In a few of the cities I serve I already know there will be many low income buyers that cannot afford to pay the agent in that case they will go to the listing agent or be at a disadvantage when making an offer these lower priced homes are still in bidding wars - this change is going to put my market in turmoil

People can't afford buyer's agents because of the price fixing this industry has engineered. Buyer's agents will go extinct, just like travel agents did. The only reason buyer's agents have survived is due to the rigged pricing.

DOJ says that they can still use current federal programs if seller pays the buyer fee, not the agency.

Thanks, Jack. I believe this situation has unfortunately opened the door for a listing agent to discriminate by offering varying commissions to agents based on their race, color, or creed.

OR... how about the buyers just pay their own agent theysame way they pay for everything else? Buyer wants a car. Buyer pays for their car. Buyer wants an attorney? BUYER PAYS for the attorney. Buyer wants an agent? Great! Buyer should pay for it. It's called NORMAL.

@@GramMedia-qj3tm As a seller, I don't care however many % go toward BA commission, rate buy down, furniture reimbursement, etc. I only care about my net proceeds. It's not discrimination if the only color I see are the shades of green.

From ten thousand feet the fact that the only amount that can be earned by a BA is set with the singing of a BRA makes it easy to assume that the potential for steering is gone. Buyers who agree to work with an agent who say they will only show them homes that are offering BAC are choosing an agent who is looking out for themselves vs the buyer. Any buyer who signs with an agent that say we will have 2 BRAs, one for you and a higher one to show sellers, are also signing with an agent mostly looking out for themselves. The steering is happening at the signing, #BUYERBEWARE

It seems like there's plenty more than just steering that was found by the Sitzer jury. It looks like there has been Sherman Anti-trust Law violation on pretty much every realtor mls transaction where the two opposing agencies openly "cooperated", and the plaintiffs believed, and the jury determined, that cooperation is notihng more than a euphemism for collusion.

Because agents don’t get it. You can’t show a home without a buyer agency what you agreed to on the buyer agency with the approval of the buyer is what you’re gonna get paid. So how many buyers are gonna pay 3% for their buyers agent realistically? A better question is how many buyers agents Are going to be able to have the conversation about compensation with their buyers to get it even signed? So what will happen is agents will sign for less than what they’re worth for example one percent in some instances. And it doesn’t matter what’s being offered because they only can get what they contractually signed with the buyer. That’s what people are not getting doesn’t matter what the sellers offering what matters is what you sign with the buyer, you cannot take money outside of that.

So here is what you are telling me. The NAR permitted steering, and then said it was against their ethics, when it really wasn't. But then they allowed steering. Interesting that it was allowed, but it wasn't. Who do we report these violators to?

Exactly my point on LinkedIn post I did today. Agent to agent behind close doors commission discussion ……ie if one agent is known to listing agent vs another . This issue seems to be much less transparency than a posted 2.5 or 2% commission. We don’t see 3% often if at all. Don’t know who the agents were steering that brought up this lawsuit. But that wasn’t done in my area. At all. And how would NAR steer. Do they sell houses? This in my opinion going to cause some interesting new issues….and I agree with previous post. My clients are constantly on line and STEER ME as to houses they want to see. NO ONE was looking at commissions on the mls. Fixing what did not seem to be broken.

The only STEERING I HAVE EVER BEEN INVOLVED WITH IN 20 YEARS iS when I’m driving my CAR. I HAVE NEVER SEEN ONE BIT OF STEERING. NEVER ONCE IN MY LIFE HAVE I STEERED ANY CLIENT. THIS IS PURE BULL S--!!! Want to eliminate steering and have transparency leave the compensation on the MLS. So now compensation is all behind doors. Agent to agent phone calls. Now thats real transparency. NOT. !!!!

There were numerous documented examples of steering presented at the Burnett v. NAR et al trial. The jury unanimously delivered a GUILTY verdict. Steering is the fundamental crime that leads to artificially elevated agent fees.

According to the MLS Research Data, "steering" was never an issue......NAR is just appeasing the DOJ now. Buyers can look at anything an everything online if the choose.

Steering can still happen. If agents post the buyer commission rate on their own websites, what would stop an unethical from sending clients to only higher commission listings? It seems to me, the only way to stop steering is not to have commissions advertised anywhere. I think that is DOJs position...right? Perhaps that NAR rule protects NAR and pushes the liability to any unethical agent or broker. Thoughts....
