The first thing out of this pig mouth is that he is not cooperating and he doesnt have to so what exactly is the problem. Direct any and all further inquiries to my attorney, I have no further comment at this time." And then shut your mouth *and keep it shut* until the cop lets you leave OR you speak to your attorney.

I got stopped by the US Secret Service Uniformed Division while in DC on a protest. I was stopped because I was from Colorado, driving a big Ram 4x4 with an NRA sticker on the back window. The Agent's official reason was that I didn't have a valid registration sticker on my license plate, and he was correct. I had forgotten to put the sticker on. When one of the agents asked if I had any guns in my truck I responded with, "No disrespect intended, but as a matter of policy I can't answer any of your questions.". He says, "Policy...?". I said, "Yeah... It's just policy.... You know how it is...." lol. I got a ticket (Which I still have for bragging rights) but the agents didn't file the ticket. When I didn't get anything in the mail I called the DC court. They had to open the case in order to dismiss it, and it was closed.

watch the Orginal video. Ata did it again and didn't cover so many things that were pretty relavent for the audiance to know. The cop absolutley Trashed the inside of his car looking through things when asked not to, The officer in question Complained to his partner that there were no pending chrages, as well as racially profiling him by refeering to his look and face tattoos as he shows the Drivers lisnces to his partner and other remarks. AtA has skipped over details like this before on many videos and as much as i agree with you i would also watch either the orginal or other Auditors covers on the video and hope to see congruency

Traffic police are 99% of the problem and give other officers a bad name. They go after low-hanging fruit, victimless crimes, most the time, the cops have to break the same damn laws they're trying to enforce. They are nothing but Hypocrites, Authoritative bullying jerks. The cops get a feather in their cap if they can get us for speeding, drugs or paraphernalia in the car, or any other simple infraction, that's all they seek so they can get their promotion. Traffic Nazis at best. 😮

They are literally trained to do this. They tell cops to look for cues for possible illegal activity and believe it or not, invoking your civil rights is a cue. And since they only hire obedient dummies as cops, they follow every order even though it’s unlawful. This is also why they rarely get punished for doing this stuff, because their leadership literally told them to do it.

Not long ago, A Florida Deputy was recorded planting Drugs and Drug paraphernalia and sentenced to 12 years. They had to review and release every person he had arrested for Drug possession while doing a traffic stop. So it's not beyond the realm of possibility. And not the first and certainly won't be the last corrupt cop arrested for this

@Salty Pureblood No permission at least gives a chance at using the "illegally extended stop" argument in court successfully. If you consent for any reason, that's gone...even if they plant. It's hard to imagine a scenario where consenting to search is a good idea. And given the asymmetric nature of these encounters all around (monopoly on violence, no accountability for civil or even criminal actions by police, legal authority to lie to you while you're charged for reverse, etc), the most they can/should expect is the citizen politely declining interaction and then doing/saying nothing other than occasionally reaffirming that they're illegally detained.

Absolutely they will plant something. Look up deputy Zachary wester. This POS would lie about a traffic violation and ask to search. For months there was not one car he searched that he didn’t “find” drugs in. And on about 90% of those stop he would say that he “smelled marijuana” but he seemed to always find meth. 128 cases that he was involved with got dropped a few weeks after his arrest. People lost their jobs, cars, houses, marriages…one guy had just gotten custody of his daughter and he lost her because of this deputy. It makes me sick to just look at him. But he’s not the only one…there are dirty pigs all over this country.

The man was treated like a criminal for driving properly, not having anything illegal, and going to the gym. This reminds me of the stop where the guy got pulled over because he had an “air freshener” on his rear view mirror. Just no need for all of this

Well driving under the speed limit can be an offense...and is very dangerous to others on the road (depends on the situation, road conditions, etc). So i think its good if people going 10mph or less under the speed limit get a ticket for endangering everyone else

Unfortunately, there have been cases of Police planting evidence, so even if you have "nothing to hide", consenting to search is still dangerous. Especially when it happens under such suspicious circumstances that border with coercion.

Audit the audit did a video on that. The cop planted drugs on multiple people and sent lits of innocent people to jail. He got caught because he forgot to stop recording. So the cop's own gopro showed him planting the drugs. The cop is now serving time in jail. We need to eliminate all drug laws because they're abused.

I talked to a fellow that did 10yrs in prison because a cop wanted his wife (they had began an affair). Cop pulled him over one evening, then asked to search the car. He was a working stiff and had nothing to hide or so he thought. The officer threw a small bag of dope under his car seat then pulled it out saying, "What's this?" He lost his freedom, his home, his job, and his bitch wife all in one evening.

