I was blessed to have a judge who was compassionate. He asked me the trick questions, I answered honestly, and I think he knew I was telling the truth. He asked me questions about my disability, what I could do, what I couldn't. I was open, honest, didn't elaborate on anything just directly answered the questions. He asked the doctor who was at the hearing what jobs I could do and he said factory work, how many of those jobs in the country (8000). I was still working part time and the judge asked him how I could do what I was doing and the doctor said "I don't know". A few weeks later I got my letter of the judge's decision, saying I was approved.

I now have a ICD, uncontrolled with medication HBP, and now a benign brain tumor, I don't qualify but my cousin who is 43, never worked more than 3 months in a row, got disability on the first try for alcoholism....this is absolutely true and shows that those who need it and worked their entire lives can't get it but if your a drug addict, or alcoholic its easy peasy.

@@blakestollman8080 what? It's a simple reaction to have if tons of people claim they have some mental illness that can't be proven (records, doctor visits, etc) of course the judge would include this. It's nice to think they only look at a person's particular case each time, but the fact is if you see tons of people (clearly wanting free money) reapplying constantly with vague/broad illnesses like depression, of course, you're going to be suspicious of every person which is a good thing.

@@mrcoreynitro Most people don't know about it... Also, it makes people ashamed when they think about getting disability unless you grew up around people that were constantly on it. That's why you'll see families where half of them are on disability, like my friend from High school (2 more accounts of this in my personal life). It's all about what's normal in your upbringing/family, you haven't realized how many people are severely injured? There are tons of people who have excruciating pain from some physical ailment. You can't tell me a large portion of disability recipients have zero illnesses and there's a large portion that has a mild form of pain but they could clearly work fine if they wanted. It sucks for people like me who have to spend months just to get approved, I have multiple proved illness like epilepsy, hearing loss, two broken discs on my back, and even more. Mr. Ginsberg - I want to personally thank you for your commitment in taking the time to create the many U Tube presentations you have. Prior to my hearing I spent many hours listening to them and your advise. It was extremely helpful for me personally when appearing before the Judge with my attorney (who is excellent however would not have the time to go into the intricacies you do on the videos). I am happy to say I recently received the Judge's decision of "Totally Disabled" and I sincerely believe what contributed to it was the investment I made in exploring your many U Tube presentations (this in addition to an incredible attorney). For those going through the process now, I encourage taking the time to review these and your medical records, take notes and follow advise - the court is the only time you have to present to a Judge the real reality of your disability and having followed all advise (including letter from MD and co-worker nursing friend) I believe contributed to myself being a credible witness and with all the requisite documentation. My thanks again.

I only wish i would have came across his vidoes much sooner, but better late than never because I've actually thanks to Mr. Ginsberg I've hired a real law firm that actually cares about they're clients and they actually answer the phone and answer any questions that you have and that's a professional attorney because the old one i had before i don't even know how he stays in practice that's the truth. His videos are a major blessing and have helped in so many ways and i watch them every chance that i get. I couldn't thank him enough.

Picking 1-1/4” screws out of my left pouch and driving them with a screw gun all day with my right hand. I’ve had surgery for both hands 10 years ago and also my left knee for a torn and flipped meniscus 9 years ago. I had to leave the union basically because of the damage that I was doing to myself and took a nice job at a local Marina in town where the Boss actually dropped a 24’ by 6’ pressure treated dock on me from a forklift when is was under it almost killing me. I fractured my right ankle, broke three ribs, tore up my left rotator cuff, and folded my two front teeth right over 90 degrees and lost them. That happened in 2013. Now every joint in my body has gotten progressively worse and doesn’t let up. I’m getting up every morning and going to work, still construction but light and I’m not sure I can continue much longer. My mind says “You got this” but my body is saying the opposite. Kinda at a crossroad and could use any advice on any future decisions related to this subject. Thanks.

How about these: "Do you drink/smoke?" - I have not consumed an alcoholic beverage in roughly three years. I don't smoke cigarettes or use other tobacco products, but I occasionally vape legal CBD to help with my chronic pain and sleep problems; that I do for about 15 minutes once or twice per week. "Do you drive?" -no. I don't even have a driver's license; I worry about having an anxiety attack while driving, and when I do go out, I rely on public transportation and paratransit. "Do you do any cooking?" -Yes; I rely a lot on convenience food that doesn't require much effort, like cereal, instant oatmeal, canned soups, sandwiches (simple ones like PB & J or Tofurky) and frozen fries and entrees. Otherwise, I rely heavily on delivery or takeout food to eat. My chronic pain makes it difficult to be on my feet unassisted for more than 5 minutes at a time, so if I do cook something in the oven, I have to sit or lie down and have a timer on. Mobility aids- I use a cane and a walker (cane is not prescribed; walker was prescribed after I broke my leg at the end of January) because of chronic pain and balance issues. I can usually be okay without them at home, but need one or the other when I'm out of the house.

