Our Story:
We are six years into a seven year effort of transforming 20 acres of "Piney Grove" in Northwest Florida into our dream homestead/mini farm to be filled with animals and joy. We plan to have a variety of miniature critters on our pastures, raise free-range chickens, grow fish in our pond, garden organically, plant fruit and nut trees, and harvest wild game. Our goal is to escape the stresses of corporate life and embrace all that country living has to offer as we enter the next chapter of our lives. Follow along on our journey!

I have purchased land in North Florida west of Gainesville and have similar issues with using my property for intended purposes .... My question is, couldn't you ask the county for a variance to build a second home on your 19+- acres... after everything you have done to get to where you are, I wouldn't see why they wouldn't consider it...

I have built over 40 homes in Northwest Florida and very much understand how the building departments can be. A solution to your situation would be to connect the two homes with a open walkway on the plans. that would make the two houses one dwelling. after the house is built and inspected, and you have your certificate occupancy, you can take down that walkway and have two homes.

You could also connect the detached garage and dream home with a covered walkway and, as long as it’s still over 3200 square feet, that should take care of the issue as well.

@NoxiousWZRD my question would be regarding selling or renting. It doesn't seem suspicious that buying 19 acres and the dream house is two actual houses. 1 house with 30 bathrooms and 15 bedrooms and 6 kitchens is still 1 house. Removing a walkway, creating two separate designs, on the drawings of property will fail future inspection sales. Getting around the law is the same as breaking the law.. but you all are right. Why do I care? I'll let people keep making it worse. Until. I can't take it any more

Another option that occurred to me is will your neighbor sell you .5 acre or whatever you need to be a full 20? Just a thought.

Same, this was my first thought. As small town, they may be willing to let go .5 acres. Especially, the neighbor with 1,600 acres. But their work around sounds good too.

I thought,slept the property in two, and sell it to your inlaws, have your wife be the beneficiary in their will. 🤷🏻‍♀️ Now you have two ten acres and can build everything you need. 😂 Use one of the ten acres for a campground. You can't have enough campgrounds in FL

Same EXACT thing happened to my wife and I in Columbia County, FL. They finally figured out a work around, but had to break some rules to get it done for us. Thank God we live in a rural County that had good people that made exceptions for us.

You own no property, slaves can't own property. Read the Deed to the property that you think is yours. You are listed as a Tenant. (Senate Document 43, 73rd Congress 1st Session)

The state owns everything besides the government. I see why these people don't want us to pay off anything. So these same people can have someone come out take it's, have the IRS/ uncle Sam at our throat. The only thing we own is ourself. Like saying my saying, " we're all born with nothing, and we die with nothing." Because the government will try to take or take it.

I was going to say the same thing. Not sure the rules there, but there may be a process to request a zoning variance. It's pretty common in most places with zoning regulations.

@@PineyGroveHomestead Men and women are different. If you go to a woman planner, she will fully comply with the rules. A man will try to think creatively think of how to solve the problem. Sorry gals, but while there may be exceptions, this is generally true. I have the same issue in a rural Arizona county. None of the neighbors would have an issue with it, but the county can’t possibly think for a second that they are there to SERVE the public.

I just learned the hard way too here in NC. Wanted to put a modular on a small corner of my 90 acres. There had been singlewides and 2 abandoned wells and septics but all removed in the 1980’s… so I went to get permits and was told no, only one dwelling. On 90 acres…. So had to subdivide and deed to myself to get it done… added 8 months to the simple process of bring family onto my land… i totally get ya, praying for you both.

Have you ever heard of Grandfather Clause. This sounds like a perfect example of the clause, you gave the county a site plan with everything on it, they made the option of removing the main house with the option of adding it back when you were ready to build, then codes changed. If you can prove the original terms in that meeting, sounds like you might have option to do the original plan.

@@Jack-jp6ki Nope. The rules changed before they built. It happens all the time. What is no problem today is an issue next week. In my county all new home construction now needs to have very expensive systems to control water runoff. Not the case 20 years agon when I built.

