One thing we should take it to our mind - Students were banned from wearing hijab only in educational institutions by invoking Sec 133 (2) of the Karnataka Education Act, 1983. Otherwise, they are free to wear hijab or burka etc anywhere else. It is claimed that wearing anything in addition to a uniform defeats the whole "purpose" of uniform. Karnataka government believes that it would disturb equality and integrity among students.

I noticed you are not wearing a Bindhi, nice secular touch, by the way I have 2 questions for you , please answer if you see this comment 1) Preethi what's your opinion(judgement) on this udupi matter as a law student? 2) In Sabarimala case, one of the Judge Justice Indu Malhotra said that "some religious moralities may be superstitious to me". Even one of our CJI said that "Religion is about faith and constitutional provisions are nothing but rational". So my question is that , why do we give power to the judiciary body to access the "ERP'(Essential religious practice) is right or wrong? Do you think that can be good?

Every Indian must remember that their holy book is the "Constitution of India" and one must obey & act according to it. I don't know why most of us have a thought that, lawyers are the only one who read/know about our constitutional provisions? Come on makkale, start to read some basic constitutional provisions like "Fundamental rights", "Fundamental duties" etc.,.
@RaviChandran-pi9wz2 жыл бұрын
Dude stop it 😂. Even our constitution of India rules dosent matter in military. They have seperate rules. In our article itself they said education institute can frame their own rules. If that girl studied in muslim aided school there is no problem. The problem arises only when she studied in normal aided school
@rajeshboopathi14342 жыл бұрын
@@RaviChandran-pi9wz You did not quite get the point brother Private educational institutions can frame their own rules - Yes they can 1) What the Muslim girls claim is that, they are denied to school entry for wearing a hijab during the "end of the academic year". 2) Why did the private school institutions failed to inform those students about to not wear a hijab during admission ? The private institution did not set up any rules for not wearing a hijab, and they now denying entry for those Muslim girls by a rule which is not even present in their institution, is wrong according to constitution. By the way, even the Indian Military comes under the Constitution of India
@RaviChandran-pi9wz2 жыл бұрын
@@rajeshboopathi1434 the is fundamental rights talking about private and business freedom too.. which mean private school and college can frame their own rules for the good being among the students. So muslim can wear hijab outside the campus and not inside. If they can't follow the rules they can go to their religious school.
@RaviChandran-pi9wz2 жыл бұрын
@@rajeshboopathi1434 actually there is no rules mention. And there is no proof of that.
@rajeshboopathi14342 жыл бұрын
@@RaviChandran-pi9wz Nanba very simple For example : I create my own school nanba ok, and I make a rule that muslims students are not allowed to wear a hijab in my school ok. In this case, if some muslim girls are wearing it, then it is wrong , why? Because its a private institution and I set my own rules there. But in udupi case, there were no rules set up by that private institution about hijab, so now you have to allow students though if they wear Hijab

When education can mould a person why couldn't it been said in a ethical way instead of prohibiting and spreading a news everywhere ....like in a Vivek comedy "am I so strong or is he so weak" likewise is the school so weak or the media is so strong?
@preethilaw2 жыл бұрын
Firstly, religion and politics are inseparable in our country. There are people out there who wait 24 x 7 with their eyes open to ignite the spark. Secondly, when you say media, we all are to be blamed as we all like to play the role of PRESS and take it as our duty to spread every single message we receive without giving it a rational thought. If you are referring to a Meme video I don't know what it says. Don't take Memes seriously. Most of them do it for fun and most memes do not have anything important to convey.
@Uncoveredumbrella2 жыл бұрын
@@preethilaw I'm not referring any memes actually when Vivek hits a person he becomes fatal and it is there where this dialogue is heard.....when religion has freedom I don't think it's moral for an educational institution to prohibit actually this is the only issue ...why would an institution actually prohibit his fellow students when an institution is recognised for teaching moral and educational values to Thier children ....if according to the institution all are equal and that is why they have prohibited the children could have defended by saying if all are equal what is our common religion ? If you don't like coffee you can have tea but what is like when it comes to religion ? Because it could be a serious propaganda ....people are bound to faith and worship and it's immaterial to fact because no judge can order anyone to choose to practice this religion according to justice or that religion .... Actually that is why I said refering to that joke

Yes, such a case went before SC when a sportsman was disqualified for not wearing helmets in sports competitions. It's not decided yet. However, many States have given exception or made special provisions in their State laws allowing Sikhs to wear turbans (Eg- exception from wearing helmets, educational institutions etc).
