It is a relief to listen to scholars who are able to analyse and go to the depth of problem keeping in mind the cultural, psychological, emotional and biological factors. The solutions do not give any weapon in the hand of any party, rather gives both parties some reason to have an insight into one’s own self to see the issue in correct angle and make a justifiable decision. As Shaykh rightly said that such issues can only be solved with love and consideration and not by Fatwas.

Well, if the wife does not want to be intimate with the husband, she can always let her husband marry another woman, or seek divorce by returning the mahr/dowry.

Ma shaa Allah. We live in the US and our husbands are collecting 50% of our family expenses as from us as our share of finances. What right do they have on their wives? I think they’ve given up their rights on their women

Assalamualaikum dear epic masjid team, i hope you accomodate holding this type of class like Ask YQ or Prophet Series or other lengthy class with live auidence in the masjid, because there is tarbiyah difference between seeing the shaykh interacting with people directly and speaking in front of camera, it feels more real and listening friendly, i saw the difference how is the talk engagement quality was much better before pandemic area with live audience in Epic masjid, and when the shaykh gave his seerah lecture in memphis, jazakallahu khairan, i hope this is constructive advise for us 🙏

Salam. Sheykh YQ has clearly said that both spouses has the right to engage in intimacy, but the woman refusing to give the man’s right, doesn’t justify marital rape ! The reasons why are because: 1- It’s recommended by Allah, to treat women with gentleness ; therefore the husband would desobeys God, because of his wife’s fault. 2- Forcing someone to do something is always contreproductive; that will only fuels the fire. Now, The question is, what to do for the man who is denied his right ? To this, Sheykh YQ proposes to first, try to find out and follow some therapy if needeed. I’ll add that, the second step should be getting another wife, since our religion allows polygamy. The last solution should be a divorce, if the man can afford it. Noone loves polygamy or divorce but Islam has allowed them for this kind of situation, where husband or wife might suffered. God blesses YQ for his effort and all of us.

@@MD-vx3un Thank you for trying, but the solutions you propose are by no means solutions. Marrying a second wife does not resolve the problem between the man and his wife, it just provides "an object to fulfill his sexual needs" while, like i ve already said, the issue with his first wife remains. And...may i remind you how the Shaykh spoke about this " beautiful, special act""...Nothing to do with "anything" to be replaced by anything. And i am sure no woman in the world is happy to be the second wife for such a reason.

I’m a woman and I think that a woman shouldn’t create emotional distress to her husband by refusing intimacy . She had to explain herself even if it is her own body. What is the man is supposed to do if his spouse refused intercourse without valid excuse?

They should seek help or get a divorce. Raping is not justified as it may create more misery and ultimately divorce.

I think a man can withhold his provisioning, protection and attention as well. Marriage is an exchange of value. The woman give calm, intimacy and submissive peace making on the other hand, the man give masculine leadership , protection and provisioning. He should withhold his duty as well.

On what condition can a man take a second wife ?? And can his first wife refuse ? And if the first wife feels treated unjust through out the marriage, her rights were usurped and then on top of that the man wants second wife out of bordem and no other reason can she take a divorce?

Assalamoalaikum Jazak Allah for the video. What if I buy home 🏠 on mortgage from Bank of America and the home equity increases over the period of time and my children inherit it. If we say it's perfectly halaal to inherit regardless of how the wrath was accumulated then we are indirectly encouraging parents to acquire wealth by any means which is what happens in most of the cases. In USA majority of people build wealth by buying home and building home equity. Muslims buying homes on even on so called sharia compliant institutions are not 100 % halal. Instead of solving root cause of the issue we think we are being pious for saying no to money earned by selling alcohol.

Sometimes refusal of intimacy from the wife have something to do with the husband not being the provider, neither the husband helped around the house with chores and the wife ended up feeling exhausted and just as she lay down the husband wants intimacy. This is the most cases I have encountered.

Cz, That's not normal. No man ever refuses a woman for sex unless he's got issues. You are pointing out a one in a million case. Now, to cater to your query: listen to 45:39 implying a woman has right over her husbands body, just like she has over her husband's income and wealth. If she is deprived of that, she might consult to save her marriage.

Fair point. In that case she has the same rights. Does the Quran not say و لهن مثل الذي عليهن بالمعروف And they (female spouses) have the same rights due to them as are duties upon them, and men have a degree over them (rough translation). I think it is the last third of alBaqarah.

@@cerberus8856 This issue can happen if either side stops taking care of themselves, not maintaining attractiveness. Putting aside unreasonable modern beauty standards, one still shouldn't assume a man should be fine having sex with any type of woman. Sex drive is linked to energy, fitness, ... we're wired to want to reproduce with 'healthy specimens'. Love can remain, but sexual attraction suffers.

The sad fact is that most Muslim women aren’t even aware of what their obligations to their husbands are. Men are constantly informed of their obligations to provide, and for good reason. But rarely do any mainstream scholars or educators inform women of their obligation to provide sex in a marital contract. To not know your obligations before marriage is dangerous. This doesn’t justify marital rape, as harm isn’t allowed, but it is still sinful, and shouldn’t be surprising if it leads to the rapid destruction of marriage. Even here, and I say with utmost respect, you say clearly that the man must provide, but you are very careful around the language that the woman must be open. Though I respect that you did say it. It needs to be mentioned more though.

