The Church is following the Twelfth Article of Faith by strictly upholding The Religious Land Use and Institutionalized Persons Act of 2000, and the Texas Religious Freedom Restoration Act. It's the municipality of Fairview that has no regard for the 11th Article of Faith.

@@lauriewilliams3402 I am UK LDS so have limited knowledge of US law but it seems to me that there is a conflict between the US constitution, religious freedom, and zoning laws as ensconced in civil and community law. As a consequence, these need to be ranked in order of obedience; dare I say the first law of heaven? Listening to commentary, it seems the US constitution and the associated civil liberties outrank local laws. Therefore, to state that the Church is at fault is shooting at the wrong target. The state and federal laws that give religion precedence is what is wrong. If you are basing your argument on moral grounds then that needs to be transparent and no one, yet no one, gives a toot about morality as there are no consequences. People jump up and down and scream ‘foul’ then they run out of steam. I recognise that west is least and east is best, but perhaps there is a greater need for civil, urban, rural protection overarching religious rights. Or is that blasphemy?

My Aunt and Uncle-in-law are LDS (I am a life-long Lutheran) and live in Heber. I recently asked my Aunt how she feels about the new temple hoopla, and she is all for it, because it will be closer to her to go to, to do her genealogy. I was surprised. That area has beautiful scenery, and I thought for sure she would be against the fact that it would be blocking people's views of the area. I don't know where it is in relation to her house.

The Taylorsville temple is in a lot that is currently zoned SSD-IN (Site-Specific Development - Institutional). However, it was zoned R-1-8 (Single family residential, 8000 sq. ft. lots) until it was re-zoned for the temple in 2020. It's an easy mixup though, as it directly touches residential on the west and south, but is directly across the street from commercial on the north and the freeway on the east. Still, half commercial is much better than the full-residential that they want in Fairview.

After 64 years of membership, I’m glad to have left this LDS corporation. We lived in North Dallas for 15 years and even helped build the Dallas temple. Texas has a lot of undeveloped land. Move out there!! 😮

I just saw this parallel between the temple experience and the Church lawyers promising the Fairview citizens that they have to build the temple to see the blessings that will come. In the endowment ceremony in the temple, you’re told you have to agree to eternal, binding agreements BEFORE they will tell you what those agreements are. Would you buy an expensive car at the edge of your income based on the salesman’s promise that “you’ll love it”? Trust us. We’re from the Church. Would we ever lie? Run from such!

I am a member of the "LDS Corporation" since I was born and the Church has been nothing but bullies in matters having to do with temple building lately. Temples used to be very special and greeted with lots of joy and fanfare, but in recent years it has become more annoying and even redundant. Inventing steeple doctrine to facilitate political ends is a disgusting move from a doctrinal standpoint. I am from Hawaii and our temple -- first to be built outside the US -- has never had a steeple.

Land use and zoning aren't my area of legal expertise, but I think the mayor and council did an excellent job of setting themselves up for winning a lawsuit. The mayor made it clear that they were not discriminating on the basis of religion, but rather that their decision was based solely on the neutral ground of zoning regulations. He told them that if they built in the commercial part of town they would likely be approved with little trouble. Texas is in the Fifth Circuit, which I think will be friendly to the town if/when the case goes up on appeal. I realize that the church won in Boston, and I don't know the details of that case, but here, the church isn't asking for a small exception to the law. Rather, it is demanding (and extorting) a wholesale disregard of the zoning laws. I wish the town well. If churches can walk all over completely secular land use/zoning laws, then our laws are at the mercy of organized religion. It will be interesting to see what happens if the Satanic Temple decides it needs a structure in downtown SLC.

I think the important part of this issue is never being talked about . Number one. The church and its members in great numbers, believe that they are the only true, and that their people and they themselves talk to God in one way or another. This causes some thinking issues. Number two many members and some leaders still believe the old Teachings that the constitution would hang by a thread and would be saved by the elders of the latter-day Saints. This is very problematic when you are right and you are the savior. It isn’t just this is the way Mormons act it is they want to be and think that they will be part of, the world domination at the second coming.

The church already won this fight once in Boston. In the long run, it will probably win again eventually, either at the state high court level, or even at the SCOTUS level. But that would be an AWFUL outcome for gathering Israel in that area. People who were either pre-disposed to like us, or who had zero ill feelings toward us, are now firmly on the thumbs down side. And for what? Huge spires are completely unnecessary, and do not in any way improve the holiness of the structure. Seriously, this whole insistence upon this ridiculously huge spire has done nothing but stir up the evil spirit of contention, and that spirit will remain there for decades.