Ridiculous... we bought 6 acres from my wifes parents in rural Mississippi, out of their 18 total. Didn't have a single issue building a new house. Our county didn't require anything other than a 50 dollar building permit. It amazes me how insane some of these local governments are. You work your tail off to build a life on your own property, and the government says you can't. Unreal...

@PineyGroveHomestead extend the house which you built for your parents; either sharing the walls somehow, or place your house right next to it with a beautiful room connecting them into one house.. and then it becomes one house - one enormous house.. with a large room between - could make it a nice shared space full of plants that might shut planning up lol

Right. I found a house plan I really liked one time. It was connected to a tiny home via a screened in porch. Maybe a sun room between the two or a huge family/party room. Or what about a commercial style kitchen for canning, etc.

Use a large breezeway or enclosed breezeway between the two homes and make it attached. Make it a long one. Then years later demo the breezeway.

Please make sure to get from the county in writing that you can build the two car garages attached to the house and be counted as square feet of a home structure. Also get in writing that your parents home will be changed to a secondary structure or whatever needs to be. Have everything you need as far as proper paperwork ready before you build your home. I would make sure my parents home is changed before starting your own, and also that the county is not going to kick them out because they will be living in a secondary structure which usually means it is a structure for hay, farm equipment, animal's shelter and so on and so forth. Here in Florida St Lucie County, AG 5 zoning 10.23 acres. We can have 1 home per 5 acres. that's terrible. Government overreach is getting out of control. Don't take what the first person says. Go higher up. Answer seems to change we've been through a lot of things.

Here in Citrus county Florida I have seen so many variances rubber stamped. Get a knowledgeable attorney and apply for a variance. Were rules changed after you land purchase ? If so you should be grandfathered in.

Although I have no plans to fence in my property, I would like to fence in some areas as well as put up a fence to create a buffer at the road. I found out that to do this, I would have to pull a permit and then hire a professional fence contractor to put up my fence. I have decided that instead of fencing that I’m going to use plantings to give me that buffer at the road. It isn’t as though I live in the city limits either. I purposely bought a couple of acres in the country. Sometimes I wonder why we are allowed to purchase land because it certainly isn’t ours. A can of worms that we will never find our way out of.

This is my first visit to your channel. My son is in year 6 of the USAF and is currently cross training in Biloxi…so thank you for your service!! Ohhh and I’m in!! Subscribed to your channel!! ❤ Ohhhh, my sister in law built a home and a smaller mother-in-law house on the same property…they were only allowed it by having a large back driveway and then a “breezeway with sidewalk” attached to it in order to consider it part of the same “foot print.” That was their way of being able to have the separate structures but considered one footprint…

Where I live we have the same roles. We had a similar issue. Our county includes covered walkways between sections of the structures. We added a covered walkway to our garage and a covered walkway to a gazebo. Maybe that can work for you and not need to change the buildings.

I went through a very similar situation in building on some family land in Indiana. The area plan commission is a nightmare to work with. However, there is some good hope for you. I have two suggestions: 1. Go back and talk to someone else. My experience is the left hand doesn't know what the right is doing in that office and if you speak to three different people then you will get three different answers. 2. If #1 doesn't work, hire a good land attorney from that county. They can make things happen that you can't. It will likely involve a variance but it could be easier than that. I think you can stick with your original plan by doing these two things. I would be glad to talk to you about how we had to do things.

Thanks for the advice. It's a small county and there are 3 people in the office and we have communicated with all three. A variance or lawyer would likely cost more in money or time than adding a garage. We're working with the drafter and builder now to see how much this change will cost us. Thanks for watching!

Another added SqFt option would be to build an attached 3 car-garage with a small 'apartment' above it as to not take away from your original house plans for your children to visit. When we were looking for land a month ago, we knew the florida requirement of one dwelling per 10 acres, in AG2. In one spot we were looking was a divided to 5 acre plot from 10acres in AG2. Too small for us, BUT a variance was an option. You can APPLY for a variance on this-it is an occupancy variance. There is also a florida law that you can only have so many out buildings per acre-but I think that is going to be repealed. In the meantime, you need apply for a variance. You may be turned down, but it is worth a shot. Another option-add on to the existing house.