I would be petrified they would plant something. The problem is, if you don't consent, they end up arresting you for obstruction. I've always respected the police, and now I feel a different kind of mindset causes a young man or woman to join the force.😢

I watched a video where a cop arrested an EIGHTY year old WHITE woman for a “DUI” bc she was confused. Her son came as she was getting arrested and explained she had a stroke, she’s on blood pressure meds, and other meds, and that he would drive her home. They did eventually let her go home with the son after they made him call his supervisor. But had the son not showed up, that cop had full intention of booking her in jail for a DUI, even though he smelled no alcohol or anything on her. It was unreal the way he not only treated her, but the way he spoke to this old woman was horrendous. Sorry for the rant-but it’s really hard to see comments like yours basically inferring that the one and only reason he was treated like this was because he’s black, bc I can ASSURE you, the cops really truly hate ALL of us civilians and believe they’re above us all. To be quite honest, I’ve seen them treat poor or homeless white ppl worse than any other race. That’s after watching probably 80 hours worth of these videos in the past several months. And there’s many more to still go thru and watch!!!

There's a fix for that. Have the case go to jury trial, and if the jury finds that the police officer was in the wrong, not only should the police officer face punishment (and dismissal, if the jury thinks it's warranted), whoever approved that behavior should face the same punishment. But for this to work, the PD should not be allowed to settle the case out of court.

I live in MN and the minimum speed for 60 is 45 so going 53 is not a justification for stopping him. The real reason is they are profiling him as it happens quite a bit here.

I’m a female, Black Veteran and a law-abiding citizen that respect(ed) police officers. I was driving from Texas to Kentucky and was stopped in Arkansas (of course). I had three bags in my back seat and the officer questioned why I needed so much for a week’s vacation! Three bags is a lot?!? This a**hole made me take my bags out and open them up, had I known then what I know now, that wouldn’t have happened. I grew up wanting to be a cop and admiring/respecting them, sadly that has changed! I was pulled over for ONE reason and ONE reason only: driving through Arkansas while Black-period. You serve your country honorably, follow the laws of the state and country and are mistreated for absolutely NO reason. There are people that seem to have a problem with Black people being upset with SO many being killed and mistreated for no reason, but until it stops we will continue saying Black Lives Matter! Let’s be clear, that’s not saying ONLY Black Lives Matter we say it because it’s Black lives being taken. Until (and I hope it doesn’t happen) other races are killed for no reason, then we MUST bring attention to what is going on. This man has clearly done nothing wrong, but I assure you he’s standing there because of the pigmentation of his skin! Do better!

I agree with you completely. The internal affairs departments certainly aren’t doing their jobs properly. That money should be used by a city council to create a police accountability department for each jurisdiction. Then the associations who cover for bad cops need to be disbanded, unionized yes, political no. There should be consequences for the good cops who witness bad cops breaking the law and not reporting it. There are too many cop gangs. And from watching these videos, too many either don’t know the law or just push it and claim qualified immunity.

That's all well and good, however sleeple are fooled by these citizen police accountability boards, when they are no such thing. They never have any power, not even to suspend cops for a day, yet alone terminate anyone. They can only forward concerns to Internal Affairs and DA's who already aren't doing their jobs. More often than not are comprised of people close to local government. They're just feel good committees that in reality do absolutely nothing

It's illegal to pull someone over for a mere traffic citation, that would normally take 10 min, to hold that person for 20 min waiting on a dog. Always deny. If they ask y, say you believe in the constitution, and they aren't liable for any damage they cause tearing your property apart looking for something

I would NEVER give consent for a rental car. Who knows what previous renters have done in the car or substances left. I once rented a car and later found 4 or 5 beer cans under the drivers seat. I was a commercial driver at the time and this would have been a life changing situation if I'd have been stopped. Never never never assume that these rental companies give you a pristine cleaned vehicle!

Profilers make educated guesses based on the mannerisms of criminals to build a 'profile' on how a criminal may look or act based on their crime. In this situation, they're using a persons physical appearance to assume a crime.

Remember too, if he had just finished working out, his body temp is higher so it feels colder than it actually is, and he may be in damp cloths because of sweat which is easily and quickly changing temperatures.

True for the most part, he should have flat out refused and stood his ground on not consenting to any searches (even though he knew he was clean), but I understand as the pig was esssentially trying to torture the poor man into compliance with the freezing weather. It just would have given him a best case scenario for a lawsuit had he withheld consent, and possibly the cop would have done even more illegal shit.

And here I’ve been driving around with multiple criminal indicators these last few months and didn’t even know it! I drive a rental car while mine is in the body shop AND I always have multiple bags in the back seat. I may even occasionally drive 5 miles below the speed limit at night when deer are out and I’m coming home from the gym. How suspicious of me!!!

