The sense of reasoning of some of the so called intellectuals baffles me sometimes. The law says if the MP seeks to run as independent from his party or joins another party too you don't understand? What does seeks to run as independent means?

But wait , how can one vacate his seat in a house that not yet in existence. I believe the constitution is clear on the particular house the member has to vacate his seat which is the current house which is in session. By precedent, it is the right for this members to vacate their seat. Because the integrity of the members will be assumed to be compromised if there is a switch from an independent to a party and vice versa.

The analogy of marriage is flawed. What is the law that governs marriage? A legal marriage can only be annulled through divorce or death etc. per the law. What is the rule that governs membership of a political party? Membership of a political party is premised on the party's constitution. One automatically looses membership of a political party when one decides to go independent. How can a law lecturer throw away his law and argue on a flawed analogy of marriage? Divorce is a process. Until a divorce certificate is issued the marriage still holds. Membership of a political party is automatically lost when one decides or becomes an independent candidate.

Joy news, please start featuring the ordinary Ghanaian in discussions of such, we also have sense and can make laudable and sane arguments regarding law and everyday practices. The average Ghanaian is already a lawyer i can assure you.

Article 97 clause 1: A member of Parliament SHALL vacate his seat in Parliament - g) if he leaves the party of which he was a member at the time of his election to Parliament TO JOIN ANOTHER PARTY OR SEEKS TO REMAIN IN PARLIAMENT AS AN INDEPENDENT MEMBER; or h) if he was elected as a member of Parliament as an independent candidate AND JOINS A POLITICAL PARTY. Does the Constitution require a written notifications from the affected political party before this provisions are enforced?

With my layman knowledge, I don't think it lies in the bosom of the affected political parties to notify the speaker. Any parliamentarian can do so. In such cases, the most important thing to consider is the action taken by the said parliamentarian

Is the law talking of an action now or a future action? The law is talking about an MP still serving joining another political party or being an independent candidate or an independent candidate joining a political party. Let's stop this hypocrisy.

What does the Constitution say? And how was the same Law applied by the Speaker from the same NPP the last time around? Why are the NPP MPs seeking to have the Law interpreted differently this time? Isn't it because its application as done in the past is now going to affect the NPP negatively? What is good for the Goose is also good for the Gander. It has always been the behavior of the NPP that it is above the Law and can choose to do as it likes, regardless of what is generally and legally known to be fair. But it is undemocratic for any Party to behave that way. This case is simple and straightforward. The Supreme Court should not even waste resources to hear it. It must dismiss it upfront. Afenyo Markin is only acting the way he naturally is, a hypocrite and a cheater. It is the NPP that set the precedent the NDC is asking to see implemented.