I was disabled as a child but worked fast food and did basic jobs in the army (failed at one of these). Now I can't do that because my mind is slow. Last time I tried to volunteer, I had panic attacks, but my social worker is going to have us try again. I'm trying and keep drowning. Yay, I get money for being worthless!

Yes i did that back in the day and walked to the bus stop and i wouldn't let my children when they were smaller do that because times have changed so much and it's not safe at all. I remember always being scared sometimes because it would still be dark outside walking to the bus stop and there was a patch of woods and that area i would run past because you couldn't see what or if someone was in there. The cool part was the bus stop was in front of my grandparent's house and i remember one time them picking up a man for hanging around that area not cool.

This happened to me, I told my counselor that I cooked all the time, then the judge asked...do you cook at home and I said no....she said, well you told your counselor that you do most of the cooking at home, I was like, well I have cooked but I don't do it all the time...I felt stupid because I was being truthful but fell into a trap to where I felt it was a strategy they used to catch me in a lie, I have good solid evidence of my disability but felt like I was tricked because the questions were random and fast..plus my attorney at myler disability talked to me for only 10 minutes on the day of my hearing, didn't say good morning, shake my hand or anything....didn't even contest anything that was said....I was very dissapointed at myself and my lawyer...hopefully i get approved.

This really helps..I 0have a hearing at the Appeals Council this Friday. It's by phone thank goodness. My SSA.attormey won my.appeal in 2018 partial favor but also partial un favor because I tried to work 6 to 8 hrs a week for 16 months. I am still getting my benefits but my attorney didn't prepare me first time. Your videos did. I got MS and Bipolar. And been letting SSA know what upcoming treatments and my adult son is my in home caregiver paid thru the county. I believe I got good medical documentation so I am a nervous wreak. This stress is making my MS flare up bad plus the depression and fatigue. This ALJ didn't agree with 1st judge. But I have a diagnosis of progressive relapsing MS since 1st appeal. I should qualify under the SSA handbook. Thanks a lot for your videos. Oh yeah my attorney bailed on me and sent back all the money I paid him so I am representing myself.

All the doctor did was have me walk touch my toes and squeeze his hands and pull them and that alone was what told the judge I don’t have a problem. I recently reapplied (April 2023) I have depression migraines and anxiety and I take meds and have since 3 years. I take a self employed job because I can work when I can to survive… it provides me opportunity to not loose a job. Panic attacks put me down for 4 days afterwards!!❤

Some of the questions are hard to answer honestly because the answer changes with context of the situation at the moment. Example if my feet aren't bumped and my body is not touched. I can walk 6 blocks. If I am touched unexpectedly or I trip or fall while walking for any reason my successful walking range is reduced 95%. I can walk unassisted if I haven't been touched without warning or my feet have not been bumped. If I've had a spasm I must use a wheelchair. Part of my problem is I have autism so processing the questions I'm asked have their own challenges. I usually eat prepared foods. If I must prepare food at home I eat one of three meals I can prepare without getting too sick or hurt yo eat.

I had a very good reason for making the change. Is it legal or reasonable to be charged this fee for THE REST OF MY LIFE? Where and how else does a person receive a LIFETIME PENALTY? I understand that SSI doesn't want people making policy changes, and I can understand paying that fee for the year I made the change. After 10 years of paying this fee, it's about $400! I know it doesn't seem like allot to the average working person, but trying to live on SSI is very difficult as it is, I have to account for every cent . I'm also now wondering if I'm able to make a policy change anytime I wish , if I'm being charged for the rest of my LIFE ?

Old video, but I’ll respond … In your examples of questions about how a disabled person handles parenting - getting up to get the kids dressed, fed & out to the bus, showing up for school events, helping with homework & school related projects - my parents did none of that. When my brother & I were 6 &7 yr old 1st & 2nd graders, my dad barked _”get up”_ on his way down the hall & out the door while my mother stayed in the bed until we’d left for a mile & a half walk to school. Her habit was to sleep till 10am or later, wander into her job by around noon & stay till 8 or 9 in the evening. My dad always got home a couple of hours after we did, then spent his evening behind a newspaper. That went on for each of the next not-quite 10 yrs before I bugged out at age 15. I’m 62. This wasn’t common for my generation, or for the sons of middle class engineers & librarians. My neighborhood was full of stay-at-home moms & professional fathers who more or less liked their kids. As one who just might lose C-PTSD related benefits in the developing 2024 purge, I might suggest that we cut struggling parents who suck it up & make the effort a little slack. Mine _weren’t_ disabled & they never did, so call me a cautionary tale.

