In sec 81 example he is sure he will kill 1 person but in ipc bare act it is written that act is likely to cause harm and in illustration also incur risk of running down a boat C which he may possibly clear. Means he is not so sure like in train example that he will kill someone . Please clarify my confusion. Your videos are really helpful ☺️ .

Hi I have a question, section 83 here has a case law ulla Mahapatra vs the king, the boy was below 12 years and he shouted saying I’ll cut you into pieces and did so, and was convicted und 302 and you said he was given life imprisonment, but the juvenile who was a part of the Delhi gang rape case 2012, he was prosecuted and set free. Though the juvenile had committed a heinous crime still he was not sentenced for life imprisonment, but that 12 year old boy did, though murder is a heinous crime but why was this juvenile boy was set free? ( this occurred to me while I was watching your this video so asked, please help )

That is an interesting question. But i dont think peer pressure will be considered 'against his will' . Because peer pressure is just social pressure and if the law started giving defences on acts done because of social pressure even honor killings would be justified and untouchability would also be justified. (Because society can pressurize one to commit wrong things too) So according to me, no he can't take that defence because social pressure would not constitute being 'against the will' legally.

If the conditions of legal insanity are fulfilled the medical insanity will be called legal insanity. The conditions are mentioned in the M’Naghten case (as explained in video)