If the Church can't build as planned in Fairview they will either submit a revised plan or go somewhere else in Texas. I doubt Fairview would approve a revised temple plan at this point. But the Church still owns the land so there are other options for building other structures (like a Bishop’s storehouse or a Deseret Industries) that may be approved. Texas is the largest state in the continental USA, so there is bound to be somewhere near Fairview or elsewhere in Texas they can acquire as a new location for the Temple. So no, the Church has not failed in Texas. Hopefully this has been a learning experience for Church attorneys, etc. on how to be a more humble neighbor in the next community.

As members of the church, we are taught that we have to take sides (Who's on the Lord's Side, Who? Now is the time to show...), and obviously our prophet and our other inspired and set-apart leaders are the ones on the right side, and our personal worthiness before our Eternal Father depends on our loyal sustaining and supporting of those leaders, and also being sure that we do NOT support any groups that oppose the Church. My life was simple when I believed and followed that view. When I realized that the exact same men who I was always sure were the real-life "true messengers from the Father" were also men who often teach "the philosophies of men mingled with scripture," it absolutely blew my mind and turned my life upside-down. It was too complex for me to handle for the next 2 years (and counting...). I can't blame these members for not being able to compute the complexity of their leaders being the ones in the wrong. To them that's not even a possible permutation of reality. The Lord has revealed his will about the temple to be built, and the leaders are clearly on the Lord's side. So it's a simple black-or-white, right-or-wrong, all-or-none issue. The only explanation is that the opposition is blinded by and under the influence of the Adversary, even to the point of fighting against God and persecuting the saints.

On our way to and from, we pass a smaller town with a newer LDS temple just off the freeway. (Yes, smaller temples exist, LDS leaders, and you know it.) Man, Nemo and Peter’s comments about the cultural differences bum me out. It’s interesting to see how different the Church acts in Britain. I hope the First Amendment isn’t used to find the biggest bully who demands the most wins. Insane to me that’s even a possibility here. Makes me want to read a bunch of the “RFRA” and RLUIPA case law and see what the likelihood of success if the Church sues is.

The naming convention of the church (calling temples by London, even when it’s 40 miles away from London, or McKinney when it’s in Fairview) - started with Joseph smith and the Book of Mormon when he says Jesus will be born in jerusalem (rather than Bethlehem). … they are just following their own convention. I think Peter is spot on that there is a lot behind the fact that these temples are not going to be prefabricated and it's too hard or expensive to change that process. Someone needs to follow that money

I think its amazing that in both Kirtland and Nauvoo the saints were persecuted for encroaching on the rights of the people who were already there. All these years later its still the same thing. "God told us it's ours so its ours."

Hi Nemo, I would like to apologize for not defending your position on the Murph's podcast. I made this remark within the video comments "Honestly, the hyer-fixation on steeples is driving me nuts. It didn't start with Nemo. He quoted Elder Bednar that mentioned that there are no such things as small temples because it is about the ordinances. Then, he quoted President Nelson about the importance of ordinances. Obviously, now he thinks the symbolism of the size of the temple is worth the possibility of a lawsuit. Nemo went through the list of temples with varying heights, and some of them are lower because they don't have steeples. Nemo's point was that the temple's height religious symbolism wasn't church doctrine, but the church is now claiming it as such. I agree with his argument. I have to apologize to Nemo for not mentioning this on the podcast. It seems like this hyper-fixation about steeples is coming from supporters of the church's argument. Fairview rejected the overall size of the temple."

Why not build across town you ask? Because go to any temple town USA, and they're built right next to the Stake Center, which is where 651 E Stacy Rd, Fairview, TX is. So ya - the church will go to the matt on this one.

would love a talk through the Sutton Colefield/ Brum sight. 'multipurpose building' has accommodation - is that for missionaries based at temple? and some posher ones for the more important. And the temple floor plan seems to be half changing rooms... Would love to have a talk through what will happen where. Is contemplation the celestial room? Instruction = endowment?

Hey doing a call for any active mormon who could pull up if the VEGAS temple is always full? I just found out they are trying to build another here is Vegas and this is a VERY mormon city (odd I thought so too but not the more I learn of the church) and I think city council let it go cause no one knew about it till the news on this temple came out. Need help to see if the #'s match when they say it's "Needed"

Nemo, you have ignored UK building laws that can override community and parish laws and enforce the building of houses by reference to the government. Indeed, the current labour government have said they want to build 320,000 houses in the UK including green and grey belt land. So to state pushback by local, civil and parish councils is erroneous

This has been happening prior to the election of the current government. We live in a largely agricultural area and despite objections to planning for projects where there is no infrastructure the large building companies keep submitting applications that county councils haven't the money to object to.
