Nathan Holstrom him getting away with it is arguable or vague at best, the movie doesn't give you a full conclusion you don't know if Marcus let Toby off the hook and if he didn't then the last line strongly implies that they will try to kill each other in the future

Another nice irony in the movie is Jeff's partner is american Indians. His ancestry had own all these land. Then white men came and stole it. Then bands started to steal from white men. Then since he is law enforcer his death again was from hand of a white men in a war between bank and the poor white. very ironic to me . and sad.
