According to HMA, this arrangement is violative of Hindu marriage Act and the agreement is also void so technically the arrangement cannot be declared as workable and it is void ab initio. Now my question on this, In this case, if multi-marriage is allowed by court on the basis of mutual understanding between two parties i.e. 2 wife's and 1 husband then why there is an issue for LGBT (gay and lesbian) marriages even though the two gay or lesbians involved in such marriage want to get married on mutual understanding grounds only! Why our law-makers denyed such marriage by giving very lame excuse that "Hindu marriage only talks about the marriage between different gender marriage with one husband and one wife and not for same gender marriages". Why can't such wordings can be added or appended in the law, on requirement basis!!! Note : I'm neither an LGBT activist nor against law but such examples are clear indicators of Gender biasness OR inequality among the human beings.

Indian contract act,1872 under section 23 says that an agreement is void if the object or consideration of such agreement is illegal. The agreement in this case among husband and his two wives is void and has no sanctity in the eyes of law bcz bigamy is illegal according to the section 17, Hindu Marriage Act,1955. Hence husband’s second marriage renders his act worthy of 7 years imprisonment under Section 494, IPC,1860 and his second wife will not have any right whatsoever given to a legally wedded wife. She is is equal to no wife.

Govt is treating Marriage like a business contract which they allow to break with divorce.But govt has done really wrong by not punishing adultery. Adultery should be punished with atleast 6 months in jail and then divorce. Adultery causes mental trauma and causes instability in the society , decreases the morale of family values ,individuals, which is why it should be discouraged. And best way to discourage it is punishment. Divorce is pointless. Because divorce isn't punishment. Many men and women may deliberately commit adultery for getting divorce and then repeat the cycle...Which is why adultery should be punished by law to discourage it. Also punishment of adultery will also make people choose their spouses more wisely.

I don't know if Hinduism allows it. The thing which I've heard and in most of the cases, court's views were never supportive of such actions. But the strange thing is no lawyer raises question when courts allow prostitution as job, I mean, who are going to be there customers, Do we not know that, Not all unmarried persons are going to be their customers. There will mostly be married persons. And if so, Is indirectly court is allowing adultery to happen because it has a certain view over this matter. If they're having such views, then why don't they ask authorities to regularise it and tax it as per the gst/corporate tax/income tax/service tax/vat and relevant service and trade charges and make them compulsory to have medical fitness certificates from govt hospitals (atleast every quarter) to avoid health bills to shoot up. Judiciary isn't solving problems but complicating it. If they really wanted to solve the problem. Then, just end the saturation at top SC & HC Have reservation of 1/2, gender parity of 1/2, religious representing of minorities as per their population of 1/5. About marriages and divorces and changing of faith. It must be private affair. If both wants to stay with each other. Give them marriage certificate and if they want to end it, give them that certificate. Just take the fees and verify the details and give them the paper. That's it.
