He is a better speaker than even the greatest exponent of English, Shashi Tharoor. This young man's a pleasure to listen to. The points are very clearly explained and there is no convolations and obfuscation of sentences that confuse the listener or deliberate use of words that even most native English speakers would be hard pressed to understand. Hats off to this young man for speaking to the audience and not at or over it.

The origin of the Citizenship act in India is "unsecular".According to the speaker himself the leaders then were impeccably secular.Why then were the portions of the act u secular?There were strong reasons beyond religion then.Those very reasons are still relevant. Where was the reason for this speaker to paraphrase Patel's letter?Betrays his bias and intellectual dishonesty despite his learning. He has spoken about orphans,atheists and transgenders,but not a word about Srilankan Tamils.Can he be called anti Tamil?Certainly not.Everything has a context.One can go on and on condemning every legislation.Is there anything wrong in the identified groups. There is a flaw his argument, he doesn't prove the law is unconstitutional by it's intrinsic character but by what it has excluded. That can always be argued as a policy decision based on the situation and can't be argued as unconstitutional unless proven to be malafide in nature. And there is already a precedent set where India have given citizenship to certain groups. So there is an equally compelling argument on the other side.

There are several flaws in his argument. The historical basis that he talks about Muslims returning to India from west Pakistan. He forgets to mention or conveniently omits the fact more than 80% of Muslims in unpartitioned India voted for separate Pakistan. So government of India is just in preventing their come back and giving priority to non Muslims coming in especially because non Muslims are being persecuted... he himself mentions they being persecuted. He is talk only talking technical points without any humanitarian point of view. His point about other religions and transgenders is illogical. This amendment was for specific set of people who are living refugee camps in India who were unable work or go to school. They enumerated who were in the refugee camps and listed their religions. It is as simple as that. But high intellectuals like him and people commenting here don’t understand basic things.

These are sugar coated lectures keeping aside pragmatism. Having degrees don't make you a pragmatist. There was a population exchange in Punjab. So people who came from West Pakistan could easily settle in Punjab. But nothing of that sort happened in Bengal. Muslims in West Bengal didn't cross over to East Bengal, but Hindus of East Bengal crossed over to India (Assam and West Bengal) in millions. This created ethnic problems not only in Assam but to some extent in West Bengal also, especially in northern Bengal. Fresh influx of East Bengalis into Assam and West Bengal happened during the Bangladesh war. 2.5 million Bengali Hindus were killed by Pakistanis. CAA is meant for these persecuted minorities of Bangladesh. CPI (M), during their rule butchered certain East Bengalis who took refuge in marich jhapi, in the Sundarbans.

Let me admit that l am not Modi Bhakt , but a liberal religious person , proud of my religion inclusive of other religions. I disagree with Anubhav on categorising CAA is unconstitutional. The reason is what ever the articles of constitution which he is referring are applicable to Registered Indian Citizens as per constitution but not applicable to refugees or illegal immigrants. I disagree with him on second point of Bangladesh immigrants , when the original CAA proposed in 1948 to restrict or prevent lndian Muslims who went to Pakistan ( don't differentiate east or west Pakistan ) and like to return to India . He is interpreting to his own convenience of winning the argument on why the Bangladesh Muslims are excluded . Point 3, 1948 , our constitution was not added the clause is secular , but it was later annexed during Indira Regime , just to win Muslim Votes. 4. One must remember the situation will keep changing based on the circumstances. The law which was applicable today may not be good for tomorrow. I am against protest and processions towards CAA as that is already passed in Parliament. If we are not satisfied with the present regime just throw it in next general elections as we have done in the past . I don't like anyone to troll me , if you have substance in argument , please address . If you troll my posting what is different between you and Bhakts or desh drohis . I request youth to ask and question the present to provide , employment opportunities , improve quality of education standards and affordable and health sectors , instead of becoming fray to BJPs trap . He only referred to article 14 which is equality before law is applicable to every person whether they are citizen or not. It's same as article 21 which is right to life. Article 14 and 21(only if they are sentenced to death) are enjoyed by every person in the territory of India. These are universally accepted. Then he said article 19 which is not a question of argument here because it doesn't come under the act.

