There is a lacuna because the law never contemplated a situation in which nearly all the members would (purportedly) "defect". Let us take his supposition, which holds no ground in law, further. What happens if all the members, except one, died? Can a single member (instead of 32 )make laws for the entire state when the Constitution stipulates the quorum as one third of all the members?

Martins Amaewhule is the current speaker of the Rivers State House of Assembly as it stands, because of a judgment of the Abuja Federal High Court (FHC/ABJ/CS/1613/2023) headed by the honorable Justice Omotosho. The judgment recognizes Amaewhule as the speaker, and it has not been set aside by a higher court. The Judge directed the Governor to represent the state budget to the Amaewhule led house of Assembly. This is the status quo until a higher court set aside this ruling. The Appeal Court ruled that it is only the Federal High Court that has jurisdiction and Justice Omotosho is a Federal High Judge.
