Out of a hundreds post office videos I've seen there's one thing in common which is the cockiness and self entitlement of the P.O employees, it never fails...

Well, thank you to the chief of police for educating her self, and her ignorant lieutenant, who was using, of course, intimidation tactic and thank you to the auditor for asking the right questions and educating everyone involved and that question about having jurisdiction on federal property. Great job keep up the good work.

The agreement is called an MOU. It allows local law enforcement to enforce FEDERAL LAW on federal government property.

It never ceases to amaze me how postal workers will insist, with maximum confidence, that you cannot film inside the post office. Obviously they have no idea whether that is true or not but they really believe it is. Makes you wonder why they wouldn't first go read poster 7 and see for themselves or call the post master and ask if photography is allowed. I guess their goal for the day was to make a complete fool of themselves on KZbin. Mission Accomplished. Well done!!

They ran like there was an announcement of bubonic plague once the chief talked to the lieutenant outside and he mentioned lawsuit. FOIA the body cam footage of the lieutenant.

Do a FOIA request to find out if they have a Memorandum of Agreement between the Post Office and PD. (Ya know, you could do a Google Maps look up and see what the post office looks like. If its an old one, one that looks like it was built before 1940, that's a building owned by the federal gov't. AND unlikely they have the MOA between post office and PD. Then, before you drive there, do a FOIA request and confirm there's no MOA. (Bring the reply) and when the PD tries to run you out, put it in their face that they have no jurisdiction and can't bring firearms. In the military officers are LT, Captain, Major and the like. They are not SGT or privates. Patrolmen are the lowest rung at the PD. My point is they are not Officers. If the rest of the department behaves under military like order, then its a contradiction to call the patrolmen, officers. So, as far as I am concerned, they are Mr. Not Officer. Always interesting now, one camera equals 4+ armed Mr or Ms. But that's good. Because the more that show up, the less are out their extorting money as Road Pirates from citizens. So, the more that show up, the safer the citizens are. Let's not forget that.

If I understand you correctly - one must have a contractual agreement to have jurisdictional leo authority. Without it, only fps can have said jurisdiction. Do I understand this correctly?

@@davidgiles4681 This is what Poster 7 says. Down at the bottom there's a section about Penalties one property. Violations of the rules or regulations are to be heard in front of a district court or federal magistrate. (Not a city or county judge/court) The property, the building that were built before 1940 retains exclusive law enforcement to the Post Inspectors, not local PD. Local PD, according to the CFR are not permitted to bring guns on federal property. p) Penalties and other law. (1) Alleged violations of these rules and regulations are heard, and the penalties prescribed herein are imposed, either in a federal district court or by a federal magistrate in accordance with applicable court rules. Questions regarding such rules should be directed to the regional counsel for the region involved. And there's an enforcement section. (q) Enforcement: (1) Members of the U.S. Postal Service security force shall exercise the powers provided by 18 U.S.C. 3061(c)(2) and shall be responsible for enforcing the regulations in this section in a manner that will protect Postal Service property and persons thereon. (2) Local postmasters and installation heads may, pursuant to 40 U.S.C. 1315(d)(3) and with the approval of the chief postal inspector or his designee, enter into agreements with State and local enforcement agencies to ensure that these rules and regulations are enforced in a manner that will protect Postal Service property. (3) Postal Inspectors, Office of Inspector General Criminal Investigators, and other persons designated by the Chief Postal Inspector may likewise enforce regulations in this section. Watch some of the post office audits. You can tell most employees have been there years. Yet, the never even know Poster 7 exists. How is that possible? Especially supervisors? Heck, even fewer know they should have a law enforcement agreement with the local PD.

