Carlton McPherson, the suspect accused of pushing a man to his death at a subway station in East Harlem last month appeared in front of a judge on Wednesday, where he was indicted for second-degree murder.

I could only guess it's less legal wrangling (No motive or hard to prove) on the DA's part since mental illness is going to be the defense's strategy for trial, sentencing or both.

Many times, a reasonable Prosecutor will consult with surviving family members and provide all the factors in play, ie. criminal/mental history, evaluation findings by forensic psychiatrist, conflicting witness statements, etc

Also DAs aren't always going to be prosecutors. They may look at starting a private practice or hiring on with a lawfirm. In essence, they're "working on" their resume. They can't only pick easy cases, so they sometimes prosecute a lesser charge that is more likely to get a conviction (or plea deal for guilty plea) than a higher charge that is 50/50. Would you hire the lawyer who has 98% conviction rate (wins) or the one with 78% conviction rate?

I'm a New Yorker and pass the 125th street station on my way to work! The Aunt tells how it is! He is vecious and evil, and now claims mental illness. The city needs to do something about all this crime! First time I'm actually thinking of leaving this city! It's become Gotham City! You need to constantly watch your back. Riding the subway is like playing Russian roulette with your life. But what can you do? You must ride it to work! I'm so sorry for this family's loss. A needless act of cruelty!

My train stops there everyday on my way to work an back. You wouldn't believe the amount of dudes (who look like the suspect shown in this video) that cause trouble on the trains. Sometimes, the stand in between the train doors, preventing the train to leave the station. Then they tell everyone that they will only move if someone gives them a dollar. I hate living here, but I can't afford to live anywhere else.