You are living in la la land if you think muslim women are not always being told about their obligations! If a wife is only available for sex because it's her 'obligation', then there is something really wrong in that relationship. A healthy, loving and fulfilling relationship will naturally lead to healthy sexual relations, if that's not happening both parties should have an honest conversation about why that's the case. If you are a man and the only way you can get your wife to have sex with you is by telling her it's her obligation, then either do a better job at being attractive to your wife and pleasing her or just walk away and find a woman that wants to have sex with you willingly. Some men work their wives like maids, give them 10 kids to raise on their own and on top of that don't make any effort to look good for their wives, and then want their wife to be in the mood? Withholding sex should not be used as a weapon in marriage, that's not what we are talking here, but women are human beings, they get sick, they get tired, and they are also sexual beings that need to feel attracted to their partner, before you go around emotionally manipulating your wife into sex with religious texts, please just analyse your marriage, see what you may be doing (or not doing) to cause the problem and have a chat with your wife, you will find that might solve the problem. 🤦🏻‍♀️

A married man should not have to "rape" his wife. That is a serious problem if wife refuses husband without a valid reason. My advice is to avoid marriage and remain celibate. Most people do not behave well at all

If a man does not contribute even 50% to the NEEDS of the family and wife does not have access to his money (you said “take”) then what? Wife will be resentful obviously! And he can still force himself on his wife?! Some Muslim husbands now a days want wife to work, give him the money or pay for bills and he doesn’t want to work or keep his income AND have “access” to his “wife”! The audacity of this being to call himself a Muslim😅

So true. In my country itself many men depended on their wives for financial support. A lot of women here paid bills etc on top of that the husband is a drug addict who stole money from his wife. Some even went to jail and still expect his wife to accomodate him upon releasing from prison. Yet, at night he still force himself on his wife and have the audacity to speak about the wife's obligation and so on. Its really disgusting

by definition such husbands probably regard misyar marriage as halal. the husband in such marriages makes it an obligation to offer sex only which is quite disgusting.

Have to disagree with this. Most of the acquired wealth is Haram in developing countries at least. You have to do at least basic research. Common sense dictates that it is Haram but people are just in denial. How can your father be rich when he should barely be able to make ends meet. Plus if nothing else then you are a beneficiary of your father's Haram money. This perpetuate the cycle of Haram as it focuses Haram wealth in families forcing others to do the same to catch up, and create haves or have nots. It's preferable to not be wealthy in the first place in Islam. Wealth is extremely rarely created in reality, it has to come from some place which is usually either the poor in your area or from far off places, which is why Islam focuses to donate it to the poor to balance out the society. You cannot see everything in a purely liturgical manner, these ulema a thousand years ago said this and others a thousand years ago, or followers of those thousand year old ulema said this. You have to see the spirit of basic Islamic guidelines, especially in the context of real world problems plaguing the society in the current era. Was the society extremely corrupt and entirely interest based unlimited growth model a thousand years ago. Almost all of those Thousand year old Ulema would call for mass Jihad against this system if they were alive today. Many notable ones died opposing false Khulafa and Kings for far less. Islam isn't simply a religion it's a way of life and a guideline for humanity.

He didn’t say that. He said we can make Ijtihad on issues which are not explicitly mentioned in the Quran and Sunnah according to our time and circumstances which is Islamicly valid. Contemporary scholars are not bounded by the Fatwas of past scholars (may Allah bless them), they’re only bounded by the decision making-process of past scholars which is unanimously agreed. For example smoking. There’s nothing in the Quran and Sunnah that prohibits smoking and if you look at the fatwa of scholars in the past, they believed smoking was halal and you had scholars in the past who used to smoke. Why did they believe that? Because the harms of smoking was not known in their times but in recent times we have discovered smoking causes serious harm and almost all contemporary scholars consider smoking to be haram based on the harm principle which is apart of our faith. There’s nothing in the Quran and Sunnah that prohibits smoking but since we know the severe harm it can cause, we can safely conclude that smoking is haram.

@@LeoMessi_22 Be weary of secularising, liberalising Scholars who are out trying to reform Islam in the image of disbelievers. By conveniently discarding the rulings of our earliest, pious predecessors whose methodologies and transparency are agreed upon by this Ummah; in favour of what westerners concoct as ideals or ethics of modern times. We have seen the likes of this Sheikh even challenging and trying to overturn the opinions and ahadith of the Sahaba. A ruling is not found in Quran and hadith does not mean you can chip and chop in your own ways driven by a desire to appease the Kuffar.

@@LeoMessi_22the issue is the older scholars were leaps and bound more qualified in ijtihad. And not only that each madhhab has scholars across a 1000 years in different places. And if they all had a conclusion you can bet they were less affected by their culture and more able to discern principles than contemporaries. And even then, 50 years ago our western scholars didn’t have the same view. When we change with the zeitgeist we risk seeming foolish to our grandchildren (as has happened). Now on a practical from sh yasir’s opinion isn’t binding on anyone. And by introducing all these opinions in muamaalat you set the stage for dif expectations

Asalamalykum it’s haram bro ,yasir qadhi clearly said it is ,and so have the scholars ,jus cuz u hear people unfortunately saying something like this is halal it don’t mean it is ,many times the evidence/hadith dont reach a lot of scholars ,for eg anal sex was permitted by sons scholars but obv they didn’t know about the authentic hadith then