@obijuan- I know fed cops exist. I know uspo is a federal building. I have not read it as you have and thank you. Remember that you are talking about 65 iq persons with scotus qi. I doubt that they can read past- dick and Jane -. Sc - 12 weeks to become a cop. 108 weeks to become a paralegal. I had a graduation class of 200. The math means that 1800 cops were graduated at the same time 200 paralegals graduated. Who has qi? Not the paralegal. That is a 9 to 1 ratio. It even increases with doctors v cops. You and I actually can read the totality of the law. Cops only read enough to arrest. Magistrate judges in sc do not need to have any legal degree at all. You read that correctly. No legal degree at all to be the lowest form of judge in sc. You can beta street sweeper, get chosen, attend training, and be a Magistrate judge in sc.

They say that if being mugged or raped that yelling ‘Police’ is useless, but yelling ‘Fire’ gets everyone looking. But it genuinely seems that if you just pull out a camera, you will get rapid multiple police response! I think a camera is more effective than a rape whistle for gaining the attention of law enforcement.

The United States Postal Service (USPS) is a federal agency and its properties, including post offices, are considered federal property. As such, local police departments do not automatically have jurisdiction on USPS property in their town or city. However, they can exercise police powers on USPS property if they have a signed agreement with the USPS or if they are responding to an emergency on the property

I think there's a lot of wriggle room on the emergency part. I would not want to bet my freedom by finding the same interpretation of emergency as an unsympathetic judge. (I haven't checked if there's definition of emergency or if the definition is pretty open ended.

@@MrDandaman137 Oh yeah, I'm with you. It won't be that it is an emergency call. But maybe local postmaster says gtfo. And asks the cops to assist because it's urgent. I wouldn't want to bet by freedom that there's some jurisdictional quirk related to the age of the tenancy of the post office in the building. I'm just spitballing here, not analysis.

Where do these people come up with the idea that there is no freedom in a post office??? Why are these postal employee's not being trained about photography? How many times do free people have to goto post offices to teach these people about freedom when their superiors will not train them NATIONWIDE???? Four officers for a camera??? The chief was great in honoring the oath. The Lt. has an attitude towards freedom.

IN THIS DAY AND TIME, no one shouldn't know when and where people can record. All law enforcement should also know where they have authority and a general knowledge of property as to public and private and what is allowed.

Plus you'd probably be surprised to find out that there's usually four or five postmasters assigned to each post office that they never visit like those good old no show union jobs.

@@baazinga13 That’s not correct. Are you familiar with the DHS memo? What about the first amendment, freedom of press? Long Island Audit was arrested for the same conduct in a USPS by local cops and easily beat his charges based on “subject matter jurisdiction”. The local cops who kidnapped him had no authority on the premises of a federal enclave. Asking a journalist to leave public property for no other reason than merely exercising their civil rights is discrimination and therefore, illegal. Also, a postal clerk, branch manager or other on-site staff member does not hold greater authority than the PM General, nor can they override federal statutes that govern conduct on USPS property. Areas that are open and accessible to the public remain such whether the patron holds a camera or not. Photography is not a crime.

Postal management should always call the Inspection Service first for guidance before calling the police. I received an ass chewing that I’ll never forget from a Postal Inspector because I called the police before him.

Given the age of the post office, I would wager that the police don’t have an Affidavit of Concurrent Jurisdiction on file for this post office. Thus they may very well be violating federal law with their weapons.

Finally, I see in this auditor someone sticks around after the police leave and confront the postal worker who tried to through him out. Most auditors leave along with the police and don't make their point.

still comes down to improper police training. if dispatch tells them to go investigate a person jogging at the public park and someone doesn't like to see that, they shoul say "no, there's nothing illegal about that". The same goes for public fotography.

I believe that right after this arrest their should be a quick trial about losing their qualified immunity then the lawsuit trial begins ! No waiting around for years and once judgment is passed and the plaintiff wins go straight to officers house and clean it out ! Take boats, cars, motorcycles, houses and retirements !

