Mam I didn't get your point regarding the proviso... what is the difference between the proviso and section 16(e) ??

With due respect, the example you've given about the specific performance of contract regarding the proviso of section 16 is wrong. On point that, you said decree for specific performance of contact can't be executed by attachment, arrest, or sale of the property. Hereby, you're requested to go thorough the Rule 32 (1) of the Order XXI. Here specifically been mentioned that specific performance of contract is executable through attachment /sale of the property or by arrest of the person. So, suits regarding specific performance of contract falls within the proviso of section 16. Thank you.
