I was a green card holder for almost 20 years, being married to a citizen all these years. Three years ago wen my husband hired an attorney to write his will, it appeared that I have to be a citizen spouse, to be able to receive inheritance if this is a case. I also could not make my own will for our son. So yeah for he legal issues like this, otherwise I was fine with the GC

However, after one year, I am still waiting. Online says "please wait" as there are so many applicants. I want to travel during this time urgently to visit a sick relative. I cannot even get an appointment to visit them even though I tried. They keep saying please "wait" for some more time. Do you have any other suggestions please? Is there a way to walk-in and explain?

When you join the Armed forces with a Green card, you would need to apply for Citizenship as soon as you join in, the Armed forces pay for it and it would take you less than 3 months to get it. However, you must fulfill your contract with the Armed forces and not get expel from them; once they expel you the USCIS will revoke your citizenship due to unable to complete contract. This process was approved by then President George W. Bush through the Executive Order Expedited Naturalization of Aliens and Non-citizen Nationals Serving in An Active-Duty Status During the War on Terrorism in July 2002. Section 329 of the Immigration and Nationality Act 8 U.S.C. 1440. I hope this helps.

What would happen to SS benefits if you decide to retire in another country after working in the US for the most of his/her life as a permanent resident. Would you lose your SS benefits if you ever decide to leave US in order to retire in another country. Thanks in advance!

I believe there is no problem in getting your pension living outside the US but the problem is you have to live in the US as a green card. if not you will loose your GC and charged you as abandoning it. Then your pension is affected once your GC is revoked. In this case, you can no longer enter the US without a valid green card. Better to be a citizen than a green card because you can live outside the US as you can.

Very good but #5 is I think wrong. You say "as a US citizen you can live abroad for long as you want without abandoning your green card." Unless things have changed since I became a citizen (20 years ago) you actually SURRENDER your green card the moment you become a citizen. I always thought it strange that you then have NOTHING to prove you are here legally unless you acquire a passport.

Romanian passport can visit 174 countries without visa. All countries in EU + all Schengen countries not in the EU. But still, Romanians cannot buy apartments on the corner of a table, on a napkin, in a foreign country. Americans can do that. That's a major advantage. Want an apartment (house) in Katanga ? You can buy it. Romanians never even heard about the concept.

If it ends up being greater than 6 months but less than a year and you can show the border official you had intent to return or could not return due to extreme circumstances (like no flights from your country to the US), you should be ok. However, I would recommend calling an immigration lawyer to talk through all your options. You say family re unification especially for spouses is a priority? As things are right now it is not established in fact. In the case of a long time married, yes a distinction should be made for those that have been married 5, 10, 20, 30 years or more and have already u.s. citizen children or adult children, clearly it is a bonafide marriage. In those cases, there is not a need for any interview at all. Many countries allow a spouse of their citizen to enter with a marriage certificate. The marriage is respected and the family is not distressed. There is no waiting or interview. It is an aknowledgement that their citizen has the right to abode with their spouse. If a background check is deemed necessary, I remind you that gun purchase background checks are instantaneous in many cases. All of those administrative barriers that are now present should not apply to u.s. citizens that have obviously a bonafide marriage with a non citizen. What is obvious? They have children together that are u.s. citizens! Hello? And they have been married many many years already . What are the administrative barriers for? It just wastes government time i.e. salaries, paperwork, needless computer records, etc. etc. etc. Time is money and gov. wastes a lot of it in these cases. Some of these very long time marriages, the non u.s. citizen already has been a LPR (long time permanent resident) for many years, has a u.s. issued marriage certificate from many years ago, and has been out of the u.s. more than a few years with their spouse, and simply want to return with their u.s. citizen spouses, children, and family, to their homeland, but noooooo, they have to go through the 'process' as if they had never been to the states, and don't have a bona fine marriage. So again, the distiction is if one has no u.s. citizen children and has not even been married a year or two. These cases may want to treat differently .

I spend the majority of time in my homecountry as i do busines there and partially in the US where i have business too. Im an independent proffesional. Im always back and forth without spending more than 5 months outside the US. Would ike to apply for citizenship but dont quite fit with the 50% rule that requires that in the last 5 years one would have to reside at least 50% of the time within US soil. Do you find this fact enough to inhibit me to apply for citizenship? or should i just go ahead and apply without major ocnesquences if the process is denied?. Side note: my son who received his green card at the same time me and my wife did, just became a US citizen as he did reside in the US for th last 4 years while attending college. Thanks

Hi Maneesha , i am born in Doha , my sister is a citizen. Then Is it faster to get green card through sibling immigration OR do the green card thru H1b work visa?
@maneeshamukhi
@maneeshamukhi 4 жыл бұрын
Through a sibling, you are looking at 10+ years. Through H1B it depends on which category you fall in - EB2 or EB3. My guess is it will be faster through H1B, but you can also do both. You can start both processes and whichever one comes first, you can adjust your status using that one. Also, fyi I am not an attorney, this is an educated guess based on my knowledge of immigration.

@@GeorgePhilipBobby I would confirm that with an immigration attorney (I work with a lot of them, but I am not one myself). I know for sure that you can file a green card through work and spouse at the same time so I imagine it's the same for another family member.

Hello. What are the barriers to renewing a green card that has been expired for many many years? Is it possible?
@maneeshamukhi

Yes, as long as you have maintained your status, you can renew using Form I-90. Here is the form and the USCIS instructions. www.uscis.gov/i-90

I just got my appointment date for my interview early next month, I don't know if after passing the civics test I will be part of a the oath ceremony on the same day or a different day. After 5 years of being a permanent resident, I had to apply for a second time because the first time was during my marriage to an American spouse, but now I'm facing a divorce. So my attorney suggested me to withdraw my previous application and apply based on my 5 years as a permanent resident. I wonder if still I will be asked questions about my current marital status.

Sometimes the oath ceremony can be on the same day but usually you get a letter soon after your interview w the oath ceremony date. You’ll find out when you get there! As for the questions, answer honestly. Sometimes marriages don’t work out and you are a permanent resident now so you should be fine! Good luck!

If you plan on staying in US why not. I got my citizenship and glad I did. It was a weight off my mind. No more forms or costs no worry about deportation and dual citizenship.