I was born premature so I was born disabled. When a human has experienced a disability and then cures they would still need trauma treatment. And it's a civil violation to have lead a civilian on in the scene where they think it's ok to settle in order to be a part of a community and are still in dangers because the suffered already. The system promised them that the ground they live on is a safe haven and they still suffered harm. To be immune to a disease or more than one disease is disability on both parties so the situation should be handled with patience and compassion especially if it is God who created or is planning to create us as human beans and his or her love for us is going to be unconditional. To live a miracle can happen to any of us and it's not right to hate, we should just try our best to be happy for one another and wait our turn.

You would need extensive records from a treating psychologist and psychiatrist that your condition prevents you from working. SSD judges see a lot of mental health cases - depression, anxiety, schizoaffective disorders - that often create severe symptoms that impact not only work but activities of daily living. In my experience they don't put ADHD into that category. If you were approved you could work but only at below substantial gainful activity limits.

Don't know what the heck I'm going to do. My cognitive issues keep me from coming up with specific examples and my severe PTSD caused by being doubted and forced to hide it makes it even worse. I downplay horribly and don't even realize I'm doing it.

i have autism and BPD, my hearing is in five days. i’m beyond terrified of what is going to be asked and if im going to know how to answer it in a way that wont “hurt my case” its so hard to understand especially with autism why im not allowed to talk about certain things that i struggle with or elaborate on. i really hope the people in my hearing can at least understand that i know i cant work and this is my only option for any sort of income
@ssdattorney Жыл бұрын
I would think about how your conditions negatively impact your reliability and dependability at work. That is the main issue in an SSD case. Try to be very specific. For example if your autism makes it difficult to pick up on social cues then you would likely not be effective in a customer service job. If your bi-polar results episodes of severe depression that prevent you from getting out of bed 3 or 4 days per month, your reliability at even a simple job would be a problem.

@@DawnSuCallahan my lawyer said that he thinks it went amazingly, i only was present two hypothetical scenarios with jobs and immediately it went down to zero jobs. he also told me that the judge believes me and in what i was saying which was the best outcome in my opinion but i still have to wait on a decision. i will update you when i receive that lolol

I wouldn't say "avoid absolutes", but maybe word the truth carefully and precisely rather than trying to push the spirit of the truth too hard. "I drink only a few times a year, particularly on special occasions," > is a statement of absolute. "I have ____ before, but I cannot recall the last time it occurred, at least more than a few years ago." > also a statement of absolute, it's stating the absolute truth that you are uncertain of ____, but it's clear to be very infrequent.

I have bipolar. I havent been on benefits or under care of medication or a doctor since I was 17 and my grandmother collected benefits for me even when I was not in her care from 17 to 18. My bipolar has kept me from people and doctors out of fear. Will I actually be able to get help and benefits now being 29? I just called an attorney and waiting for a call back to see if they would take me. Whats my probability?

From what I have heard it's much easier with proof of therapy and medication. Please contact your local community health department and ask where u can get help. It helps alot to be on medication and the therapy helps as well.

I'm in major need or just any help or advice. I have court the 22nd. I had a lawyer for 2 yrs talking to him only once on the phone. When I verbalized my concerns he withdrew from my case 5 days prior to my first hearing and that ended with me asking for a continuance. I could not retain a lawyer in that amount of time. I have got an amazing mother who has gathered all my records for the last 6yrs. I go before the judge in just a few days with a new diagnosis of a TBI I can barely remember to return a call let alone all these questions. I am petrified

Citizens Disability? Yeah they suck they didn't even collect medical records for a period of 2years time. Judge gave me 30 days extra and I collected them and turn them into the judge myself. Still waiting on a decision.

I see a few things there are thorny issues, and would require further explanation on the persons' part, like yes but only limited, then how much time do you have so I can explain... Or like myself, Q. Can you drive a semi truck? A. Yes, I have the ability to drive one, but not the ability to get up in one, without major effort, and as far as hooking up a trailer or cranking up the dollies, it would be impossible without just as much effort, and then I'd have to take a break every 15 or minutes to a half hour...