You see secularity is already in the constitution fabric. The court itself said the preamble is the basic structure and nothing thats in the preamble can never be amended. Preamble can be upgraded as you said as per coming years. Supreme court also held that further views on new inclusion into preamble can be said through time but can never exclude what's already there.

*NRC - National Register for Citizens* • A nation wide NRC is yet to be drafted, until it is drafted and tabled in the parliament, people shouldn't jump into any conclusion. • Basically it won't allow any illegal immigrants to stay in India. • People who posses the required documents that will stated by the govt in the nation-wide NRC BILL will be acknowledged as citizens and rest can also apply for citizenship as per citizenship act 1955, section 5 or section 6. • The current NRC is only applicable to Assam and refraining from assuming that the same shall be applied for the whole nation.

His arguments are good but also flawed, He willingly chooses to ignore the specifics of the CAA. Like 1. CAA is to help existing "The Persecuted Minorities from 3 specific countries with whom India shares its Borders". This is addressed as a "specific case" with respect to the Citizenship Act. The act that has been amended 5 times prior to 2019 2. Ahmadis and Shias are self-confessed and constitutionally addressed as Muslims in India. Here CAA is based on our constitutional definition of Muslims which encompasses them as legally Muslims too. FYI google - Ahmadis and Lahore Resolution 3. There are no Jews existing in any of the 3 Islamic nations thus Jew not added. Iran does not share its borders with India and thus does not fall into the specif case addressed in CAA. 4. Comparing UK with Islamic countries to suggest a theological state can be secular is deriving false equivalence. UK has not persecuted its religious minorities. His examples are good but don't apply to the situation CAA intends to focus on. I understand why Govt is on a strong footing with respect to CAA and its constitutional validity. Anti CAA people may enjoy this session for it validates their stand but then there is always more than 1 side to a situation.

We are a secular nation, and if any reprieve is to be granted, it has to be granted irrespective of arbitrary classification, especially if the said classification is not upheld by the constitution. I mean really, why does the CAA have so little compassion for people not comming under its purview? And if this is for practical reasons of limited resources, why this expedient leniency to certain select classes on religious grounds? This itself has a hidden assumption that these select hallowed classes are somehow more entitled to live in India. 2. If you are considering religious persecution in another country, its system of classification has to be kept in mind as the persecution is based on those. Not on the basis of Indian classification. Also, you seem to forget the other classes the speaker mentions: atheists, other racial, gender and sexual minorities. Orphans, people abandoned at their birth... What about people who have converted their religion (and may convert in future)? 3. How can we have data that there is not, and never was, even a single jew who migrated from these countries to India? Could you please cite sources? Most data have the word 'other' for trace categories. The law is not to exclude people just because they happen to be a minority. 4. This was not actually a public speech. It was to the law community. So the speaker mentioned the UK to show the logical distinction between a theocratic and a secular state. Not every debate is about street-wit. I believe the legal and logical basis was very much a reason for the discussion.