I build houses on rural country acreages and it's frustrating because there are so many things to trip you up and the county doesn't always go out of their way to help you, it feels like they're more trying to stop you. Really they are in CYA mode because they have to follow some very specific and arcane rules put in place. It's really the zoning rules that drive up property prices, it creates an artificially low supply of buildable country properties. I've had to go in front of the county commission before with members of the public, aka neighbors. The majority of the neighbors were happy that I was going to replace an old rotten shop building with a nice new 1000 sf home, except for one lady who owned land in the neighborhood, but didn't want a new house built, just because. I did good approval because the county was supportive, that really helped. Good luck, stay positive!

Where I live in Calhoun County, Florida folks who live on 10 acres put 2 or 3 mobile homes on them and Tiny shed houses. The same 10 acre rule. I don't know how they get by with it. Your property is beautiful. I pray y'all get everything worked out.

What is wrong with 2-3 mobile homes on 10 acres, plenty space for that, use to live in Blountstown many years ago when I was in grade school with my uncle Homer who has passed away now, wasn't much to the town back then in the late 70s

If zoned farm your parents can be a hired hands quarters. Your land measurements also always counts the portion you gave county for road frontage when divided. You need an experienced land development company.

Yup I see so many KZbin's do this by a piece of land and then they can't build what they want to build because they didn't bother to check city ordinances. It's the first thing you check before you even look at buying land. Always buy land where you can build with no restrictions

We almost bought a beautiful piece of land in FL but it was just shy of the 2.5 acres needed to build. Researched the variance that also cost around $2500 and there is no guarantee it would be approved. Then we found out the county miss measured and the plot was actually 3.5 acres 😮 .5 is the road. THEN once we were going to move forward we found out that the lenders require a private road agreement that is nonexistent!!! We have passed on the property, meanwhile 20 acres away they are mowing down every tree to put in multi family! It all seems like a huge racket! Best wishes on your future plans, I’ll be watching. 🍀

It's called an ADU ( accessory dwelling unit). Florida allows them no as long as the ADU is 50% smaller. Makes no difference which one is built 1st. I'm kinda surprised this was missed when looking at zoning. A quick look at property appraiser website would show how many units per acre.

I began asking our building dept if they can show me in the United States Constitution that they have the authority to tell me what I can and cannot do on my own property> Silence. You are the sovereign owner of that land so you need to tell them what your going to do. I built a large barn and a 2200sq ft house, the county attached a non compliance notice on my property but that is it. You do not need their permission. The constitution is there to protect we the people from an over reaching government.

I think I would build a 2300 sqft. addition to your parents' house linked together by a long enclosed heated and cooled hallway, then you would have your new home with your parents' wing. But considered one home with an add on.. be it large add on.

I am a retired City Planner for a rural Arizona city. I have advised people with similar issues as you. Just be aware that codes are different in every city and county. Both the building and planning codes come into play in my suggestion in my city. Our zoning does not define what an "attachment" is. The building code does. In other words...if you left your garage where you originally planned it and connected it to the main house with either a beam...or beams with one or more posts...that would be considered an attachment. In another jurisdiction in California, a footing from the main house connected to the garage was considered a connection as well. I just saw your video tonight on 6/29/24...so I do not know how far you are along in your design process. If you wish to go to an extreme....you can construct the same type of connection to you parent's home to your dream home and make it one building!!!!!!! GO FOR IT! Check with your Building Department first before you speak to your planning department. I have always been an out-of-the box planner in assisting others...and came up with the above solution and it works i my City. Blessings!

Wife and I bought 38 acres here in Texas. We had our house almost framed when one of the city councilmen came by and said we didn't have a permit. Told him I didn't give a crap about his permit. He came back a few days later and handed me the permit. LOL I have built a shop, pool, pool shed, and a she shed all without their glorious permission.

