It's much more humane than the original Pena Duro back in Bane's home country of Santa Prisca. There Bane witnessed his mother get raped to death by a pack of other inmates at the young age of six. Then instead of burying her, they fed her to the sharks surrounding the island.

Bane had one of the best lines later in the episode: Arkham is for the criminally insane. The Pit is for the criminally capable. It highlights how Bane takes into account you can help yourself but you just don't want to. The criminally inclined, the criminally dispositioned, the criminally aggressive. That is what I would've chosen, because these criminals committed acts of aggression, aggression that is criminal. The criminally aggressive.

So yes I would say this is a reference to Bane’s backstory in DKR.