I find it strange that police will come at the beck and call for office workers. Then try to enforce the offices policies or feelings of the workers. And not charge the office/workers for wasting taxpayer funded emergency services? I don’t have a big fancy office but…. When my kids won’t eat their vegetables, leave lights on, or don’t go to bed on time - those are all rules/policies in my house. So can I call the police to come enforce those policies for me? If I leave the seat up, can my wife call the cops to come arrest me? Cuz that’s a really strict policy she has. *Oddly enough, despite it being a genuine ‘call for service’, I’m betting we’d be charged with misuse of emergency services? Wonder why business staff can get away with it, yet a concerned taxpaying citizen homeowner doesn’t get the same rights afford them?

I am dismayed that American citizens don't know the law, that they have the absolutely ridiculous idea that a policy supersedes the law, that a cop thinks there is such a thing as official press credentials and worse, that many Americans are willing to take not only other people's rights but to give their own up so easily. They are so ignorant and sad.

They always lead off by I'll call the police, but it's the postal police that I have jurisdiction in post offices. They would have to get in contact with the Postmaster General, to understand rules and regulations regarding filming in post office areas. They never do! Instead they call local law enforcement, which in retrospect is supposed to refer them to the postal inspectors. They never do!

Looks like this Postmaster has only been in his position for 30 days so he has an excuse of not knowing all the regulations. In a few years he will have learned many lessons the hard way. Hopefully his POOM will see this video and give him the guidance needed.

7:57 - NO! I think you should have pushed back more! I would have said, "And I'm requesting you honor your oath, and protect and defend my rights dictated in the 1st Amendment of the Constitution!" And then I would have asked, in a demanding and authoritative manner, "Did you swear an oath to protect and defend the US Constitution?"

One thing "I" have a problem with is hearing what everyone else other then the auditor is saying. I understand that without walking up to them and asking them to speak into the microphone that you place in front of their face that it will always be a problem. I just wish there was some magic wand that we could wave that would fix that problem. when I watch these, I am continually rewinding, turning up the volume, then turning it down to continue watching,. Struggling to hear what the others are all saying, then realizing that I have to rewind & crank the volume up again. It's just a "me" problem. I get that. But C'mon, I can't be the only one who wishes that that particular magic wand existed! lol

What year was the building erected? 1941 and before federal police have exclusive jurisdiction on the property, local police does not have jurisdiction inside of it. After 1941 local law enforcement needs a cooperation agreement to have enforcement capabilities. When you go in a USPS you should look for the building erection plaque which shows the date the building was erected.

That building looked pretty old. Pretty sure that local police can never have jurisdiction agreement on any post office built before 1940. LIA was arrested on post office in such a situation. Charges were dismissed, he sued, PD and city got money. Check it out.

Ask them if their department has a Memorandum of Agreement with the Post Office. If not this post office has "Exclusive Jurisdiction"they can't bring firearms in the Post Office The lieutenant claimed his department has the memorandum with the postal service. He could not possibly know whether they do or not as this is the first time he has ever heard of this but to save face he probably lied.

Of course they lie, that’s their law or non law, I support good police, I don’t agree with qualified immunity. But we need police reform.

you would be wrong 18 US Code 930 subsection D (d) Subsection (a) shall not apply to- (1) the lawful performance of official duties by an officer, agent, or employee of the United States, a State, or a political subdivision thereof, who is authorized by law to engage in or supervise the prevention, detection, investigation, or prosecution of any violation of law; (2) the possession of a firearm or other dangerous weapon by a Federal official or a member of the Armed Forces if such possession is authorized by law; or (3) the lawful carrying of firearms or other dangerous weapons in a Federal facility incident to hunting or other lawful purposes. law enforcement have an exemption while on duty

Why don't all these nuts in charge of cities & agencies call their city attorneys for advice, a 1 minute phone call would be all it takes, they're well paid, let them earn the money.

I see that’s how that lieutenant conducts his investigations - with a narrative already in mind before establishing the truth of the matter. Horrible policing. Get the facts, figure out the law and THEN decide on your actions.
