually make it possible for you to reach them and notify them in some way (in this case, the subreddit).

@@ErikPT It really depends if it becomes fair use and is transformative. We're running into the issue here of where we draw the line on what is and isn't original creation. Like, West Side Story is based on Romeo and Juliet, but it's very much its own thing. Plenty of musicians make things inspired by artists they liked, some more blatantly than others. There's a gradient, on one side is someone just straight up re-creating something someone else made and claiming it as their own, and the other has totally original creation. Some fan art I would honestly say has become its own thing. You can also be in a weird limbo space of sort of owning the works you made, but the original works are obviously still owned by their original creators. Look at Team Four Star making money by selling Dragonball Z inspired shirts like the Pickle-O shirt, and other stuff like that. You were talking about law, though. I went off on a tangent about what's right and all that kinda stuff, sorry. I have trouble understanding the law side of it, but I think you're pretty much right? Again, depends how transformative it is.

A.13 essentially removes the 'safe harbour' defence; at present, a site like Google or KZbin that just hosts content can't be sued by the owner if that content is copyright material, only those who disseminated (etc.) it there can. A.13 takes that away, and means hosts can now be sued. KZbin does not want to be sued, so it, as a massive and famous fan of overcompensating, will get real draconian on taking things down for fear they'll get sued if they don't. For that reason, it doesn't necessarily matter whether your use of something is technically, legally acceptable; if it practically makes KZbin nervous, it's toast regardless.