Thanks for sharing your story. It is discouraging that we live under a rule system that is on shifting sands. I have sold property and cancelled extensive long-term plans due to government zoning policies, only to find that later "they" changed the rules again and changed the property that was one house per acre, to become "commercial." Had I known, I would have kept it and been much wealthier. I have other properties which I assume I cannot use as I had originally intended. In Florida, "long-range planning" seems to be intended to take away all our property rights. In reality, the government is our "landlord." We only have a lease, and if the annually increasing rent is not paid, it WILL be taken away - improvements and all.

Per each state there can be land requirements regarding how much land goes per house. In your situation like many here have said do a breezeway or it was said you can build a big tool shed. Well big that big tool shed with living quarters in it. It can be as fancy on the inside as you want but keep the outside minimum.

@Piney Grove Homestead. Submit a variance in front of the County PLANNING BOARD, then it goes to COUNTY COMMISSION in Florida. There is a fee for a variance. Best thing you can do is speak to your neighbors ahead of time and see if they will either testify at the hearing that they have no issue OR get a written letter signed and notified and read into the record by someone. Also, research all the variances in your area and have a list of them to submit to the county at the hearing, What about a barndominium?

We’ve been dealing with something similar where we live. Planning and such. We live in “Westwego” LA and small unincorporated city. But it’s not “Westwego” out zip code covers 4 towns We had to “subdivide” 3 lots into one and hoping to get building percent to move the shell of the tiny home on a concrete pad and add 100sqft to it to make it compliant with the city codes. Ugh! We get your frustrations. Keep your heads up and persevere.

There is something similar in Oregon where if you have 5-acres but less than 20 it’s considered farm forest and you can’t get a residential permit. You can build an agricultural building but that’s it. You can try to get the land rezoned but 5k is the minimum starting cost and it was pretty obvious that you better hire a land use consultant and getting your request approved is less than 50-50

If you are putting dirt up there on the hill you should have been mixing dirt and gravel together so it will settle if you're going to put a house on it because you should mix gravel and dirt together so the house will never settle too much you should make put big gravel and little gravel and dirt together

About 20 years ago I bought 40 acres 10 miles from the closest city and put a mobile home on it so I would be on the land. I got NO permits on anything, built a two story house and then a hanger. Removed trees and carved out an airstrip. Built my 3rd airplane and started flying from the strip and had meetings there and friends flew in also, even one twin engine plane. A couple of months ago got the FAA to OK the strip and got it on sectional maps. Also drilled my own water well and installed a septic system, all with out any permits. I just went out and did it and no one said anything about it.

Cal the “guest house” an accessory dwelling unit, you will need to make a sidewalk from main house to the “ home office “ aka accessory dwelling unit. Then this should just make it part of the house .

Have you thought about doing a covered breezeway/patio between the house and garage so they are separate but attached. I think it would be considered one dwelling but may help the cost and size.

You might consider an expansion to make a very large storage wing. It can be built on a slab, and in a form that makes it non-integral to the main structure. That way if you don't like it, then you can remove it and only have to re-do the siding. The back door of the current design would go into a mud-room that connects to the expansion. In the storage room you could have a huge pantry, and even a walk-in freezer if you want.

My parents were looking to buy a 3.5 acre property in Florida this spring but found out through the county that the smallest plot that can be built on is 10 acres in that area. My parents ran and let the sellers know that their lake front land is worthless.

There is a good chance you can get a variance. It is critical the buyers with plans for accessory units look at the local building codes. Have you submitted an application for a variance. Most variances in our area are approved. You should not assume your neighbors will object. Just make sure you make clear to them that you plan is to build a single home not a development.

Hey, my family have been in FL. since to 20's here what you need to do is get an real estate attorney. I did a total property plan for future buildings and design of the property and plan use of the property. Oh and by the way you do not want to build a stick house in Florida I highly recommend concrete. The other thing I noticed is you got the stick Pines close to your building she want to have no trees within your buildings of 150 ft that's my rule hurricanes will turn those pine trees into projectiles those things will snap off with Summer thunderstorms does the pine trees they make oriented strand board out of and that's the next thing I'll tell you don't use Orion strand board in your house use real plywood it costs more but with the humidity down here and holds up so much better

Maybe you can make the 2nd house a guest house or technically connect it with a walkway of some sort? That may be a way to get around the technicality. Also, you should be able to get a variance since you are so close to 20 acres.