@@mrdebraj I see your point but your argument also misses some points 1. I believe you are quoting Article 14 which forbids is class-legislation but it does not forbid reasonable classification. The classification, however, must not be “arbitrary, artificial or evasive” *but must be based on some real and substantial bearing a just and reasonable relation to the object sought to be achieved by the legislation*. The classification is based on "Religious Persecution" which also is the Statement of Objects and Reasons. The amendment attends ONLY to those who are recognized as persecuted for their practicing religion in their respective countries. Classification by CAA is reasonable enough as it is based on "intelligible differentia". 2. And if this is for practical reasons of limited resources, why this expedient leniency to certain select classes on religious grounds? - Coz their persecution and exodus have not stopped and ignoring them for decades has not solved the problem. CAA addresses a problem that should ideally have been solved decades back. But then no one cared to fix the problem for those who came to India seeking refuge from religious persecution. The limited resources is the stark reality of India, Its an economic consideration that Govt needs to weigh in, looking at the larger scheme of things. You don't need to but the Govt of the Day needs to Balance Compassion with Pragmatism and Reality at hand. 3. If you are considering religious persecution in another country, its system of classification has to be kept in mind as the persecution is based on those - Not Necessarily since classification by the state and by the sect are contradictory in nature. For example Shia's are not considered Muslims by the state of Pakistan but Shias believe they are staunch Muslims. Here the definition that you suggest becomes contradictory in nature. 4. lso, you seem to forget the other classes the speaker mentions: atheists, other racial, gender and sexual minorities. Orphans, people abandoned at their birth... What about people who have converted their religion (and may convert in future)? - For all of them the regular way to get citizenship through naturalization is still open. CAA is for people who have come to India pre 2014. The classes you specified will be given citizenship on case to case basis when they come to India. Again CAA is for a Specific case of "Religious Persecution" and it ends there. 5. How can we have data that there is not, and never was, even a single jew who migrated from these countries to India? Could you please cite sources? Most data have the word 'other' for trace categories. The law is not to exclude people just because they happen to be a minority. - I was wrong about no Jews in Pakistan, as of my research there are some 200 jews still in Pakistan who should also have been added to the list but then I also read they choose to go to Isreal and rather than come to India. So yeah the govt should have added them at least for the word even if they don't seek anything from India. Again, the argument is less of legal and more of ideological that I find in most cases. Your suspicion is with BJP and thus you imply that to the act as well. Your suspicion is your opinion as well so it ends there

The reasonability of such classification is defeated by making religion as a class apart from religious persecution, by saying that Hindu, Sikh, etc. who were compelled to seek shelter in India due to religious persecution will not be recognised as illegal migrants. Ahmadiyas, who're persecuted in the listed countries and who've been living as refugees in India, are not covered by the Act. The selection of countries also doesn't bear a rational nexus to the object sought by the Act as there's persecution in other countries too, Sri Lankan Tamils and Tibetans being the case in point.

There is no provision in CAA which says that they cannot apply for citizenship..they can apply... Its just an act for certain section who were persecuted that doesn't mean others can't apply... Why is it so difficult for people to understand that CAA does not prevent either jews, atheist or agnostics from pursuing citizenship in India. It only provides a single narrow window for certain religions which are en masse persecuted on the basis of religion. Why were EWS and OBC sections given reservation after so many years of extension of reservation to SC/STs? Because at the time of Independence SC/STs were priority as a group. The same logic ia evident in CAA. Even brilliant lawyers are acting fool!

First of all Indian constitution is secular only by its name. Indian constitution talks about only minority but not majority. Indian constitution ensure protection of minorities but when it's come majority, u protection is upon u. Indian constitution offer fund for minorities but not majority. Minorities in India can establish and teach religious text whereas it restrict majority and the bizzare thing is That Indian constitution doesn't define who is minority and is majority

Three decades later, the preamble of our constitution was amended to add the word secularism as it was implied by the ethos of our constitution, the whole constitution was not changed

The entire partition was incorrect and unfair. The CAA law is just as Pakistan doesn't believe in secularism and has formed an Islamic state as opposed to India. @@sukeerthda814 yup, one of our teachers is a supreme court lawyer at a UPSC coaching institute, he came to teach us polity on weekends, he told us in class that judiciary is the most nepotistic institution in India run by around 400 families, even some of my frnds are doing LLB from DU, he corroborated with this fact. Another frnd a son of hc judge told us that it's so much corrupt that even a job of MTS in a court can't be filled withoutbribing someone in the upper echelon of judicial system.

Mistake- if CAA cutoff is based on the date of arrival it does not discriminate against foreign birth. The rest of his objections regarding overly narrow parameters doesn't hold water because no such migrations have occurred by the end of 2014.

This law is not really intended to give citizenship to religious persecuted minorities but to distract people from the main problem of our country, to be really honest , immigrants and immigration is not really our problem but economy employment infrastructure is but government dont want to talk about it, we should not allow anyone no matter from any religion to our country as we are lack in facilities and we have other things to focus on. #myopinion