I saw the video before, thanks for the legal background on the issue. The officer just felt odd, "I don't want to coerce you" But then threaten to get a dog to do a search anyway whilst letting him stand in the cold. Just made him feel forced to let him do it so he could get going. If that's not coercion then I don't know what is.

you don't actually have a choice, if they ask, they're going to search. A dog will hit if they want it to, and you can look at the rates of success of drug dogs, and it's akin to chance. This man realized this and just wants to get home, because they will make his ass wait for the k-9. Cops are being paid, and this guy loves the idea of abusing his power, and he's actively being paid to do so in this situation. There is no such things 'wasting the cops time' because they don't really have shit to do, so they'll just send a new unit out to relieve the other, and in fact you've just justified their budget by proving they need units on the street. You can't protect yourself form corrupt police without direct video evidence, and even then, it still requires their buddies in the other parts of the legal system to go against them.

Besides what the cops might plant, there have also been multiple cases of benign substances like powdered sugar from a donut being used as the reason to make a drug arrest. In the case of a rental car you have no idea what other renters may have left in it.

I had a stop like this when I was about 22 with FHP. I was polite and cooperative but have an anxiety disorder so I was visibly nervous. I was also in nursing school and had a bag full of pill bottles with candy in them (learning dosaging.) I let him search the bag and my purse. He then asked to search my car and I asked why. "It's nothing personal. I do it to everybody." Astounded I said, "you don't have the right to do that so no." He threatened to get the drug dogs and I said go for it. Long story shortish he wasn't allowed to get the dogs and had to let me go. Know your rights.

Even if he had gotten the dogs. Anything found from the search wouldn't been considered "fruit of the poisonous tree" (actual legal term) and would be inadmissible in court due to violating your 4th amendment by seizing you longer than a reasonable time for a traffic stop.

The fact that you stated the officer was looking for any reason possible warrants a D or F grade. This kind of behavior is why encounters with police tend to escalate. This man is lucky, and that officer needs to be off the streets because he's clearly searching for things that aren't there and manipulating scenarios to fit his narrative.

Needlessly extending the length of the traffic stop and forcing someone to stand outside in the cold under threat of bringing a drug-sniffing dog to the car is textbook coercion. It's not uncommon for drug dogs to alert on the basis of subtle signaling by the officer handling the dog. Additionally, drug dogs are typically instructed to touch the car while they sniff around it, hence anyone that gives a crap about the quality of the paint on their car would be further disincentivized to allow a drug dog to sniff the vehicle. Drug dogs should not be allowed to be used just because the officer can't get lawful consent. It's not entirely dissimilar to the "smell of weed" argument. Anyone can literally make that shit up as justification for violating someone's rights. Luckily, with the widespread legalization of marijuana, this will no longer be the case in many states.

some jurisdictions only allow those charges as secondary charges, meaning that if there isn't a valid reason to arrest, a citizen cannot be charged with resisting arrest, same with obstruction and failure to ID. Disorderly Conduct is more broad. and can be the primary charge almost everywhere.

I’m white, normal family, not into drugs or crime. Have had this happen to me many times and many of my friends who are WHITE. It mainly comes down to the department and how they conduct their business. It’s sad this gentlemen had to endure this. I’ve been in the same exact boat. Freezing cold and they are threatening me to wait for the k9 when in fact I have done nothing wrong and had nothing to hide. I got stopped in Florida back in the 90's and refused the search of my vehicle cause I knew I had nothing. Two hours later, the cop was mad that they found nothing and that I wasted their time.. I laughed at him and told him he was wasting my time, so I felt obligated to return the favor.. Now if you'll excuse me, I'm going to the beach and I'm sure you have work to do.. 😂😂😂

​@Michael Brammer if I recall correctly, whenever ATA refers to the definition of obstruction, it requires an active attempt to prevent law enforcement from executing their duties. This would be achieved by force or tampering with the subject of interest. Just passively saying, "I don't consent," has an extremely low chance of being construed as obstruction. "Im not trying to coerce you" *extended the traffic stop for no reason, had him get out of the car into the cold, dragged out the questioning and asked to search several times before threatening to keep him in the cold to wait for dogs if he didn't consent*

I'm 29 years old and I kid you not the only time I have been pulled over was for driving too slow through a construction zone AT NIGHT "Do you know why I pulled you over? You were driving too slow" "...Through a construction zone? Isn't that the point? I can't really see where I'm going" He let me go but it was a rather confusing moment.

My best traffic interaction - I used to drive a Honda Accord Type-R. One time, I'm waiting at a red light, I'm the first in line, green light lights up and I went off full throttle, accelerated on 1st gear from 0 to 30mph, I mean just for fun, just to make it loud. Next thing I know a cop, who was a few cars behind me, turns his lights/siren, chases me up and pulls me over. He claimed I was "driving recklessly", started giving me a lecture on how dangerous I was driving. I asked him "Are you in all seriousness saying that accelerating in a straight line from 0 to 30mph (the legal limit) constitutes dangerous driving?". He mumbled something, I couldn't really understand what he said, then he swore at me and.. walked away. At first I was stunned, but then couldn't stop laughing. What an idiot.