So apply for a change on that property, or ask a neighbor for 1/2 acer and for this 1/2 acer let them plant on part of your land x amount of years and see if you can merge both properties into one deed. There are ways to get around codes. But you submitted plans for 2 homes they accepted and approved. Other option sell the house you have off the land make them move it and add a larger home with 2 living areas. Planing commission approved this, they can't say no now. At least give a deviouation .

If you want to actually have farm agriculture use land, you have to meet the requirements, otherwise is s form of residential with more limitstions. Forestry and horticulure, etc also have requirements. Can divide a parcel into different uses.

Same thing in Lake county Illinois....$800.00 a month in property tax on a 50X150 lot....they tax me on the house we paid for, not the land. When did it become constitutional for government to tax personal property??

Im in North Florida also, Putnam county to be exact. Go back to zoning, ask for the variance paperwork. Its a simple process, as long as you dont get public pushback by neighbors you will get approved. A real-estate lawyer is definitely recommended.

Stumbled across this. I am civil engineer. Three things I thought of. 1.) buy a little more land adjacent to get to 20 acres. 2.) The county commission should make and rezone it or at least give you a variance from the law in this case. Maybe they could limit you two or three residential buildings for 25 years or something, 3.) A tiny 800 sf tine home would save lots of money and is doable for two people. Build outdoor space to make it bigger.

i have some thoughts...keep the plans made for your 2100 house with the 1600 as an accessory building. build 3 garages attached to the 2100 house. in one or 2 keep your cars. in one have for storage or for golf cart/boat. in one of the 3 attached garages build a tornado shelter. it is something you will need. the golf cart is nice to have checking on your fence line/flooding. cement,roof,walls&garage door shouldn't up the price too much. check with county on storm shelter idea in a garage. 20x20 is 400sq ft just for one. also a spare bedroom with own entrance and bath makes a nice B&B income if county alows. ( or for guests) also...if you would rather only have 2 garages add an attached greenhouse to grow own food. just some thoughts...all have to have your county stamp of approval of course.

Change the parent's house to a storage building and build your planned house with a parents apartment added on . Have separate meters for utilities so as to only pay for your own heating and cooling etc. I'm confused as to why the primary house has to be exactly twice the size of the secondary . Are you sure they don't mean not more than twice the size ? If not it makes no sense to me , making the plan exactly to the specs would be a headache in itself and get the set-up you want .

Some of the inspections can be done to the federal government bypassing the county I don't know if the planning can be done the same way

I know some homes in GA where they created an enclosed patio/breezeway between the house and garage to satisfy zoning sqft requirements. I know FL has stricter rules but something like that could increase sqft but not necessarily heating/cooling cost. Technically it is just a large screened in porch.

Okay, how about working around the system? Why do you submit plans to expand the current house? Use your dream home plans and build an indoor hallway to your parent’s house. Since you are expanding the current house and they are both connected by the enclosed hallway it would be considered a single house. I hope that this idea helps.

The obvious question would be, are you allowed to add on to your parents existing home "creating" 1 structure that could house both families? Sure it would completely change everything, but it would be within the county ordinance. When your parents passed, you could then decide if you wanted to rent that part of the home to recover the added cost, or covert it into part of your living space. Not ideal, but not nearly the cost of an additional 1000 sq ft. added to your new plans.

I remember hearing someone with the same problem yrs. Ago & I think they got a letter from all their surrounding neighbors & some county officials/politicians? giving them a waiver to some of the zoning rules?? Also, could you build a large addition to the smaller house &/or maybe look for an even nicer place?

Is there a Board of Adjustment? Generally, there is an option to ask for something called a "variance" - it would allow you to get an exception to the zoning code. I doubt you'd be denied over 1/2 to 1 acre. You can't buy that land without passing your problem to a neighbor.
