CJI - Retiring on 10th November How will I be remembered? He asks .. CJI Chandrachud wanted an answer .. Was he seeking the answer from the public?or was it just a soliloquy? Anyway, the premise on which the answer has to be derived is in-fact hidden in his own explicit and implicit actions and demeanours during his tenure as CJI 1-First of all, Justice Chandrachud violated his oath of office when he said that he prayed to god seeking his guidance while confronting with confusions to decide on the Ayodhya case intending to resolve it 2-As the oath of office he took was by pledging absolute allegiance to the constitution ,telling that he sought the guidance of god to decide the Ayodhya case was an utter breach of the oath he took and office he held 3-As this breach of oath can be challenged in the court of law,would the CJI have listed the same in his own bench had it been challenged in The SC ,would he have heard it by himself and made a judgement against his breach or exonerated himself as happened the case of former CJI Gogoi? Of course it is hypothetical 4- Provision and Execution of Justice seem to remain for the powerful few , and have been slipping away from the reach of the common people at all levels ,even for political parties, if they are with the opposition 5- He changed SC flag and the physical appearance and attire of the goddesses of justice removing its blind fold from its eyes,replacing the sword in her left hand with the constitution - (is it the constitution or the manu smriti? )Not known ,as nothing is written on it,here we are also confused ? or is it that the CJI wants to keep us guessing ? Anyway ,not in this case as this was done without any discussion having done with anyone ,though he always keeps talking about preserving and protecting the democratic values! Therefore, to answer his question ,we have to look into the number and nature of cases that came up before the SC during his tenure,the cases decided, the cases not decided, the cases deferred or refused to be heard etc.on reviewing them it can be clearly seen that justice can’t be delivered by any judge with a confused or indecisive mind with no conviction to the constitution or the oath of office to deliver justice impartially ,indiscriminately and decisively in accordance with the constitutional laws and principles During his tenure as CJI, it was seen that justice was denied or delayed,diluted ,discriminated,dismissed or discarded without any reason or respect to the constitutional rights of the people. The SC under his tenure often ignored the most important cases related to fundamental rights,electoral violations EVM tampering,Against EC ,ED,CBI,ECOC,SEBI, UAPA,NRC,CAA,federal law violations,financial irregularities etc etc,applications for bail or RTI ,misleading defamation cases ,misuse of power by constitutional institutions ,corruption ,economic offences ,diminishing political,social and religious equality ,rights and freedom of speech and expression etc etc Coming to the answer to Justice Chandrachud's question seeking to know how and what for he will be remembered? It's quite clear and simple for any common man to answer .... He will be remembered for the wrong judgements he was a part of,for the ppolitically doctored judgements ,for the judgments he avoided or refused to make,for the appeals he refused to accept or rejected , for the revelations of Gods direction in his judgments,for the Ganapathi Pooja he conducted at his home with the PM,for his acute public and media attention savviness , for his ability to articulate his projected image , for his profound interest and intent to protect ,promote ,preserve and his irresistible interest to continue in service of the people in a much higher position with the guidance of his God he trusts Yes ,he will also be remembered for lot of things like this and may be many more to come before his date of retirement Anyway he will be remembered,but with least respect or ranking as a good justice of courage and integrity who protected the values of the constitutional principles and its supremacy in safeguarding the rights of the people and our democratic republic Lastly,one doubt if justice Chandrachud doesn't mind to answer Had the CJI been a Muslim and was a part of the Ayodhya,Babri masjid judgment and if he too had sought the advice from his God while deciding on the case,what would have been the judgement? And if it were just opposite to what Chandrachud's bench decided ,what would have been the political and social response to it ? Particularly from the parties of the present regime? My answer to CJI's question has became little longer ,lest some points be found ignored and will be subjected to criticism by his multitude of fans ,the powerful lots and by influential legal luminaries for deliberately excluding his excellent judicial exploits that also should have been included in the list for which he will be remembered Now we are Looking forward to seeing him as our VP and then as the president. Anything else or less will be an insult to the one and only highest position he held ,or insufficient compensation for the judicial services done to the government and democratic services done to the people and the nation on the guidelines of his God Disclaimer This is just a joiner to many ongoing you tube discussion videos on the topic and not intended to defame or discredit or criticise the judiciary,any judges or any judgements