"I can't really see where I'm going" is not a thing I would want to say to an officer. It would give them all kinds of excuses to "investigate" you. It may be hard to remember in the moment, but "Visibility is poor in this construction zone" would be a better way to say it. There are people with vision problems who shouldn't drive at night, and some who shouldn't drive at all, and not all such people have the good sense to limit or give up their driving. And of course there are times when visibility is so bad that EVERYONE should stay off the roads.

When I was a teenager my brother, friend and myself were walking through our neighborhood and we came across a couple of police officers who were looking for some kids smoking pot. Back then it was still illegal, but the 3 of us just got to the area and were detained for 15 minutes because apparently we some what matched the description the police received. After the 15 minutes we were released without incident, we didn't talk much or really answer any questions other than if we were ever in the area of the suspects.

I would say that the reduced speed is absolutely justified with the amount of ice on the ground that the officer had to walk through to get to his car. Sounds like the officer was just bored and needed to meet his department’s quota.

Probably one of the cops doing repeated stops looking for "drug traffickers". Since it's often out of state they get fines paid more often. Rental cars throw that flag. Little towns set up several officers to do just that task to bring in funds for the office. He's a piece of crap cop.

Eroding faith is an understatement. I wish this channel existed back in 2013. I unfortunately had my own run in with Ohio state troopers. I come from a family of police officers (actual good ones, I'm not being biased either) and now I don't trust any of them. It's gotten that bad. Even though at every opportunity the empathy in me when I see them at a gas station or what have you,i tell them "be safe" It's officers like these that make me sick and lose faith more and more every day

Watching a channel like this one, which sheds light on officers like the one on this video, can give you a disproportionate sense of police misbehavior. People binge on these videos and develop a belief that the cops depicted are typical and representative of the average cop. That's not a reasonable assumption.

Just a few days ago around midnight a cop flew past me and my friend going about 70-80 in a 35 going into oncoming traffic lane and then proceeded to run 2 red lights infront of us. Their lights were not on.

So if an officer tortures (cold exposure is a known torture) you long enough, and threatens to continue torturing you, during a baseless traffic stop to make you "consent" to a baseless search they can legally get away with it and will be fully supported by their chain of command. Disgusting.

We've seen that many times where a non-corrupt cop won't stand up to the corrupt one who can make their life miserable to defend a random civilian they'll probably never see again and just ends up standing there staring at the ground waiting for the encounter to end as fast as possible, praying that it doesn't escalate. 🤦

I see others have stated the issue with being out in the cold underdressed, and how that is a form of coercion and possibly torture depending on duration. The threat of staying in the cold waiting for a K-9 is the coercion and any rational person would realize the possibility of illness or hypothermia from a prolonged wait would definitely sway their decision to get the stop over with as soon as possible.

its the bad apples that make everyone look bad...theres more cops with good intentions than "out of control" ones. part of the reason cops need to be funded more not defunded. better training and personality screening would prevent a lot of this id like to think.

​@@DylanPorto45Generally the movement for defunding police is in agreement with you, it's not meant to neuter their capabilities but rather reduce the funding which makes them so heavily militarized, gang-like and resistant to ramifications for their abuse of power. If they had less funding and fuel for their ego trips, and more of the money was directed to actually making them competent then things would be much better.

@@abirdnamedwill not sure i can agree. have you seen Portland? ramifications have nothing to do with funding, its just city governments not holding them accountable. they dont want to look bad. regardless of how much they are paid, certain personalities still would have a sense of "power" over you by simply being a cop able to arrest you. its the people, not the money. i personally dont think they get paid enough (hot take i know). people want cops to save their lives in a crisis, but judge them every chance they get otherwise. doesnt make sense to me. maybe if they paid more and put resources into making them learn the law to a tea, and the right and wrongs in certain situations, more people would want to be a cop. not sure what you mean by "militarized" either. i was in the Army and they are getting no where near the funding we are to say the least LMAO.

Once he said, "I have no intention of writing you a ticket." That is the end of the investigatory stop. Anything further is harassment and illegal search and or seizure. Then he made sure to verify it was just that, not to mention "threat, duress and coercion." I am glad he is filing suit.

Just to add a bit to the initial context. This piece of road is close to the MSP airport so it is loaded with rental cars and people who are trying to find their way and drive slow while doing so. Also, because of the Mall of America and other attractions located In Bloomington the police department seems to treat most situations I’ve seen so along these ways because of their “training.”

When the cop threatens to call the canine, he says "you can sit on the front of my car or hang out in the back seat with the windows down and door open". This combined with the unnecessary questioing outside is proof that he's just torturing him with cold weather to get him to break down and consent to a search. Evil. Why would he need to sit in those conditions? Edit: TLDR: consensual search by coercion.
