Hey Hashem....thanks for subscribing! Yes you can file for your husband under the 2cnd preference. When you become a citizen, you will upgrade it.

Hi Mr. Gray, I am a subscriber, thank you for this information! I lived in the US for 30 years (and I have tax returns, CDL, Rental contracts, etc. as proof) - but I had to leave in late 2017 as my Mom passed - I was out of status when I left and I am not currently in US, can I still apply through this and be granted green card?

Entered in 2009 states for a month and returned in 2010 Feb and staying since then , on non immigrants visa H1B , am eligible for applying under this registry provision considering proposal is to set it to 2010 I.e folks entered before 2010 Jan 1st ?

this is a great question. we would need to dig into this diplomatic status, but on paper, you would meet the physical continuous presence test.

How does am undocumented have a SS Card or a drivers license, legally???

They could have gotten it when they were legal and fell out of status. Some states allow undocumented individuals to obtain drivers licenses.

What of someone who visited USA twice but was denied Visa after he left. he had doctor's appointment and was not able to travel as scheduled. he has applied applied 3 times attending d interview with letter given him by his doctor to show he was sick and could not travel. It depends on the Consulate. You need to check state.gov website and find your Consulate. It will indicate when they will resume full operations.

Hello and greetings my brother thank you for the info. Your time is not took for granted. My wife and I married here in Virginia back in 2009. She was with me until 2015 When she first came here she came legal On her Visa and Passport. Back in I think it was 2012 or 2013 Her Visa ran out. She was with me here in the States until 2015 when she lift out to God back to her country which is Panama City Panama. Her Visa was expired when she did go back in 2015 They told her then because over stayed That she could not come back to the States for 10 years However since then the laws have changed So I'm writing to you to see if you by anyway be of any help in this matter She is still in Panama.

I am holding Green Cards , I left US in July 2019 for medical treatment ,unfortunately it took longer thhan expected. This followed restriction of travel due to COVID pandemic . I applied for re entry visa, interviewed in February 2021& approved to apply SB-1 Visa. I submitted all the documents , tried to make appointments for Biometric & interview. Unfortunately I couldn't find SB-1 Visa section in website. Now the COVID pandemic is high here & Embassy is not processing SB-1 Visa. I started these almost a year ago .All my Children & grandchildren are in US . What do you suggest me to do now ?

You can try to make an entry and explain yourself at the port of entry that you never gave up your green card.

No...they must be in the US Continuously from January 1972(today). If the law changes, then they must be here from the date congress sets( 2005 or 2010).
